      Mountain Summit Financial approved a loan and issued loan proceeds to an individual that was not me. This was a fraudulent loan and now they want me to run around filing police reports in order to try and resolve this issue. What difference is a police report going to make? I can take time off of work to do this but would rather use my vacation time on vacation and not correcting your mistakes. Identitytheft.gov does not direct a consumer to file a police report. It is not part of their steps towards a recovery plan. I found out about this loan when I received a tax document in the mail. I asked if a credit report was pulled as I have a freeze on it to prevent fraudulent activity from happening and they said no. I also asked how my identity was verified and they said it was through a third party. I want this remedied promptly as I have never applied for a loan with this institution or even heard of this p

      A fraudulent loan was authorized by Mountain Summit Financial *** in my name over a year ago. When I was notified for payment, I made the effort to correct the issue and made the notification to their fraud department. They had very little concern that the authorized a fraudulent loan in my name. I was upset that there was very little security procedures and loan verification. After all that I assumed the issue was taken care of and now I just received a 1099C for $1000.00 debt discharged. This is criminal to authorize a fraudulent loan and then report it to the *** as a for discharged debt. I called and emailed my complaint to their fraud department and now they want me to file a police report and have paperwork notarized. I work for Homeland Security and do not have time to do all their leg work to correct their fraudulent loan. I have been monitoring my credit reports for any red flags and nothing has been reported.       I opened this account on October 2 2021, for $800. 00. I have paid $1188.00 so far....I was told that the principal could be paid at anytime via online but the website was constantly down and down for the entire Christmas and New Year holiday. Whenever I called to speak to someone they said I have to pay it online. When the online finally came up I did a debit but it said it was declined and I had to wait 17 hrs before I attempted another debit, I attempted anyway and then it said I had to wait 24 hrs. I called again and the person attempted to do the debit and said it's not going through But I confirmed with my bank that they were not rejecting the debit and my account was sufficient. This is highway robbery and Mountain summit's convoluted payoff process is designed to keep paying interest. As far as I am concerned the interest racked up after my months of trying settle this account, I have paid in full. The only resolution I want is for the account to be closed with a zero balance. If this is not resolved I will be contacting the *************************** this place needs to be shut down.

      Mountain Financial Summit gave a loan in my name to someone other than me, then sent me a ****c. They have kit done anything to help resolve this leaving me to figure it out... both the "income" that's not mine, for a loan that wasn't mine, affecting my credit since it was in default and written off. Not once did they attempt to "collect" said debt so we could've tried to fix this before it got to this point.

      Mountain Financial approved a loan for someone fraudulently utilizing my name, address, and SSN. I only found out about this when I received a 1099 in the mail last week for tax purposes. Interesting how I received the 1099 but no loan application materials or papers needing my signature in the mail. This is outright fraud. I want this matter cleared up immediately.

      I am rejecting this response because:

      I went to my local police department in Jersey City to have them fill out Mountain Summit Financials paperwork and they laughed at me. They stated they do not and will not fill out “some companies” paperwork. They also stated that was extremely sketchy. What they would do was file their own report which will take approximately 5 days from yesterday. It’s also worth noting that when searching Mountain Summit on the BBB website, I’m not the only person they allowed someone to open a loan in someone else’s name. Clearly not a reputable company if they allow this to happen often without verifying the identity of person completely. Why is it that I was mailed the 1099C to my address 9 months after the loan was taken out but nothing when it was actually taken out in May 2021? 

      As soon as I have the police report in 5 days I will upload it here and  I expect this matter to be closed otherwise I will proceed with legal representation against your company.

      Mountain Summit Financial *** approved a $1,000 loan for someone fraudulently utilizing my name, address and SSN. This loan was approved in March 2021. Spoke with them on April 9, 2021 and again on April 15, 2021. Explained that this was clearly fraud and need immediate action to resolve this fraudulent activity. They were not helpful and did not provide any information in regards to the loan process, approval process or verification process. On February 7, 2022 received a ****-C form filed with the *** which allows Mountain Summit Financial *** to discharge the debt and require me to include the $1,000 as income. Spoke once again with Mountain Summit Financial on February 10, 2022 with no resolution. (Spoke with ******) . They would not provide information in regards to the bank transaction and asked for my banking information? I have filed a police report and FTC complaint. Can you assist with resolving this issue and retraction of the ****-C which was filed in my name. I have also contacted the (3) major credit reporting agencies and placed a fraud alert freeze. This loan company sent me no loan application, loan confirmation or loan approval documents. I appreciate your help in resolving this matter.

      I am rejecting this response because:
      I have not received an amended ****-C (Cancellation of debt) which requires me to include as income on my tax returns.
      This amended ****-C should be sent to the *** and a copy forwarded to me. 
      I have completed Mountain Summit Financial **** identify theft Affidavit and returned to them on February 23, 2022 and also filed
      a complaint with the Maricopa **************************** No indication as to whether Mountain Summit Financial **** will file a criminal
      complaint against the individual committing this fraudulent activity. I did receive a copy of the fraudulent loan contract.

      We have provided the complainant with our Identity Theft Victims Complaint and Affidavit form and instructions on filling it out and returning it to us. Once that form is returned we will investigate the claim and if it is found that the loan was the result of ID theft we will waive the loan balance, correct any reports made to credit reporting agencies, refund any payments taken, flag the complainants information so that no loans can be obtained with it in the future, and correct the **** that was issued. It is not our intent to inconvenience the complainant with these requests, but we do require sufficient proof that a complainant did not take out a loan before we can take these actions, and these requirements are typical among financial institutions.

       

      We await the completed affidavit. The complainant may contact MSF directly if there are further questions.

       

      In responding to this complaint, MSF notes and reserves these objections, as well as all others. MSF has not and does not intend to waive its sovereign immunity.       Hello 
      Thank you for your help. The company has not provided any proof of Picture identification or anything that the loan was taken out by me. The loan is at a 674% APR. I have never taken out such a loan and do not have an account with *************** where they claim to have deposited the $1000.00 . As far as I know it is illegal to charge this high an APR in *******.

      I received a tax form ****-C (Cancellation of Debt) reflecting Mountain Summit Financial *** as the creditor in the amount $1,200. dated 12/31/2021.I have never heard of nor requested a loan from this company.The ****-C reflects my name and address with a debt description # of ***** and account # of *********** company must have opened an account fraudulently for someone using my personal information including social security number. If this form was sent to the **** I will require a corrected ****-C reflecting this form was issued in error due to fraudulent activity.I would like to request assistance with resolving this urgent matter.
