      The contract to build my garage ended on 9/25/2022. Because the garage doors were not high lift as agreed to, I was not able to install lifts before winter, thus I can only utilize half the capacity of my ********* paid for a garage capable of storing 4 vehicles and can only store 2. I'm asking that Gilbert Garages refund me $1140.00 for the 2 places that can't be used for the 6 months of winter. This is based on $95 a month for each storage space that I can't utilize.

      ************* statement, "The contract to build my garage ended on 9/25/22", is a false statement.
      "Start August 1st" is written on the Building Agreement/Purchase Order and signed by ************************
      The Agreement states "Work will begin within 60 days of the contract date and be completed within 120 days from the start date.
      The Garage was completed October 10th, 71 days from the requested start date of August 1st.

      ************** statement regarding "high lift" garage doors as part of the agreement is also false. 
      "High Tracks" are not included as specifications of the agreement. See attached Structure Layout. 

      ************* assumes Gilbert Garages knew his intentions of installing two lifts for storing 4 cars
      Gilbert ****** knew one lift was being installed by the owner.
      Gilbert Garages specified  "Lift by owner-include 5'' concrete and extra rebar as needed"  See attached Placement Layout.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      The intent to install lifts by me, the owner, was verbally discussed with *** during the drafting of the contract so *** was well aware of the intent. He has also agreed to pay for reworking the doors to high lift in the spring, further showing that he knew they were to be high lift. Any competent garage builder should know that a reinforced floor and a 12ft ceiling means lifts are yo be installed. By *** indicating he didnt know he is either a liar, I competent, or both. 

      I believe *** is incapable of accepting accountability for his poor performance on his projects.

      I understand **************** concerns that the agreement was to include 12' overhead door tracks for the 9' tall doors.

      Gilbert Garages has agreed to install the special order taller door tracks.

      Gilbert Garages does not agree to **************** demanded payment of $1,140 as compensation for the missunderstanding and for something not included in the written agreement.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      I paid extra for a thicker cement foundation as well as a 12 foot ceiling with the intention of installing automotive lifts. I could have stored 2 vehicles without paying for these features, thus the extra cost of these features was agreed to in order to increase the garage capacity to 4 vehicles. This was discussed with Mr. ********************** on 3/29/22 when the contract to build my garage was signed and Mr. ********************** is well aware that this was the intent of the design of the garage. The door tracks not being at 12 feet is a mistake on Mr. **********************'s part. Because of Mr. **********************'s mistake I can only utilize half the potential capacity of the garage as designed, thus Gilbert Garages is in breach of contract. The damage due to this breach is only being able to use the garage to half it's potential until the defect can be corrected in the spring. This is storing 2 vehicles for 6 months at $95 each/month, or $1140.

      I will not accept any response from Mr. ********************** other than agreeing to send me check for $1140.00 to cover the loss of functionality of my garage. Any other response is a failure on Mr. *********************** part. Mr. ********************** knows this is his mistake, to deny it is to acknowledge that he is an incompetent garage builder.

      I contracted Gilbert Garages to build a garage with a 4-vehicle capacity. Due to the garage doors being installed incorrectly I am only able to store 2 cars in the garage for the winter of 2022-2023. This is a breach of the contract to build my garage which ended on 9/25/2022. Because of this I require compensation for the 2 lost storage spots from the end of contract to April of 2023 when the deficiency can be corrected and the ******** contracted to build has the functionality agreed upon. 

      I will not agree to anything other than a refund of $1140.00 from Gilbert Garages for breach of contract.

      Clarification; Gilbert Garages LLC owes me $1140.00 for the loss of 2 garages spaces in a 4 vehicle capacity garage do to a defect in construction.

      I am currently under contract with Gilbert Garage to complete a garage build. Nearing the end of the build *** Gilbert fired the general contractor **** on my build. At this point my garage is incomplete. The roof trusses are out of alignment, the roof eve on the south side of the build is crooked, the wrong garage door tracks are installed, the rain gutters are missing and the front fieldstone to match my home is unfinished. Due to an error by the concrete company a poured wall is needed next to my driveway as they dug out the supporting material under the driveway and it has since collapsed. The concrete company also destroyed a 22x20ft section of my back yard for no reason. *** Gilbert has provided no resolution to the change in build price and incomplete work and no resolution for the blatant defects assembled by his crew most notably the crooked trusses, uneven roofline and drooping roof edge.
