Luciano was hired to cut and install countertops and a backsplash in our kitchen. We paid $3600 down payment up front and he wrote the proposal upon payment which we signed and have a copy of. He finished the final install of backsplash around 9 pm on a Sunday (7/31) and I was at work and unable to inspect, my husband said we would reach out to him tomorrow (8/1) once I was able to check the work. Luciano changed the window ledge and backsplash without approval, apparently because he cut the piece too small and didnt want to lose money cutting a new piece. This part is not specifically detailed in the proposal how high the backsplash under the sink should go up, but you are able to tell in photos where the cut was made too small and a piece of wooden trim was installed to cover it up. He also did not cut the pieces to fit the sides of our windows and there is about an 1/8 gap all around that he filled with heavy caulk. The trim pieces or ledges on top of the backsplash are also not to the specified depth of 2&3/8. This IS detailed in our proposal. The seams are wide and the job is unsatisfactory. We told Luciano we would like him to fix it before we pay as the job is not complete and he immediately went to intimidation and threatening to report us for not paying, refusing to do any more work. He has been unprofessional and hostile, and contacting us at inappropriate times and we do not know how to proceed. If he is not going to repair it, I do not want to pay him the $1755 remaining balance (due upon satisfactory completion in the contract) as he did not complete his job and we will need to pay someone else to fix it. He will not respond to us except to tell us that he hopes we have money for court and that no complain, all is professional. I have all documented through text messages. Any help is greatly appreciated. We just want the job complete and to not have to deal with him ever again. Thank you.
