    ATX Lakesxapes installed a unleveled and unstable boat lift, it caused our boat to slide off and our engine sustained water damaged and now is not working and has to be replace as well as our power pole.

    Upon learning of the client boat's going into the water, the initial conversations with the client were cordial and we were working towards a solution. Within a short period of time, the client and his wife became threatening and harassing, texting non stop and making demands without allowing us an opportunity to investigate what actually happened. 

    They demanded our proof of liability insurance non stop without the opportunity to complete our investigation to put all of the cost on us without proof of fault.

    The client claimed the wrong size bunks were installed which were 12' instead of 10' which is what caused the boat to come off 

    A technician from the Sunstream Manufacturer went to the job site to confirm the lift was installed properly, change the bunks to 10' and we offered to pay for the parts and labor for this service. After the technician inspected the lift and spoke to the client, he confirmed the 12' bunks were indeed fine and the client agreed to keep them. The only adjustment the technician made was 3" on the back left leg stock. He also confirmed the lift was installed properly and we also provided proof of our general liability to the technician to show the client. 

    The client refused to come to an agreement on the final invoice minus any cost to pay the technician and stopped all communication. 

    It has not been determined the lift failed or was installed incorrectly and outside of the leg stock adjustment nothing else was done after original installation.

     

    If proof of failure would have been determined, Atx Lakescapes would have done what is necessary to rectify the error.
