A deposit was given with an agreement that a decision was going to be made the next day to buy the car or not after the car is throughly checked! The following day as we came and did a test drive the car started smoking and many check engine lights came on! So we decided not to but the car anymore but the seller refused to give us back our $2000Business Response

Thank you for bringing this matter to our attention. We would like to clarify the events surrounding the situation described in the complaint, as they do not accurately reflect the sequence of events or our dealership policies.
The customer initially came to our dealership to inspect and test-drive a vehicle. During the visit, the customer requested to remove the engine from the vehicle for inspection by a third party. We explained that this request was not possible, as it is against our dealership policy to disassemble or remove parts from a vehicle before purchase. We did, however, offer the option of a pre-purchase inspection by a licensed mechanic.
After test-driving the vehicle, the customer expressed satisfaction with it and negotiated the price with our staff. The customer decided to place a $2,000 deposit to hold the vehicle for one day while they obtained the remaining funds to complete the purchase. During this time, we clearly communicated that the deposit was non-refundable unless the vehicle was found to have a significant issue during the holding period. This policy was explicitly explained and agreed to by the customer before the deposit was made.
The following day, the customers husband and another individual returned to the dealership claiming the vehicle was smoking and had mechanical issues. However, the vehicle remained in the same condition as when it was inspected and test-driven by the customer, with no evidence of the issues they described. We even offered to transfer the deposit to another vehicle of their choice if there was genuine dissatisfaction with this particular car, but this offer was declined.
Unfortunately, the individuals became hostile and disruptive, verbally insulting our staff, loitering in our customer lounge, and attempting to dissuade other customers from doing business with us. Despite multiple polite requests to leave the premises, they refused, prompting us to contact law enforcement to maintain the peace and protect our business environment.
We stand by our policy that deposits are non-refundable unless the vehicle is found to have a substantial defect that prevents it from operating as described at the time of the deposit. Since the vehicle was not found to have any such issues, we cannot issue a refund for the deposit.
We strive to provide all our customers with a fair and professional experience and regret that this situation escalated in the manner it did.Initial Complaint

I purchased a 2012 Audi A3 from them in February. When I test drove it everything was fine. There was no check engine light on or anything so I made the purchase. I got dropped off the next day to pick it up, drove two blocks away to the freeway and right when I got onto the freeway the car began to misfire and the check engine light comes on. I went back and explained the situation the guy told me to come back the next day and to talk to the salesman who sold me the car. Came back and was told they would not refund or help in anyway because I bought it as is. Now it won't start period and not sure what I'm supposed to do.Business Response

Upon your return to the dealership, our team was prepared to assist within the confines of our policy. However, the aggressive tone of the conversation made it challenging for us to address your concerns fully. While we empathize with your situation, unfortunately, given the circumstances outlined in our sales agreement, we are unable to provide further assistance in this matter. Transaction date 19AUG23, bought the vehicle on this date and on the drive home, it stalled on me the very same night of the purchase and I could no longer drive it on the highway. I was on the farthest left side of the highway and if it wasnt for my quick actions the car couldve caused a car accident involving me.$7200 loan check was given to the business ****** promised me a working vehicle that I could use for work, it however, broke down on me the day of purchase and I was unable to even drive into work the next day. I want a termination of the contract they had me sign because of a faulty vehicle. I wouldve been fine with it had it been a month of continuous usage of the vehicle and Id accept it as my fault but it broke down on me on day 1.Apex Motors Inc. in ******, ********** did not bother resolving the problem, I had my coworker called Apex Motors Inc and he was able to get through to them the second call. They told him and I that it was business and thats that they do not care to delve in any further, so Ive called them ***** times afterwards regarding the check but theyve immediately sent me to voice message each time. Even on the night of the purchase I was able to call ****** the seller a few times before it broke down on the highway and he never responded since before the incident.Initial Complaint

I found a used vehicle on carfax website that was being sold by Apex Motors Inc. in ******, ** around March 13. The carfax said the car was last serviced on Feb 10 2023 and passed safety inspection. The car appeared to be working fine when I test drove it around the block a couple times. I decided to finance the car so I had to wait for approval and for the bank to send them the money so I could pick up the car. I finally was able to pick it up on March 24. I drive off the lot and soon make it to the freeway. I was heading north towards home in *******, **. I made it maybe 2 miles down the freeway before I started noticing slight jerking and the RPMs jumping and falling. It got progressively worse as I continued driving, barely maintaining the speed limit. I barely made it. By the next day the transmission was dead and the car wouldnt drive. The guy who sold the car, named *********************, said the car is sold AS IS and its my responsibility to fix it. He claimed he drove the car to and from ******* twice with no issues. He sold me an unsafe vehicle claiming it worked just fine. I started reading ****** reviews and a month before I bought it, someone else wrote a comment saying he took the car to a mechanic and they told him the transmission was bad and he warned others about buying this car. So ****** knew the car was unsafe and still sold it without disclosing any of information about the condition. He told me to stop complaining about the problem and to fix it. I bought the car for $11.4k and he told me the car was worth $13k so Im still in the safe zone. I had to pay for the parts and labor which totaled over $6500. Other reviews show that over the last two years, other customers have bought cars from them and shortly after the car showed major problems and apex motors claimed no responsibility so this is a habitual problem.
