October the 21, I drove from ***** to *************** to attended my class reunion and visit my mom, I did not get a lot of rest that Friday and went about my day normal. Saturday morning between 3am- 4am, I got into a accident. I hit a tree which cause my car to flip over and it was totaled. The accident left me distorted and shaken up but I didn't suffer any major injury by the ***** of God, although I was left in shock for the next few days knowing I almost lost my life due to being tired. The night of the officer had A Superior Towing pick up my car. Unfortunately that weekend they weren't open so I had to pick up my car on Monday which interrupted me getting back to ***** for my Job and to attended to my wife and kids. Monday morning I visit A superior towing with the intention to grab my stuff I left in the car ( ************** keys, work keys and laptop) I was given a sheet of paper at the front desk I was told to fill out so I can go to the back and get my things out the car. No one informed me that I was signing a payer agree to their policy about how much they charge per day if I didn't get the car of their lot. November the 1 I received a mail with a bill for $749.89 which is potentially $840 + dollars today. I called A Superior about the charges informed them that no one informed me of their policy when I came in to grab the items left in my car, the lady on the phone proceed to say I sign a form for it. Again I was confused because I was told that form was just to go to the back and grab my items out the car. I felt like they took advantage of me because of the mental situation I was in still processing almost losing my life and I had also informed the clerk about that I was trying to go back home to my family and my job in *****. I really don't want anyone else to get taken advantage like that again. I tried to set up a payment plan, informing them that I don't have that kind of money to pay out of pocket they did not want to resolve the situation.

When arriving at our facility to remove your property we have a sign with pricing next to the window that is required by law. I'm not sure what the complaint is? The notification you received is a statutory requirement ****** to legally notify you that you have an obligation to pay the fees. Did you think the car was towed at no charge? We do not make payment plans for the services and we certainly did not take advantage of you or anyone else. The fees are regulated by the Broward County ************************* and we charged those fees that is allowed by the Broward County Ordinance. If you could provide me the vehicle identification number I will look into the invoice and see if I can help with the charges, I assume you left your vehicle at our facility for us to dispose of?

I am rejecting this response because: Again the business was being deceptive in a time when I was in shock due to an near death experience. They had me sign documents under the impression I was only doing it to grab my items out of my car. No one informed me of the charges and that I need to remove the car from their property. After a surplus charge had occurred they billed me and made threat to put my car registration on lean if I did not pay. I work out a deal with an junk yard to pick up the car and pay the difference they still proceed to be difficult about the situation. I have never been in such a bad accident so I would did not know the process instead of explaining it to me they took advantage of my lack of knowledge and rush me to sign a document under false pretense without explaining anything. I ask to see the documents I sign but was denied access I told to take it up with their lawyers. Reviewing their complaints on ****** this has not been the first time this business had done such a thing and I am not their first victim. I want other to be aware of their Mal practice. In their email they did nor given a detailed on how to resolve the situation.

      Sincerely,

      Rickcardo Bailey

      ****************,

I want to help you with your complaint, in my first response I asked you a few questions so I can identify the vehicle the complaint is about.  "If you could provide me the vehicle identification number I will look into the invoice and see if I can help with the charges, I assume you left your vehicle at our facility for us to dispose of?" Can you provide me with the vehicle information so I can look it up? I tried to look it up by your name and I am not able to.

If you can help me to identify the vehicle with a vehicle identification number (VIN) I will do what I can to help you through this trying situation.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********,  ************************* says "I want to help you with your complaint," I am willing to accept his help in anyway possible. ************************* says" If you could provide me the vehicle identification number I will look into the invoice and see if I can help with the charges"  The *** #***************** heres also a description It's a 2007 Red Pontiac Gt the front is totalled two seat drive. It's at the front of the lot.

************************* say "I assume you left your vehicle at our facility for us to dispose of?" No I did not, I made plans to get it junked and the workers at the facility turned me down due to me asking to set up a payment plan to pay the difference, No one even informed me the day I showed up about getting the car off the lot, the paper work I signed was to get my belongings out of the car. I told the guy working at the front desk I was from out of town. Days later I received the invoice thats when I came to a understanding that the car must be removed. I called in to work out the situation and was greeted with hostility and threatened by your worker that my registration would be put on lean. Review the calls for more details. ************************* say "Can you provide me with the vehicle information so I can look it up? I tried to look it up by your name and I am not able to.'" The *** # ***************** and you probably wasn't able to find it because your workers didn't process the car properly and refuse to show me the documents I signed. Again it's a 2007 Red Pontiac front of the car us totalled and it has a dent on the top, two seat drive if you visit the towing area you can't miss it. The car is set to be auction Dec 6. I called to speak with you and all I received was attitude. Please provide me a contact number for yourself. I'm willing to work this situation out.

On August 11th, my car was involved in almost a fatal car accident in which eventually caused the car to be on police hold. I was told by officers that my costs would be covered by the county but I had to foot the bill first. Imagine my surprise to see that this company wanted over $1000 for the few days that my car was there. One of the laws that Towing Company has to follow is that the customer has the right to an itemized billing list to ensure they know what they're being charged for. When I called for this towing company to provide said list, they first acted as if they didn't know what that was but then I was transferred to someone who told me that I wouldn't be getting said list because it has "personal information" on it? Yet, they sent me what they called a "Letter" but the man on the phone claimed that they don't send ***** which the "Letter" clearly was with no information. This company has extremely deceptive practices and does not follow state regulations regarding their business in order to protect consumers such as myself from situations such as this occurring.

I do apologize that the law enfrocement agency handling this case gave the customer bad information stating the County would be paying the charges, that was incorrect.

In regards to the information being personal, does this vehicle belong to you? If not that info is personal, you mentioned it was a fatal accident, first my condolences during this very difficult situation.

You stated something about a letter, was it a lein letter? If so it would have pricing and that is a statutory requirement according to SS 713.78.
We follow the state and county ordinance that governs towing to the best of our ability. I will need some more information about the vehicle year , make, model and last 6 digits of the vehicle identification number so I can research the invoice.
I then can respond with some knowledge of the situation.
      Respectfully,
