    My husband and I were served a complaint by a subcontractor, ***********************, claiming we owe them $24,500 as our detached additional dwelling unit or **** general contractor, MyKabin, did not pay them. This work was completed in March 2023, and we had paid MyKabin in full at that time for the construction. We had no visibility, notice of commencement, or interaction with the subcontractors - per our contract with MyKabin, they were responsible for the management and all payments to subcontractors, and we were indemnified against any legal action resulting from their non-payment. We contacted MyKabin several times in October (CEO *********************) to no avail. Apparently, they have shut down but have not filed for bankruptcy. In the meantime, *********************** has put a lien on our home and is suing several other of MyKabin's former clients for unpaid work by MyKabin, which we believe is wholly unfair given that we have all already paid and they were responsible for payment of subcontractors they hired. On a personal note, given the housing market, my husband and I really scrimped and saved to purchase the **** and are already paying for part of this work via a HELOC, so we are distraught that we have to pay a lawyer and potentially go into further debt because of MyKabin's finance mismanagement of our payments. Not to mention the undue stress and time we will have to spend dealing with this. We now understand that it is **************** law that subcontractors can go after homeowners if contractors do not pay them and this with all due respect seems like a backward and unfair law; at minimum homeowners should be served notice that a lien is being put on their homes initially so homeowners can help ensure general contractors pay subs - that is mutually beneficial for all. Further, this also seems prudent as the state is encouraging homeowners to build ADU's to help address housing constraints.
