I have been trying to cancel both my membership and personal training sessions. On 2/8/23 I wrote an email to two different local managers giving my 30 days notice, I provided my membership number along with contact information, no one ever contacted me. I sent another email on 02/28/23 but to the corporate membership stating what I wrote above, again asked for someone to get back with me, no one ever has. It has now been past my 30 days notice and they are continuing to charge my account. This is not acceptable and is very unprofessional. I have advised all of my friends and colleagues to avoid joining this gym now due to their unprofessional behavior.Business Response

I have reached out to the managers at the club and they did not receive an email. I do work at the Corporate Offices and handle the mail regarding cancellations and nothing was submitted. What I did do is cancel your accounts immediately and any payments that have processed since you stated you originally submitted a cancellation do fall within the 30 day cancellation period. With cancellations, you would receive a confirmation from the team regarding a receipt of your request and often times a confirmation number. To simply send an email without confirmation does not cancel the account. Our club staff is always available to assist with cancellation on site or over the phone. Thank you. I submitted a complaint back in November, the company agreed to re-imburse my $217, i said i was happy with that resolution if they followed through so BBB closed the file but they still haven't given me the money back. #********Business Response

Sometime in February last year, I had to cancel my *** membership due to being diagnosed with an automatic nervous system condition. I called the *** on Ray and Rural asking the process and what I needed to do to cancel. Whoever answered the phone (could not keep track due to the high staff turnaround) tried to give me the run around and saying I should stay, when I explained that I physically could not go there at the risk of my health. The gentleman on the phone CHUCKLED and said okay. They said that they would handle it on their end and that I did not need to show up in person and that my membership was cancelled. I even offered to have a physician's note written. I had a personal training contract along with a black membership. I then get an email from *** financial about being charged and not paying. I contacted them and said that this membership was cancelled. I cancelled my debit card and got a new one in case they charged me again. I then called the gym back to only have a NEW person answer and gave the same explanation asking if my membership is cancelled, they said it was and I explained the situation involving ***. I wanted the charges removed due to the membership being cancelled, said they would handle it. I went in person two times, first time they said the manager was in a meeting and would call me back never heard back. Went in again in person to discuss cancelling and they said it was taken care of. The *** emails stopped, and the phone calls stopped...yay me or so I thought. I get a call from SwiftFinancial LLC saying I owe $895.01 and that my memberships were NEVER cancelled in December 2022. The woman on the phone belittled me for not properly cancelling verbatim saying "you should have done that or else we would not be having this conversation so what do you want to do about it". Now I found out that business is harassing people as well even AFTER they pay the amount. I don't understand how a $22 a month membership can rack up to nearly $900.Business Response

I canceled my subscription over a year ago, heard about the fee, i went to the front desk and i was told it was waived because i was moving out of state and i also canceled the membership online 30 days prior. This has been an ongoing complained about company - nearly **** complaints with the BBB in 3 years at this location, and they are continuing to operate with shady business practices. PLEASE HELP PUT A STOP TO IT! Their employees are like predators and all they care about is making sales. They use lies and deceit to get you into contracts. The fail to disclose extra fees. They make promises they don't follow through with. They continue to charge checking accounts for money after contracts are supposed to have been formally finalized as cancelled. They refuse to take responsibility for their errors in billing and they won't credit you back any money. They make it difficult to access managers. They lure customers in and depend on their fine print in contracts to take advantage of consumers. Ironically, they are supposed to be an organization that improves health and wellness, but the stress they cause in numerous individuals for their bait and switches and lack of accountability is NOT okay! My health has declined because I don't want to go to a gym that lacks integrity and because of the anxiety. I tried to close my daughters account in Aug. 2022. They said they would just freeze the account for us, but continued charging us - unbeknownst to us. Then, when we went into them in person to close the account, they told us it was handled, that it was closed, but they continued to charge our account for multiple months past the cancellation date. When contacted, they said they would not bill us, but they continued to do so! They said store managers were unavailable and wouldn't let me talk to the district manager or request for her to call me. They also double charged me for 2 memberships when all I wanted to do was put the membership in my name (as the adult paying the bills) vs a minor's name (my daughter.) They are unethical and they need to be stopped. PLEASE HELP!Business Response

On 10/16/22 I made my last monthly payment to EOS fitness Lake ****. I cancelled my membership and did not visit the gym except for twice in 2023 to discuss EOS fraudulent activity. *** tried repeatedly on 11/16,12/16,1/16,2/16 to bill me for my closed account.My CC company refused to pay them. I was recently contacted by a EOS manager ****** ,who gave me permission to use her name. She told me about all the times they reached out to me. Emails, phone calls, voicemails. She ignored the fact that I canceled my account in October. She ignored the fact that I only visited the gym twice,to discuss my cancellation. She couldnt find any records about any thing positive for me. She DID have a record of my last payment of 10/16. She did have a record of my only two visits to discuss the issues. She did try to Blackmail me. If I rejoined the gym the collections would stop. This seems to be the classic scam. Make threats, get people to pay.****** had all the information to Blackmail me but seemed to be missing all the information about cancellation.Another thing is there ****************************** Total lie. If you call ****************** they will admit they are nothing more than a **************** They also tried to blackmail me with a deal.****** and the other employees work on Bonuses and commissions. *** appears to be a nothing more than a scam operating as a gym. On 10/26/22 I made my last monthly payment to EOS fitness. I visited the gym and canceled my membership.I did not use the gym after this date.*** continued to attempt to bill my CC. The CC company declined to pay after 10/26.In January I went to the gym to complain about harassing calls and Emails from EOS. On February 2,2023 I went to the gym to complain about threats of collections. Basically I was being blackmailed and threatened with collections if I didnt rejoin the Gym.I was lied to and scammed. Basically it was rejoin or be sent to collections. Lied to about ****** Services . ( self admitted billing company) I spoke with the manager at EOS, ******( I have permission to use her name) .She offered me a deal if I rejoined. A poor attempt at blackmail and a classic bait and switch scam. She read me all the times they tried to contact me. Interesting that she never mentioned any of my responses. Never discussed my cancellation seems they cant find a record of it. Yet she admitted Ive only been to the gym twice since cancellation. Both times to discuss my cancellation. This is a true scam . These people are paid basically by bonuses and commissions. Lying and scamming are their way of business.I think its interesting to note that my CC company most likely recognized this classic scam and stopped all payments. EOS has the nerve to file collections on the supposed balance of $74.95. Although they offered me a Deal if I rejoined. *****, the manager admitted in writing, that my last payment was 10/16/2022, that my CCCompany refused to pay them after 10/22,and that except for my 2 visits to discuss my account, I havent been to EOS gym.Business Response

On 03/05/23 I went into the EoS fitness on 51st Ave and Olive to inquire about the $10 membership. I was asked about signing up for personal training. We ended up going with the $25 membership which includes the complimentary workout and declined the trainer(mind you I had to say no at least 2 dozen times). I scheduled my appointment for the complementary workout for 03/09/23. No workout happened, just the representative pushing me into personal training. When I scheduled the workout I told them many times AGAIN I couldnt financially afford to do the Personal training. I said no MANY times but the representative just kept pushing and pushing. I read the contract and it states that the buyer can cancel the PT contract within the first 3 days. We went in to the nearby location on ************************ and let them know we needed to cancel it. They said that because we were within the 72 hours they would put it in for cancellation. We went back to the gym on 51st Ave and olive tonight and asked again about how long we can use the gym until our membership is canceled and they told us that it couldnt be and that we had to pay at least 10/12 sessions for the trainer THAT WE DIDN'T EVEN WANT! Then AFTER all of that the representative proceeds to say oh! Theres also a $50 annual fee that will come out along with the membership fee on the 17th so now we paid $30 to get started with a membership, then have to pay another $50 we didnt know about until after the fact, and somehow NOW $76 BI-WEEKLY for a personal trainer we DIDNT want. EoS fitness is a SCAM and I really wish I never walked in there that day.Bonus: Everytime we have tried to take advantage of the membership we spent so much money on we cant even find a place to park. We checked 4 different locations and all of them are packed with no equipment to use. So everytime we want to go not only is it a waste of time, its a waste of gas.Business Response

My wife and i came in to eos to sign up for monthly memberships the rep **** help us enroll in the black membership and informed up we would have a **************** session which we both agreed to. However we found out we were enrolled in by weekely payments of $88 for my wife and $88 for me as well for weekly personal training which we did not agree to. **** told us that we would have time to think about it and if we were interested we could revisit it down the line. We did not agree to personal training and i have been trying to contact the fitness manager ***************************** who had not responded to any email and also **** who signed us up for this without our permission said he would talk to ******* also. This is concerning numerous lies that the staff, specifically **** and ****, at EOS in ****** have told my husband and I. The following has been going on for the past month.The person who sold us a training contract lied to us by saying we could cancel after 4 sessions but we were charged the first day the gym opened without having a chance to even try the training. We then requested a cancelation of the contract and a refund verbally and in writing. **** told my husband, who is paying, that a refund would be made at the beginning of February, but as of today no refund was made and the account was charged twice. My husband and I have made numerous calls and sent 2 emails. On the phone my husband was told by **** the cancelation was approved and a refund would be issued, but it's been two weeks and nothing has been done . **** called me once about two weeks ago to ask details about this issue and said he would call me back once I reported my concerns but he never called me back. My emails were never answered either. We have given them enough time.At this point, my husband has put a block on the credit card and NOTHING can be charged. With regret, we will have to cancel our membership too if this is not resolved right away. Hopefully you can help us with this matter.Business Response
