Makwa Finance worked out a settlement for a loan with me-sent me documentation and had me mail payment to:Makwa, LLC.PO Box 343 *** du ********* ** ***** Check was received and cashed (i have copy of canceled check and proof funds have been removed from my account) July 7 2023. It still has not been applied to my account. I call daily. Makwa claims they have not received the check. I have emailed a copy of the canceled check 4X. No response. **************** agents. simply read from script. "if we havent received it we cant apply it" You have it-and I can prove it. I am uploading proof here. The Company is a wholly owned and operated subsidiary of LDF Holdings, LLC (LDF
Holdings). LDF Holdings is a wholly owned and operated subsidiary of the ******************************************* which is a wholly owned and operated economic arm and
instrumentality of the Tribe. The Tribe is a federally recognized Indian tribe, organized under a

The company funded $800 to me on 9 January 2023. My account #*******. The total today paid including their stated payoff amount is $2,233.90. On July 3, 2023, I paid $452.88 which was the stated pay-off amount on my loan page. The next day, I check my page and saw that my loan was in collections even though the payoff amount was now $0. I called the number listed and was told that I had a $30 late fee that was overdue. As stated, the total payoff amount listed was $452.88. I paid that amount. So why is my loan in collection for $30.00 when the status should be "paid off"?Business Response

Originally, I took this loan out with Makwa Finance due to a financial hardship. Recently, my financial hardship has worsened due to getting sick with covid which has resulted in a loss of income. I am at a high risk for having my utilities shut off and my rent payment is being affected. The interest rate for this loan is extremely high and it is impossible to pay off the loan due to these rates. I have already made several payments towards the loan but I cannot continue to pay into this loan due to my financial hardship and the risk of becoming homeless. Please help! In October 2022 under a financial emergency I borrowed $1400 from this company. Been paying $481.60 every month for a total of $3371.90. This money is taken directly from my social security direct deposit at my bank. Struggling to make the payments every month, I decided to check payoff. To my surprise, even when I was told there was no prepayment penalty, I can only pay off by another $1658.16. The APR as I just found out is 456%. This is a scam, is ***** and a shame! I already paid more than double and Im expected to pay $2408 to finish as scheduled. Abusive to say the least, squeezing people in need. I took out a $600 loan on 12/20. I have been paying $160 every 2 weeks. I have paid over $1400. This company prays on desperate people who fall in to their loan shark tactics. 649% interest. I understand they say they are protected under some tribal government, which is nonsense. I a requesting that the remaining balance on this loan be forgiven,, without any negative consequences to me. On March 6, 2023, I took out a loan for $1000.00 from Makwa Finance. My account number is *******. I had an emergency arise for which I needed additional monetary funds. Unfortunately, shortly after, I was laid off from my software engineer position. I called Makwa and explained the situation; they were unhelpful and just told me that I signed the agreement and was responsible for the loan. While I understand and take accountability for the loan I signed, the terms are absolutely ridiculous, and one would think after someone just suffered a loss in family and employment, that some type of resolution could be reached. After talking with family, I was able to borrow $1000 to repay the loan. Again, I understand that the interest and loan balance is higher than that, but due to my circumstances, I felt that at least paying the principal back would be sufficient and in good business practices for Makwa...also, just to be a human being to another human being in distress. I had a loan with Makwa finance which I paid every month. On Friday, March 31, I scheduled a payoff on this loan for $171. On Monday April 3 they took out the scheduled payment of $168 AND the payoff of $171. That is an extra $168 that they took. Now they inform me that they will not refund the extra or give me a credit for the money they took. I am reporting them for thievery. I want my $168.05 back please. I took out a **** short term loan as a family member recently passed and i needed to help pay for funeral expenses. I was told it would be funded that day and be in my account the next business day by agent, I even Received an emailing stating this. I did not receive the loan the next day actually received a loan about five days later resulting in over $500 worth of overdraft fees on my checking account. Had I known It would not be funded that following day as promised I would have used a different loan company. Then I made an additional loan payment of $400 to pay down this extremely high interest loan down faster. Of course, the agent informed me that if I made additional payments, my interest rate would be lowered based off the amount that I owed that is not the case the payments are still 200 a week for the life of the loan! This is insane and a terrible lending practice!Business Response

This responds to the above-referenced complaint. This inquiry related to a loan from
Makwa, LLC dba Makwa Finance (the Company), which is owned by the *** du **************** of Lake Superior Chippewa Indians (Tribe). The Company takes these types of inquiries
very seriously and would like to provide you with the below information. Nothing in this
communication should be construed as a waiver of the Tribes or the Companys sovereign
immunity, all of which are expressly preserved.
The Company is a wholly owned and operated subsidiary of LDF Holdings, LLC (LDF
Holdings). LDF Holdings is a wholly owned and operated subsidiary of the ******************************************* which is a wholly owned and operated economic arm and
instrumentality of the Tribe. The Tribe is a federally recognized Indian tribe, organized under a
Constitution pursuant to the Indian Reorganization Act of ****, 48 Stat. 984, 25 U.S.C. 476, et
seq., as amended, and is identified on ***************** ********** of ********* list of federally
acknowledged Indian Tribes. 83 FR 34863-01 (July 23, 2018). The Company is an arm of the
Tribe. As an arm of the Tribe, the Company possesses all of the privileges and immunities of the
Tribe. The Tribe and the Company are entitled to tribal sovereign immunity and they are not
subject to state law. ***** *********** N.A. v. Lake of the Torches Econ. **** ****** 677 F. Supp.
2d ****, **** (W.D. Wis. 2010) (holding that entities acting as arms of a tribe are entitled to tribal
sovereign immunity).
The Company issues loans in accordance with the Tribes *************************
Services Regulatory Code and it is licensed under Tribal law. The customers loan agreement
provided that it would be governed by the laws of the Tribe, without regard to the laws of any
state. The interest and fees applicable to the loan are permitted by Tribal law. They were
accurately and clearly reflected in the loan agreement that the customer signed before receiving
the loan. The customer also received a TILA disclosure that outlined the amount and date of
each payment required under the loan agreement. Due to its immunity, the loan is not subject to
state law and the Company is not required to be licensed with any state. The customers loan is
legal.
Although not required to do so, as a courtesy, the Company will reach out to the customer
with an offer to resolve their loan.
