I have had the worst issues with this company and they have the most shady practices I have ever encountered. I am attaching the document I signed - the notary was not present and no there is a lien on my house from them and they refuse to acknowledge it or remove it. I am now trying to refinance my loan on my house and am having to pay 3% of what I am taking my new loan out for all because they will not remove the lien they are saying doesn't exist. I am livid and am demanding my money back. These people are shady and should be put out of business.Business Response

We have carefully reviewed your complaint regarding our company, and we understand your concerns about the alleged shady practices and the presence of a lien on your house. We take customer satisfaction seriously,and we apologize for any inconvenience or confusion you may have experienced.
Upon reviewing the facts of your case, we would like to address your concerns and provide you with accurate information. Firstly, we want to emphasize that a copy of the contract you signed was emailed to you shortly after the signing. I have attached a copy of that email. This serves as proof that you received a copy of the contract with the notary block executed.
On June 16, 2023, you sent a text message to our Broker asking why a lien was filed against your property. In response to that text we sent you an email clarifying the situation. In that email, we assured you that no lien had been filed against your property. We explained that the memorandum you referred to was not related to any encumbrance on your home but was simply a public notice of our right to serve as your real estate agent if you ever decide to sell your property. We also clarified that only in the event of a breach of contract would a lien trigger to secure the right for which we invested in. Furthermore,we stated that neither the Homeowner Benefit Agreement (HBA) nor the Memorandum was intended to prevent you from refinancing or obtaining a new mortgage or home equity loan on your property. We even offered our assistance in providing any necessary information to your lender.
In response to our email, you insisted that there is a lien on your home when a title search is conducted and threatened to report MV to the BBB as well as to the *** if we did not remove a lien.However, we reiterated that no lien had been filed against your property, and the memorandum was not related to any encumbrance. We also offered to help with a temporary lift of the memorandum if you were refinancing, as this is a service we provide regularly at no cost.
Your latest claim is that no notary was present during the signing of the contract. Our records clearly indicate that a traveling notary named *** was sent to your residence on October 10, 2020, at 11:00 AM. Furthermore, we attached in our response to you the original email sent to you in 2020, which included a copy of your contract with the executed notary block. We did not receive any alerts at that time or thereafter regarding potential fraud. ************** law requires all notary publics to maintain a log recording all completed notarial acts.

I was made to sign a contract under duress. When trying to contact them, I have yet to receive a return phone call. I have called about listing my property and have been caused financial duress due to them not helping me with this. Each time I have been told that an agent will get back to me and that has yet to happen. Hello My name is *************************** I am a current client selling my home with MV reality. I am currently sitting in a closing attorney office with a closing in front of me and I am here alone. I have never met my realtor ******************* and she is not present even by phone or zoom for the sale/ closing. I have been severely under represented in this sale. I had to call and request a new agent after 4 months of my home on the market and 3 views/showings with the agent *********************************. I was then assigned *******************. She told me she would come to see my home/ meet me in person after she was assigned to me and ******* took her lock box off my home and her name from the sign in my yard. **** was supposed to bring a new one lock box. Instead she never showed up, she mailed it and another person came to put it on. I am very disappointed and uncomfortable with the entire way my case was handled. I don't feel the commission is fair because I was not marketed well or had contact with the company/realtors I hired to sell my house. I have text between **** and I as proof. I am trying to decide if I still want to close or walk away and hire a better company. I feel a reduction in the commission fees is well deserved for everything I went through and lost in this process, a job in the city I was relocating in, 2 homes and almost miss my sons graduation. When I asked valid questions such as why she never came to see the home she was selling to be able to compare to the others in My area so the price would be good. I got a vague answer. This was the worst experience I've ever been through. I wouldn't recommend this company to an animal. They bait you by giving you money in exchange for the opportunity to sell your home if you decide to sell but they do not do anything to get your home sold or do anything that market your home to be sold. On July 7, 2022, you inquired about potentially selling your home, and our agent ****** promptly reached out to you. However, it appears that there *** have been miscommunication as you mentioned receiving a message but did not specify if further contact was made.We apologize if there was any confusion or delay in our response.
On September 12, 2022, your inquiry was added to our customer relationship management (CRM) system,ensuring that your information was recorded for future reference and follow-up.
The listing agreement was signed on October 13, 2022. We understand that there was a disagreement regarding the listing price, with our agent suggesting a price of $240,835,while you preferred a higher price of $260,495. Ultimately, the listing agreement was executed with the price set at $260,495, accommodating your request.
On October 14, 2022, we proceeded with ordering the necessary photos and yard sign to effectively market your property.
The photoshoot was completed on November 4, 2022, capturing the best features of your home to attract potential buyers.
Your property was officially listed for sale on November 6, 2022, at the agreed-upon price of $260,495.
On November 22, 2022, a price reduction was implemented, lowering the listing price to $244,495 in response to market conditions or other factors surrounding the home including negative feedback regarding strong odors.
On January 11, 2023, you requested a new agent, expressing dissatisfaction with the marketing strategies employed by your existing agent. As a result, the listing was reassigned to **** who promised to visit Columbia and conduct an open house accommodating your request.
On January 18, 2023, OfferPad declined to make an offer due to concerns about the busy street. However, Open Door is currently reviewing the property for potential interest.
A price reduction to $239,900 was implemented on February 20, 2023, with the intention of attracting more buyers and expediting the sale process.
Feedback received on March 20,2023, indicated concerns about the smell of smoke in the house, with multiple low offers that you, as the homeowner, chose to reject.
On April 7, 2023, an offer was accepted for $234,500, with a closing date initially scheduled for May 7, 2023.
The closing date was subsequently moved to May 15, 2023, and we understand that this change caused frustration. To address this inconvenience, we waived the transaction fee on May 18, 2023.
On May 19, 2023, you contacted ** to request a reduction in the commission and expressed dissatisfaction that the agent did not attend the closing or visit the property. We acknowledge that another local agent,Shinique, was present at the property on two occasions. We apologize for any miscommunication or expectations that *** not have been met.
Finally, we closed the transaction on May 23, 2023, with a sale price of $234,500.

MV Realty operates a corrupt business model targeting the poor and African-********* with unconscionable 40-year-contracts that don't end with the death of the signer and are rightly being sued by the **************** and other states for this. I was also being harassed by their rude agent, ***************************, that conned me into executing a contract with MV Realty. I demanded that he stop contacting me. I don't want anything to do with these scammers and requested to sever our unethical agreement without any response after I told ******* I am never selling and to stop contacting me. No one contacted me after to reasonably settle and end this scam relationship they created. In reality, there is no Homeowner's Benefit that MV Realty offers, it's actually a twisted scheme to work-around usury laws to prey upon the poor, especially African-*********. ************** joined our Homeowner Benefit Program in January 2020 and is currently selling part of her ownership of her property as part of a Home Equity Sharing program; she will become a co-owner of her home with a company who also becomes a decision-maker regarding the property. While not a traditional real estate transaction involving the sale of a house, it is neither a traditional form of accessing equity nor a line of credit via a lending institution.
We reached out to the company ************** works with and offered to either temporarily lift the Memorandum while she completes her transaction, or to subordinate the Memorandum. We do this every day across the country and charge no fee whatsoever. Initially all suggestions were refused by the company ************** is partnering with; they asserted they will only accept a full termination. It is the inflexibility of the Home ********************** causing a termination clause to trigger.
There is no lien, and has never been a lien, on Ms. ****** home. Our memorandum acts as public notice that MV Realty has the right to represent its client for 6 months IF and WHEN they ever decide to sell their home. We do not require anyone to sell; we file a memorandum to secure the opportunity we invested in. MV Realty only files a lien in the event of a breach of contract; ************** did not breach her agreement.
As a result of Ms. ****** persistence with the Home ********************** along with a member of our Client Success Team, we were able to come to an amicable resolution on this matter and avoid undue fees to ***************

We were tricked out of our property. I did NOT SIGN a memorandum and the notary does not match my signature. Some how, MV Realty obtained my signature. I went to the courts and court officals agreed signatures did not match. I am rejecting this response because: MV Realty has lied, and conspired to steal our home equity on multiple occassions. We soon discovered 3 months ago that MV Realty has a lien against the property. Upon revelation of this lien, we ******************** and I personally went to the **************************** and discovered that documents had been filed into the registry as though a closing took place. Upon examination of the documents, discovered that a "**************" signature notarized my signature. Not only that, we discovered a fully executed document with my signature, ******************** signature and MV Realty signature completed on one single document as though we all had met and executed the document in one setting. This NEVER TOOK PLACE.Upon inspections of the allegedely forged documents, it appears that a "cut and paste" has taken place with such documents. We never had a closing, nor have "I, or we" ever met with nor saw the unofficial witness whose signature appears on the document by the name of "****************?". The documents was also signed by MV Realty, PBC, LLC ******************************** whose notary commission is located for the **************** whose commission is expired as of January 30, 2023. These documents appear to be executed on October 27, 2020.
Court official at the Dekalb ****************** Divison also looked and examined the documents and has also confirmed that signatures ARE DIFFERENT as recorded into the real estate divison. From my reconcilation, I DID NOT EVER MEET WITH ANY NOTARY BY THE NAME OF "**************".
It is my testimony that I met up with notary ********************* of West ******* ************* Services whose name DOES NOT appear on any documents recorded by the Dekalb ****************** office. She and I met at The Varsity located at: ************************************************************************ on October 20, 2020 around 8:30 pm at night. She and I both met and I requested *************************** about the validity of the documents. *************************** infomed me that she did not know anything about the documents and that she was only dispatched on an "emergency" basis to meet up with me to gained my signature.
The both of us sat in my truck in the dark to which the notary gave me a 1 page document for my signature. It was my understanding that I signed to receive the check for $645.00. The only thing that *************************** informed me of was that she was called by ************************* to come out and meet with me and that ******************** was not available during the time for her to meet ********************. She just told me to be careful with whatever I was signing and that she did not anything about such documents. It was my understanding that I was signing for ************************* to be our Realtor.
I contacted the notary "**************" at: ************** from the number provided to me at the Dekalb County ****************** Division. ******************** and I learned about these forged documents on or about March 15, 2023 of these forged documents. I then contacted MV Realty represented ************************* screaming to the top of my lungs. I asked her how could they file a lien against our property. That wasn't the agreement. The agreement from our understanding was for her to be our Realtor to sell our property. I asked this mysterious "*************" for her first name to which she refuses to provide to me. I then asked "**************" who was she that I never met with her ever and that I met with ***************************. She refuses to speak with me and suggested that I contact *************************. I also asked "*************" to provide proof that she met with me to which she refuses or that she couldn't provide proof that she met with me to sign my property over to MV Realty. As of today, "**************" refuses to take any of my calls. Out of concern, she contacted ***************************** and asked ************************* was she in trouble. ******** contacted me and shared the concern.
There was NEVER EVER any mention of a 40 year to life loan against our property. As of today, MV Realty's representative has failed to sell our property. ************************* actually left us handing without any representation. She told me personally, "if you want your property close, you can find your own investor and or realtor". I have lots of correponence from her with such information. I wanted to send those documents as well but the BBB site only allows for 5 documents at a time. I would like to submit these documents for your review.
I am dumbfounded to have discovered that it appears that someone may have cut and pasted my signature as evidence submitted to the courts as though a closing took place with everyone in attendance. THERE WAS NEVER A CLOSING NOR DID WE MEET UP WITH *************************** as it's recorded that she prepared such instrucment based on the real estate filing deed book ***** page 695. I am confused as to how they obtained a completed 1 page document as though everyone was in attendance on the date listed on the closing documents. This document has now become part of a permanent document filed
I've since learned that there are a total of 33 common complaints across filed with against MV Realty as well the involvement of the ************************** MV Realty has conspired, tricked and schemed swindling ******************** and I out of our home equity amount in the amount of $12,685.00 disguised as a home equity loan.
MV Realty has targeted us. ******************** and I fall into both categories as we are both disabled and minorites. Our phone number has been registered since 2012 on the National "DO NOT CALL LIST". On or about October 20, 2020, we were solicted by a Broker connected to MV Realty, PCB which by the way, MV Realty does not have an office in the **************** but used ************************* who is licensed in the **************** to conduct their business. They have an agreement in place for 6% to pay ************************* 3% if and when she sell our property.
On the same day that we received a unsolicited call from *************************, broker **** lied an stated that if we allowed her to be our Realtor, she would pay us $645.00. She stressed that we were under no obligations to sell with MV Realty. In fact she stated that if the property doesn't sell within 6 months, that we were under no obligations and that the $645 would be "a gift" as a token of appreciation is how she framed and or coined her pitch.
I am requesting that MV Realty release their name off of our property IMMEDIATELY.

As previously stated,we take such claims seriously and have conducted a thorough review of the facts surrounding the agreement in question. Here are the relevant details we have gathered:
The original agreement was signed by ***************************** on 10/22/2022 and notarized by ***************
Subsequently, on 10/23/2022,both ***************************** and ******************************* signed the agreement, which was also notarized by *******. This revised agreement superseded the original one and became the binding document.
It is important to note that the other notary mentioned by ******************************* did not send the original agreement to us.We have thoroughly reviewed the signatures on both IDs, the *** contract, and official public records. It has come to our attention that both parties signed their names differently throughout the various documents.
We examined the signatures on the recorded Subordinate Deed to Secure Debt, which was signed by both parties on 2/2/2012, as well as a partial loan document from 2016. Upon careful inspection, we have noticed similarities between the letter formations on these documents and the letters in the *** agreement signed by both parties.
Based on our comprehensive review, we have not found any evidence of fraud in the execution of the agreement. However, we understand the seriousness of your allegations and are committed to resolving this matter fairly. I was contacted by MV Realty when I was in need of funds. I was told this was not a loan. It was a good faith gesture that if we ever sell our home, we just agree to list our home through MV realty. I was told this would not cause any issue down the road if we ever did a refinance or line of credit. I was told there would be no issues at all as long as we agree to use MV realty if we ever sell our home. 2023, trying to do a line of credit and we cant. We have to pay a termination fee to MV realty because they have a lien on our address. We can terminate our agreement for a fee of over $16000. Would have never signed with this company if I would have known there would be these type of issues. Was reassured multiple times that all we had to do was use MV to sell our home if we ever decided to. I am not selling my home. Just trying to do a line of credit and having nothing but issues. When I first spoke with MV I had explained I was working on obtaining a line of credit. MV Realty did not pose any obstacle to this transaction. And was willing, at no cost, to subordinate its memo filing to my new lender. Subsequently, after I decided not to proceed with a line of credit, I chose to pursue a Home Equity Sharing transaction. Again, MV offered numerous solutions to avoid any termination fees or other costs that would be owed to MV. Unfortunately, for reasons that Unlock could not explain, they alone insisted I pay the MV termination fee to the Home ********************** as a requirement to closing the transaction. I understand there has never been a lien on this property, and it was through no fault of MV Realty that caused me to owe any termination fee. I reached out to MV Realty to assist with an accommodation for me which they have assisted with.I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.

In 2019 my husband had lost his job and we were going thtough financial hardship. At that time, there were individuals from MV Realtor offering ** $1200 and whenever we want to sell our home we would use themfor 6 months and if that did not work we could go with other companies. You and your husband have been a part of MV's Homeowner Benefit Program for 4 years. Our contract with you grants MV Realty the right to represent you as your listing agent if and when you ever decide to sell your home, and never obligates you to do so. By listing your home on the market without giving ** the opportunity to be your realtor for a 6-month listing period, this is an act of breach to our agreement. Last week, we sent you formal notice as well as followed up with a phone call from a member of our Client Success Team who reviewed the contract with you. Additionally, we explained how easily you can transfer the listing to MV Realty for 6 months and fulfill your side of the contract.
Prior to the filing of this complaint, we dont have record of you calling or emailing our office to express any dissatisfaction with the Homeowner Benefit Program. We can only surmise it's in response to our notice of your breach in the agreement. We take pride in the level of service that we offer our clients, and we want to ensure that we have addressed any issues or concerns you may have. Therefore, we would appreciate it if you could contact our legal department by phone at ************ or email at ******************* so that we can assist you in any way we can.
It is important to note that page 1 of our agreement outlines its terms clearly as forty (40) years OR until you sell your house. By transferring the listing to MV Realty, the contract ends if we sell your house during the 6-month listing period and would not last 40 years.

I was contacted by MV Reality. They indicated that I would receive a check for approx $1500. All I had to do was use there real estate company to be the agent in case I decided to sell if not them I wouldnt owe anything to them. I was told that there isnt a lien just a note placed for public record (this is not true) I was also told if be able to refinance and anything else related to MY home with no issue. However this isnt true either. There is a lien and the accounting department at MV does not remove the note/lien when you conduct business with your home. They are the main contact and will work with anyone related to MY home. I've seen several stories on the news and read articles of this scam to vulnerable homeowners. I was told some of the same things and to find out that it was a lie. The contact doesnt die with me these people will always have an interest in my home until its sold. It is important to note that a listing agreement would be for only 6 months. This means that if MV Realty is not able to sell your home within a 6-month period, you are free to sell the home on your own or with another realtor for an equal or greater value per the owner listing period in the agreement.

However you never indicated that MV Reality would be the contact person for any business I do with my home. I was told that all I do is email and the memorandum would be removed. I clearly didn't understand what I was signing and should have been offered a lawyer or my own representative to help me with understanding the paperwork. Everything was rushed and now I'm being told the complete opposite of what I was originally told before I signed.

I, ***********************, was contacted by MV Reality to sell my house. I told them that this was my forever home and I would never sell it. They told me that they would give me a check for just to be the agent in case I did decide to sell if not them I wouldn't owe anything to them. I was told when I die the contact dies with me. The contact doesn't die with me. These people would still have an interest in my home until it's sold. This company lies to people and steals their homes in the end. I thought I was helping my children, so when I pass, they wouldn't have to find someone to sell property as written in my husband's will. I didn't know that they had placed a lien until I went to refinance. MV realty called the company which I was going thought. MV realty told them they couldn't refinance or they would have to pay money or I would. I spoke with the lady from MV realty she told me the same thing about paying money. I am filing a complaint against MV Realty. In 2019 I was randomly contacted by a young girl named ********************* from this company offering me whats supposed to be a Homeowners Benefit program where she stated they were offering New home owners a cash incentive of $900 upfront with no need for repayment and all they would ask for in return is that we would use their company if we ever decided to sell our home whether it be in a year or 50 years. We were brand new homeowners and we were tight financially and decided to go ahead and take the money to help us get by but little did I know we were being set up for failure, she scheduled an appointment and came with her notary and explained the contract in her own words, I read through it but I could not really understand most of the legal terminology and I did not have an attorney present to explain what I was signing or to guide me in the appropriate direction so I took her word for it and signed, fast forward to 2023 I attempted to try to refinance or acquire a line of equity on my home for some much needed repairs and was not able to, come to find out these people put a lien on my property for 40 years !!! Would they have disclosed that information I would have NEVER signed these documents. After realizing this, I started researching and saw there were multiple lawsuits filed against them and there have been many people aside from myself that unfortunately have fallen victim to this companys fraudulent scheme. Recently, I was considering selling my property and was advised Im unable to do that because no one would buy it with a lien on my land and aside from that I would have to pay 3% in penalties and most likely wont even get the lien taken off. I feel like I have been taken advantage of by these scammers and was blindly mislead into a trap . This is completely devastating and I hope I can get some help Im resolving this issue and being released from this contract. Thank you for you time !Business Response
