    Birch Lending is charging me *****% interest on $500.00. On 8/6/2024 I was in desperate need for money for Bills. I was approved through a lending search with Birch Lending. I was not told interest rate or payment till after I had to sign. That put me in to a panic frenzy.

    Experian. / Tolovana Financial. DBA, Birch Lending. is in violation of multiple laws set forth by Congress in regards to the following account # *******. ** U.S. Code ***** ( 2 )( a ( i ) states that the consumer report does not include information solely as to transactions or experiences ( payment history, charge off status ), between the consumer ( myself ) and the person (r.) making the report. Additionally, 15 U.S. Code 1681 s-2 ( a )( 1 )( A ) states that A person ( Tolovana Financial. DBA, Birch Lending.) shall not furnish any information relating to a consumer ( ******************* ) to any consumer reporting agency (XXX, **** ) if the person knows or has reasonable cause to believe that the information is inaccurate. Tolovana Financial. DBA, Birch Lending. can not collect on a discharged debt. This is now considered a certificate of indebtedness per the *** and income can not be reported. The *** Clearly defines a charge off as Gross or Ordinary income, INCOME DOES NOT GET REPORTED ON THE CONSUMER REPORT which in fact makes reporting of this account inaccurate! I provided a screenshot from the *** website. By Definition, the *** Clearly says a Cancelled debt or Charge off is Income. The reporting of this account as a debt is inaccurate. I never received a 1099-C from Tolovana Financial. DBA, Birch Lending. for the cancelled debt the account #**** / full amount { {$ *******} } in order to file as ordinary income. Where is my 1099-C Tolovana Financial. DBA, Birch Lending. is clearly writing off debt with the *** without sending out 1099-C as required by the *** for debts greater than { {$600.00} }. This is unsatisfactory! Tolovana Financial. DBA, Birch Lending. has been HEREBY PUT ON NOTICE that they are furnishing incorrect inaccurate information. In Tolovana Financial. DBA, Birch Lending. terms and conditions they agreed not to share my information with non affiliates Experian, is not an affiliate of Tolovana Financial. DBA, Birch Lending nor are they " bureaus ''.

    I believe you are doing predatory lending. I've paid $160 5x for a $1200 loan. When I attempted to pay off the loan I was told it was $1400. I've already paid $800 how do I still owe more then the actual loan? You said you can pay off the loan anytime, when you attempt to pay off customer service has no authority to make decisions. Why dont you have a supervisor reachable during business hours. after several attempts to contact a supervisor I get told i will get a call back and no one ever calls back. You threaten me with going to collections but have not offered a reasonal solution.

    5/28/2024 l borrowed $1,200.00 n they want me to pay back over $6,500 on the loan cause they deposited the money in my account. So I think they is over charging me for the interest on the loan

    I mistakenly accepted their terms and conditions to cover an emergency expense, after the first payment was drafted and I checked the balance, I made arrangements to pay this off as soon as possible. I called in the day before my next payment to arrange a pay-off. They then drafted the payoff amount, on top of the regular payment. Quite interesting how they sneak in a ******% APR rate, but accumulate it daily. Meaning I made two payments of $270 and then a payoff payment of $1180. On a $1200 loan. Literally the definition of predatory lending. These places should not be allowed to stay in business. I've reached out to them over the phone and online, and they refuse to refund the second payment, and refuse to address the fact that they are actively engaging in predatory lending practices.

    Im being charged 600% interest on a $700 loan. That should be illegal.

    I regret applying for a loan and giving my bank info I want break my agreement with them especially after reading their bad reviews

    On 2-22-24, I applied for and got approved for a personal loan to help with rent, and I got approved for $900. However, I did not see any numbers in the contract I signed saying what my payments would be or how much I would end up paying in the end. My first payment was $241, so I checked my profile on their website to see why the payments were so much. I was finally able to see how much I owed according to them, under the "Truth in Lending Disclosures", and they are stating that I have an annual percentage rate of ******%! For a $900 loan, they are requiring me to pay $4821.61. This was nor made clear to me when I read through the contract, and this is misrepresentation.
