On June 22,2021 I purchased Faux Leather Leggings from a seller on Poshmark called Miranda M. but uses @******** in her Poshmark online store . Order# ************************ , I paid $79.99 The vendor from Poshmark sold me pants that do not fit . The XL i purchased is for a woman size 10 evidenced from the sellers conversation with a client ( Please see attached Screen Shot.). The seller never gives a description that the pants run small. I then reached out to Poshmark for assistance since they said they would not release your funds if the product described by the seller is not what you expected. Poshmark did absolutely nothing but offer me a $5 credit instead of my refund. Tracking # **********************Business response

Regarding order #************************, as stated within Poshmark’s Posh Protect policy, areas covered by this policy are undisclosed damage, incorrect or missing item, item not as described, and item is not authentic. The policy does not cover fit issues, meaning if an item does not properly fit. Therefore, we recommend that buyers ask questions regarding measurements and materials before purchasing an item to ensure it will fit and feel as expected. I am rejecting this response because:
Poshmark was made aware that the seller had misrepresented Xl size as a size 10 in a conversation seller had with a buyer. I provided Poshmark with that proof in a form of a screenshot which captures the conversation and I also submitted proof to BBB as proof . XL is not for a woman who is a size 10. Poshmark policy informs buyers that if a product is “ Misrepresented “ by the seller, “ upon buyer receiving the product , Poshmark will not release the funds and will provide the buyer with a Return Label.“ Poshmark was made aware immediately that there was a problem , and did little to resolve the problem. As an online retailer Poshmark did not address the concern and abide by their own policy and statement in ensuring consumers disputes with sellers are handled fairly.

The Poshmark Dispute Management team thoroughly investigates every claim and compares the photo proof with the listing and any comments. After further review, Poshmark found that the item is as described. For this reason, we consider the case closed.Customer response

I am rejecting this response because:The seller needs to improve how she advertises and give a better description about clothing running small. The buyer should never
receive a clothing item described by seller to buyer in a snapshot conversation where she is advising a buyer who wears a size 10 to consider ordering a XL. In the US XL is loose fitting, leggings are known by women to be “strechy.” The product is “ mislabeled“ and poorly referenced. I purchased a product that does not fit as one would expected a XL to fit and stretch as one would expect REAL “ leggins” to fit. In the PRODUCT DESCRIPTION the seller does not mention if the pants stretch,except in the snapshot conversation with a potential buyer, where she says that they do “stretch a little.” Poshmark, real leggings STRETCH! Poshmark was made aware and told this pants do not fit like XL and Leggins should fit from my experience. The product’s advertisement by the seller was misleading and greatly affected my confidence in purchasing any products from Poshmark in the future. Poshmark reassures buyers that if the product is misrepresented they will not release your funds. Poshmark knows this was the case, proof was submitted immediately and they did little to stand by their promise and compromise. Buyers need to feel that if an item is not as described that the company will do what they said they will do and work hard to arrive at a compromise .Sincerely,
