    On May 2, 2022, I requested via text message to ***** Garza (and his wife, *****) that they returned lawn care items that I prepaid for because I had canceled their services.***** responded on May 2nd that he would bring the items to my house, but he didn't. On May 6th & May 9th, I sent subsequent text messages requesting my items, and on May 9th, ***** said he would bring the items to my house that day; he also provided me with a list of items that he had in his possession that I had paid for. However, he still failed to drop the items off at my house on this day. On May 11th and May 13th, I again sent follow-up text messages asking for my items OR a refund for the paid items. He responded on May 14th that he would bring the items to me that day, but still did not show up.On May 16th, I sent another text message; but instead, I suggested that he just refund me the money for the prepaid items since he appeared to be having difficulty bringing the items to me. He responded on May 16th and agreed to refund me the money. On May 17th, I requested that he send me an itemized list of the items and the cost of each item so we can both confirm what I was being refunded for. The list he provided on May 17th was different from the list he sent me on May 9th, and it was also different from the items listed on the invoice I paid on April 29th. When I pointed out the discrepancy in the items listed, he got upset and asked me to provide him with a breakdown of what I thought I was owed and he would paid it. I sent him an itemized list based on the information he provided me via text and based on previously paid invoices - the total came up to $146. Aer I sent that text message on May 17th with the breakdown of what I thought I was owed, he stopped responding to my text messages. I've sent follow-up messages on May 17th, 18th, 19th, 20th, and 21st with no response from him. I am now out of the items I paid for as well as the money I spent for those items. This is theft.

    I am aware of this complaint by this client. I did stay in communication with her , but due to family emergency and the loss of my father to COVID-19, I couldn't keep up to my end of the deal, which was to return prepaid items that I purchased for her lawn.
    I still have the items , stored away and not used that I can deliver to her if she will accept them. I am aware she is ask for a sum of a invoice. I can pay that off in 2 or 3 payments. As sole proprietor, and not funded by any bank or firm its a bit harder to just refund right out of the pocket.
    I'm glad that she did contact you bbb. I'm not a thief or bully and understand completely how she feels. I would like to resolve this issue as quickly as we can. Please tell ****** that I am very sorry for the outcome of our relationship and wish her the very best.
