I took out a small loan with cliffs before the pandemic. In the loan agreement it's specifically lays out the loan terms what the loan is secured with and what can be done if I default on the loan. It states this very clearly in the loan agreement. The loan was secured with a toolbox and a laptop. In the loan agreement is specifically states that that is the only remedy that cliffs has if I default on the loan is to recover the toolbox in the laptop no other remedy is allowed unless we both agree on it. It states that very clearly in the loan agreement. Because of the pandemic I defaulted on the loan and for some reason cliffs chose not to attempt to recover the items. They put the issue on my credit report and they wrote the loan off as a loss and collected with their taxes riding the loan off as a loss. Fast forward to 2024 I went into a separate Cliff's location to cash a check for $444.26 and ****** who was working acted like there was a problem with the check and about almost an hour goes by and finally after asking him what's going on he admits that they are keeping the check because of old loan that I had. Even though they already wrote this off and collected through their profit loss statement on their taxes and put it on my credit report. Personally I feel this is criminal but I went to the police and they declined to pursue charges. Therefore I am protesting ****** at the location which he works. I hope a remedy can be settled between us as I'm sure ****** doesn't like his personal information being displayed so blatantly as I am displaying it everyday and will continue to display it until a remedy is agreed upon. I'm hoping the better Business bureau can help solve this issue so ****** does not have to endure my protesting any longer. The loan agreement specifically lays out the terms and they violated the terms.Business response

As the customer stated, he took out a loan in May of 2018 for $400.00 with 7 payments of $78.86, due on the 24th of every month. The customer then failed to make any payments on the account and the total current balance before this payment, was $1,229.05 due to post maturity interest. As a member of Cliff's Check Cashing, the customer filled out a New Membership card which states "I agree that Cliff's may offset (deduct) any sums owed to it by me, for any reason, for services including but not limited to, check cashing, Loans, gift cards, and/or acts of vandalism committed against Cliff's property from any checks offered by me to Cliff's for check cashing or cash offered to or received from Cliff's for any reason whatsoever, including wire transfers and/or pill payments." We made over 175 attempts to contact the customer, with little to no results. Early on he made promises to make a payments but never followed through. On 6/06/2024, the customer returned to one of our locations to cash a check for $444.29, which we confiscated per the new membership agreement. Not sure why the customer is under the impression that his responsibility to pay his debt no longer exists due to the account being written off, but we still expect him to pay what he owes us. The customer's response to us keeping the funds was to threaten to "voodoo Hex" our company and slander our store team member by displaying a sign claiming our employee is a child molester. This team member is a military veteran and is being targeted, personally for simply doing his job. The customer knows he owes us, he told you that he owes us, and we took action to recover part of what he owes us. Taking collateral is not the only option for collection of the debt, as stated in the New Membership agreement.Customer response

I am rejecting this response because:
In the original loan agreement it states exactly what you can recover if I default which is a laptop computer and a toolbox. Once I defaulted I no longer owed you cash money I owed you those items as per the original loan agreement. It states in that document that any changes to that has to be agreed upon by both parties in writing. I have never agreed upon changes to that document. Therefore after writing off the account and not attempting to collect the items that's not my problem you don't get to decide to change what is outlined in the loan agreement on a whim just because you feel like it. Once defaulted I only owed you the items. And on a separate note, I will never stop protesting not only that store but any other store with the same message as I have received information that your so-called veteran is exactly what I say he is. That means Cliff's check cashing hires child molesters which I will prominently display on my protesting materials. I will not stop I might not do it everyday but I'll get back around to it that you can count on. So let's remedy this situation as just arguing about it is not going to allow us to come to a resolution.

If you look at the supposed membership card that contains a thumbprint and zoom close you can see where this document is generated with a paint program as the pixilation is not uniform as it would be if it was simply a copy of a real document. Also looking at the thumbprint and comparing it to either one of my thumbs it clearly is not my thumbprint. This is criminal and should be sanctioned.Customer response

I am proposing a settlement offer... Half of that money was not mine as I was supposed to half it with my ex-wife. To settle this once and for all I am offering to only receive half of the total amount of $444.26. If cliffs check cashing will return my ex wife's portion of $222.13 they will never hear from me again.Business response

***********************, ***. has been in business for over 30 years and the last thing we need to do is alter any customer's membership card. As far as how the card looks after being scanned into the system is beyond our control. The fact that Mr. ***** would make this accusation is non-sense.Customer response

They've not made any concessions. I tried to meet them halfway and they do not consider anything. So therefore my offer is off the table and I want the full amount.

How can you possibly determine that the company made a good faith effort they didn't make any effort at all. I tried to come to an agreement with them I even offered half of what they did not deserve the agreement was laid out clearly in black and white they did not honor the agreement as was specified in the loan agreement. They actually committed theft yet you say they made a good faith effort to address the situation in the complaint. I don't understand this world that I live in right now. I don't understand the logic behind bureaucracies when it comes to making decisions whether corporations have broke the rules or not. You always side with the corporation no matter what that goes for police departments that goes for administrative law judges and apparently it goes for the better Business bureau as well. Why even pretend you're going to try to help a consumer if you're just going to only help the business. I'm extremely disappointed in the processes available to me when it comes to dispute resolution. It's clear that I'm never going to win even though I'm 100% in the right. C'est la vie I tried the high road I'll stick to the low road at least I get some satisfaction out of that cuz this was nothing but a disappointment.Initial Complaint

This is a check cashing place. I was shorted $200 on a credit card load. I tried to reach out to the Dustrict Manager, but no response. I spoke to the store manager and she was very unprofessional. I was giving the incorrect telephone number to speak to the District manager.Business response

July 1st through 21 2023 ***************************** went to cliff to make a payment for her electricity that was around $245 dollars ******************** mentioned that a Mexican women took her payment at the time days later she went to make another payment for $400 dollars for the month of august. She asked a worker if the previous month was paid and the worker said yes but the payment wasnt processed yet . ***** recently received a bill from her electricity company and the amount was around $600 . I her daughter asked why was the bill so high and they mentioned that a past due bill was forwarded to this recent bill and that she owes $245 and if she didnt pay it her electricity was going to be cut off . We went to cliffs to figure things out and they said they would check the cameras but they needed an exact date when my mom went to make the payment since my mother accidentally threw away the receipt. The only issue that my mom doesnt remember what day she went to make the payment and they workers werent able to help out . They checked their computers to see if anything came up but there wasnt any evidence that she made the payment but ***** keeps requesting them to check the cameras but they dont want too since she doesnt have an exact date when she made the payment . ***** had to pay the $245 again so her electricity wouldnt be cut off .Business response

Hello and thank you for reaching out to us regarding this customer complaint. I have tried to contact the customer to try and resolve this issue and I have not had any luck.
I have gone back and looked into the matter and have found that the customer did make a payment in July under her husband's name on July 25, 2023 for the amount of $390.65 and another payment on August 23, 2023 for the amount of $247.41.Prior to the payment on July 25th, the customer made a payment on June 3, 2023 for the amount of $199 under her husband's name.I have checked under the customers name for her bill payments and there hasn't been one made under her name since February 25, 2023. I would be happy to assist the customer with resolving this issue if she could provide us with a date and time that she was in the store. This would help so much with researching into the matter.

Cliff Check Cashing do illegal active at there facilities like let other people pick up money and do transact with out proper state identity it's a company that does a lot of fraud
