I signed my daughter to be a club member for ATWF 11u. The packet that was sent to me about club fee membership stated they would be practicing 2 times a week, for a club fee of $1200 for the season. For the months of Sept- Nov I had paid $800 and my daughter only practiced 6 times. I would like a refund since AWTF did not stay true to their own contract that they made.Business response

To whom it may concern,
All Parents and Athletes was notified at 1st Meeting that our goal was to have 2 practices a week, but unfortunately ATWF does not have a consistent gym to have that many practices now and for everyone to please bare with this low income club to be able to have 2 practices or more once we get a gym to allow outside clubs to use their facility. All parents agreed verbally that it wasn't a probably because at that time I was doing free small group volleyball lessons to help their girls achieve their goals in learning knowing this sport at at very young age to the age of 18 years old. ************** stated a refund because she wanted two days a week practice from jump but at the assessment I stated before she signed the forms that we are working on getting another facility. I prefer to start this season at least trying my best to go through with the club this season with one practice now until another availability open, she had agreed and came to practices and suddenly after a month or less she stopped attending. I told her I was awaiting for another gym to call me back with a yes for practices, she was impatient i guess needed the money to pay off other debts and thought it would be easy to get a refund when specifically in the contract stated no refunds what so ever because the fees were going towards gym rental fees, equipment's, uniforms and admin work that needed to be legally filed in order to have a successful volleyball club. Immediately after that we started two days practice per 6 teams a week and some teams are now practicing 3 times a week. All other Parents and Staff clearly understood with no compliant or requested and refunds. If parents had an issue with anything I as the Director asked them not to sign or registered until we was able to do exactly what we stated in the forms. ************** registered and signed papers and paid her fees to be a part of ATWF program this season. If a Parent decide to leave the club before participating any sanctioned tournament is free to leave without any refunds and everyone in the club clearly understands that's how every club works unless a athlete gets hurt or parent is under deployment then we are able to refund athletes club fee deposit.
However, ************** voided all rules and refund policy due to wanting just 2 practices a week. She paid $750.00 via ATWF cash app account. Each Parent is allowed to pay $200 a month but some Parents I allow some Parents to pay $100 a month. All we ask Parents this season is to pay the club fee for their designated team before the season is out in May 2024. If she was unhappy only receiving 1 day a week practice along with free sessions to make up the 2 days a week practice I would granted her more free Volleyball Lessons until we were able to get an approval from other gyms. ATWF and other clubs in the area does not own a gym but we do our best in the community to satisfy everyone the best way we can without having a gym. Everyone understands that. She is still registered under my club to play this season if she like. I never took her kid off the roster because some athletes come and go. However, next season we are working on a more professional base for the company from paperwork, to website, to mentor, to taxes and legally a Tax business now not just a DBA. So with that being said *************** had a balance of $500 left this season with my 11s team to complete her signed contract with the Club.
I thanked her for her time and believing in the Program and that she was able to come back to finish this season off as long as she keeps up with her club fees and USAV rules.

I am rejecting this response because:
I never attended a club meeting. I paid $800. I have screenshots of every post and every transaction. We never agreed on one practice a week. ******** made that who response up, we never had a real conversation about the club because she told me to just catch up on everything through the posts on Band App. I have screen shots of everything and she never offered free sessions. I have screenshots of her asking for $30 for group session. I will be taking her to small claims courts.
