On February 21, 2024, BBB requested Sellvia to modify, substantiate, or discontinue claims made on their website (https://sellvia.com/) that read, “WORLD'S BEST RATED DROPSHIPPING SOLUTION”, “Sellvia helps you save TONS of time and money on your ecommerce business launch”, “Trouble-free launch”, “Huge profit potential …We'll provide you with a selection of premium products that face little to no competition and are able to bring you thousands per 1 sale.”, “High-paying customers…You are going to sell to the richest audience segment, so even 2-3 sales a month will be enough to earn about $10K in profit.”, “Launch quickly”, “Manage easily”, “Try Sellvia risk-free…”, “...Start earning up to $5,000 per every single sale.”, “Your easy start to ecommerce…no hassle…”, “LIMITED TIME OFFER”, “Your store brings profits on autopilot", and “We have helped 500,000+ people like you achieve financial independence”. Additionally, the company’s YouTube channel (https://www.youtube.com/channel/UCAZnUnz-NkfLDc3HCB5YvAg) read, “#1 ecommerce ecosystem that includes:” Advertisers must be prepared to substantiate such claims per BBB's Code of Advertising.
BBB's Code of Advertising Section 1 states, The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. BBB's Code of Advertising Section 34 states, Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data. BBB's Code of Advertising Section 28 states, Superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, like “#1 in new car sales in the city,” can be proved or disproved. BBB's Code of Advertising Section 29 states, Expressions of opinion or personal evaluation of the intangible qualities of a product or service are likely to be considered puffery. Such claims are not subject to the test of truth and accuracy and would not need substantiation. 29.2 Puffery may include statements such as “best food in the world” and “we try harder” as well as other individual opinions, statements of corporate pride, exaggerations, blustering and boasting statements upon which no reasonable buyer would be justified in relying. Puffery also includes general claims of superiority over comparable products that are so vague that it can be understood as nothing more than a mere expression of opinion. Additionally, BBB's Code of Advertising Section 9 states, Time limit sales must be observed. BBB's Code of Advertising.
On February 26, 2024 the business responded by email to address the ad concerns. On March 18, 20224 and March 25, 2024 BBB emailed the business back asking for further substantiation. On April 4, 2024 the business responded by email to address the ad concerns. On April 23, 2024 and April 30, 2024 BBB emailed the business back asking for further substantiation. On May 7, 2024 the business responded by email to address the ad concerns. On May 14, 2024 BBB emailed the business back asking for further substantiation.
