I was in the process of acquiring a truck loan from Topmark Funding on June 20, 2024, which was going through. They require 20% down payment which I did provide which was $6617.83. They also required first and last month payment of $2424. The loan had no APR but when at the end of paying off the loan I would have paid $29000 extra which the agent tried telling me its to pay more cash in my pocket at tax time. **** didn't sound right so I told him I no longer going forward on July 3, 2024. They refunded back only the $6617.83 and held on to the fist and last month payment of $2424. Note I did pay them their service fee of $1500 which they already kept.Business Response

Your review/complaint is not only deceptive, but is also fraudulent. You were not offered a loan, you were offered an Equipment Finance Agreement. Secondly, the document you provided, with your signature on it, states very clearly that the funds are non-refundable. Thirdly, you signed the final contract, (Equipment Finance Agreement), and are now liable for the terms of the contract. The contract you also signed clearly states that it is irrevocable. Changing your mind after voluntarily signing a contract does not legally unbind you from the terms of the contract, nor does it entitle you to any refunds.

I am rejecting this response because: first of all if my statement is fraudulent then I would like you to take legal action against MY FRAUDULENT statement. If not then remove your accusation of fraudulent. If you want to go with fraudulent, then fraudulent is when your agent attempted to use someone else DOT number to get me approved. Talk about that fraudulent!!! And yes I do have the conversations on that!!!There could not be a full or detailed explanation on the why I would be paying over 29k extra when there is no interest rate. The only explanation is I get more tax write off and more money in my pocket. Make that explanation make sense.Business Response

Your statements:
I was in the process of acquiring a truck loan from TopMark Funding and The loan had no APR are both false. As stated, TopMark was not providing you with a "loan", but rather an Equipment Finance Agreement. Please educate yourself on the difference. Additionally, you voluntarily signed the contract and are legally liable under the terms of said contract.

On 3/21/24 I Attempted to take out a loan with ******************************* LLC . After reviewing the contract. I came to see that they did not provide enough information about the interest rate for me to make an informed decision the contract was very vague with no interest rate I am trying to contact them and they are being very evasive . I am rejecting this response because: After talking with them today they still refuse to give me a refund. They fail to provide me with a 3 day Notice to cancel, Even though by state law, they are supposed to provide that and they didn't. However, I did cancel on the same day after signing the contract. Now from this point after talking with them I see, I will have to take them to civil claims court. The only resolve is a full refund for $ ******* . This matter was already handled through your attorney. The documents you signed including the initial Letter of Intent clearly state the proposal was for an Equipment Finance Agreement, not a loan, and was both non-refundable and irrevocable.

I tried doing business with **** at Topmark to get the funding to buy a box truck. I ended up not being able to do so due to a family emergency. No down payment was ever discussed. But, almost 4 grand was taken off my card and has not been returned. At first, communication with **** was great. He would even text and call me to follow up and get the process started. After I stated I could no longer afford to get the loan, it was almost impossible to get in contact with him. Basically 2 months later, he still has my money. I havent received any call saying whenever youre ready we can proceed or anything along those lines. He will not text or call back and will not return my money. 12/1/2023 I finalized a finance agreement with ******************************* I paid roughly $ ****** ***************************** had committed to sending my title information to the Secretary of State {********} which they did.Dispute- the information was sent to the State without the Tax document included and it was rejected and sent back to ******************************* by mail without any tracking. So I was unable to generate revenue due to no plates or registration. I cannot haul any goods with temporary plates in *********** asked for some proration or compensation for this matter and never even received a response to the error that their titling division caused. The Titling documents come from the dealership where you purchased the truck, and M & K failed to send TopMark the required tax form.TopMark sent out the Titling packet to the *** the same day it was received from the dealership.It took the *** thirteen days to return the rejected paperwork.The new packet was sent back to the *** again the same day it was received. I recently became a customer of yours and noticed that the contract I signed completely disregarded the down payment of $15,000 to the $44,319.22 2018 Freightliner we purchased from Enterprise. I want the total of $16,500 paid to you, which includes $1,500 fee that should be returned if the contract is dissolved within 30 days and the down payment of $15,000 by end of day today December 20, 2023.We purchased a $44,319.22 2018 Freightliner m2 26 Box Truck to Enterprise and paid $15,000 down payment plus $1,500 for TopMark Funding, LLC fees (Total $16,500).Offered Options by Broker:Option A: 1st ********************* Institution, 12% APY for $44,300 with a required minimum 18 month installments, then the asset can be paid off.Option A numbers: $44,300 with 12% APY = $55,357 (not including the down payment). Total $1,153 per month and $11,057 paid interest at the end of the term. With the down payment of $15,000 would be $762 per month and $7,313 interest at the end of the term.Option B: TopMark Financial Institution, 10% APY for $44,300 no minimum requirement to pay off the loan at any time.Option B numbers: $44,300 with 10% APY = $53,491 (not including the down payment). Total $1,114 per month and $9,191 paid interest at the end of the term. With the down payment of $15,000 would be $737 per month and $6,079 interest at the end of the term.TopMark Funding, LLC Contract Numbers logic explained for the $1,500 monthly payment: *************** C numbers: $44,300 with 30% APY (30%!!!???) = $65,709 (not including the down payment). Total $1,506 per month and $28,026 paid interest at the end of the term. I was approved for a loan and once it was time to pick out a truck we was told that we can get into the vehicle of our choice but when it was time to purchase we couldnt get our truck. ****** attempted to fund a truck purchase for us, requiring $4500 up front. The truck he suggested was over 9 hours away and overpriced. We certainly considered his option but found better options much closer to home and better priced. He told us that a change would result in NO FUNDING and encouraged us to make the 9 hour trip asap and pickup this truck. He repeatedly assured us that nothing was final until we had been there and taken possession, and the seller had received the money. Imagine our surprise when we informed him today that we would NOT be pursuing that vehicle. We had strong concerns after reading company reviews about TopMark and certainly had huge concerns about this specific truck. His response? He would be keeping our $4500. I am self-employed and I work trying to do all that is legal to take care of my family, and thats my God and men giving rights. I got a *** number and I contacted Ryder Trucks to purchase a used truck to start a delivery business. Since they were unable to finance the truck for me, they referred me to TopMark Funding.On June 14th TopMark Funding debited my account for $1,500.00 for an initial deposit. During the loan process, the representative compelled me to say that I was going to use the truck to do pickup and delivery for my business since I have a home improvement company rather than doing delivery as cargo; but I have a DOT number, and there will be no need for it if I was going to do just that. Thus, the loan got approved and on June 15th, they debited my account for another $1959.12. The contradiction came in as I was shopping for insurance for the truck. DOT requires a minimum insurance policy, and the carrier for whom I will work, also, requires even more insurance to carry their cargo. Meanwhile, the truck remains at the dealers lot.When I found out that cargo insurance was super expensive, and beyond what I was expected to pay, I immediately realized that this will not work out, and I wanted out. The representative then told me to go ahead and get the minimum insurance required by DOT, so I could get the policy issued and sure enough, I went ahead and purchased an insurance policy from Geico, however, DOT must be listed in the insurance policy as well, and it has to be made known that the vehicle will be transporting cargo. Unfortunately, Geico does not provide cargo insurance, so I had to cancel the policy.meanwhile, Topmark debited my account again for another $155.08 for some fees he said were miscalculated. The total amount of money that Topmark Funding has debited from my bank account to date is $3,614.20, and for which I am seeking a refund.At the **** of this 21st century, here in America, this is not supposed to be happening.Business Response

I went to ******************************* to get commercial financing on a trailer for my semi Truck. I have excellent credit. The cost of the trailer was 31K. **** stated he was the underwriter and could get me approved. He stated that the trailer would be $1,032 per month for 48 payments. He stated my downpayment would be 20%. He also stated that there would be a $1500 administration fee and two payments of $1032 which would be for the first month's payment and the last month's payment for the trailer. **** sent me a Letter of intent for me to sign to take the $1500 for the admin fee. I asked him several times how he arrived at the $1032 because the numbers were not adding up. I do not have bad credit. He stated everything would be explained in the final documents. I also asked him if there would be an early payment penalty if I decided to move forward, and he told me no. I felt the numbers did not add up. The trailer was $31k, minus the 20% which is $6200 leaving a balance of $24800. **** stated that it would be $1032 for 48 months, minus the two payments of $1032. That would mean I would be paying $1032 x 46 months =$47,472. I asked him several times over the phone and by email and he could not tell me how he arrived at the numbers. I told him that I felt as though I was being taken advantage of. He kept stating that it would be in the final documents. I emailed and called him several times and told him I was unclear, unsure stressed, and felt pressured. He sent an email and text stating that the agreement had already been sent. I read the agreement and it stated that I could not pay the trailer off early without written consent. I informed him that I would not be moving forward, He never showed me the interest rate or a breakdown of charges nothing was explained over the phone or by email. on 04/26/23 topmark funding asked for a downpayment on a vehicle purchase while they got my loan approved, however once loan was approved at a very high interest rate they told me i couldn't back out. No where was that told to me before, i was told interest rate for commercial deals were same as what i paid last year (2022). this company hides info from their customers and wont refund them. Please looks at the extensive ****** reviews mostly all with same issue of wanting to lock customers in with high rate they wont disclose until the final signing, then they play it off as thats not a interest rate its the cost to do the deal. bunch of scammers i would like a refund for $2215.76.Business Response
