I am filing a complaint against Vacation Villas at Fantasy World regarding my timeshare. My wife, *****, and I are both 87 years old, and she is currently suffering from dementia. We are living on a limited income, and it has become impossible to continue with this timeshare obligation.We have no family or friends willing to take over the timeshare, and selling it is not a viable option. Our only request is to be released from our contract as we can no longer afford it.Given our age and financial struggles, we hope for a mutual resolution that relieves us from this burden. The Vacation Villas at FantasyWorld Time-****************************** (the **** is the not-for-profit owners' association that collects maintenance fees to administer and maintain the Resort where Mr. ****** and his wife own a week in accordance with the Resort's governing documents and the law. It operates like any HOA or Condo association. The *** is NOT a timeshare developer that markets timeshares for sale, employs sales people, and makes a profit selling timeshare weeks. The *** did not sell the ******** their week and did not profit from that transaction.
Mr. ****** previously filed a complaint that was closed for lack of his response. He is now filing another complaint. Notably, he has not alleged any wrongdoing whatsoever on the part of the ***, none at all. His sole request is to be "released from his contract". This is not possible as there is no contract to be released from.
The Baxters own a deeded interest in real estate (meaning they own real property) located in **************, ******** That property consists of "floating" time usage. The duty to pay maintenance fees (and the right to use the property) is a covenant running with the land. In this sense, maintenance fees are like property taxes. You are required to pay them because you own the property, not because of any contract. There is no contract the *** can "release". The only option is for the ******* to transfer ownership of their real estate to some other entity. The *** could accept a transfer of the deed from the Baxters but in that case, the other ****** owners left behind would have to pay more to make up for the maintenance fees the Baxters were no longer paying. That would not be fair to them. The *** is required to act in the best interest of all its owner-members collectively, not any single owner at the expense of the rest of the owners.
That said, the *** has created several programs to assist owners like the Baxters who wish to divest themselves from ownership. These programs work in a way that the Baxters' exit would not create an undue financial burden on the remaining owners thus complying with the ***'s duty to act in the best interest of all its owners. The *** will again reach out to the Baxters with current information about these programs.

Mr. ******: We're sorry you have declined our attempts to assist you in divesting yourself of your timeshare. As stated earlier, we did not sell you your timeshare week and we have no duty or responsibility to help you divest yourself of your ownership. Ultimately, that is your own responsibility. Our offers to assist you were voluntary on our part. Nothing in your complaint to the BBB (neither this one nor the prior one) allege any wrongdoing whatsoever on our part. We are the not-for-profit owners' association. We haven't done anything wrong.
Let me give you an analogy. Say you bought a house in an ***. The *** collects assessment fees from all the owners to administer and maintain the *** (the community pool, the clubhouse, the gated entry, etc.). Say you later regret your purchase. The house is too far from work. You don't need that much space since the kids grew up and moved out. The lawn is too much work. Instead of trying to sell it yourself (interest rates have gone up and it's hard to sell), you're demanding the *** sell it for you and complaining to the BBB about it. That doesn't make sense, but that's what you're doing.
Now you're further demanding we mediate or negotiate with you through the BBB complaint forum. That's not what this is, that's not how this works. Again, we haven't done anything wrong. Our (voluntary) divestment programs exist to help you with your responsibilities. Those programs aren't administered through the BBB. You can choose to take advantage of them (as many others have before you), or you can do it yourself by finding someone on your own to sell or gift your week to. Our (voluntary) divestment programs require confidential information (including your confidential information). We don't exchange such documents through the BBB complaint forum and that's not subject to negotiation.
If you are interested in our divestment programs, you can respond to the e-mail that was sent to you. We will work with you to find a program that suits your needs and situation. If we do, then we will make agreement with you. If we later don't do what we promised you we would do, THEN you can file another complaint with the BBB and that would be appropriate at that time. However, finding the program for you and exchanging the documents and confidential information, that simply isn't appropriate for this forum.

I am writing to formally lodge a complaint against Fantasy World regarding their consistent lack of response to our numerous communications concerning critical account matters.We recently received a notice from Fantasy World directing us to contact them about potential exit options for our account. Our account is significantly behind, and we are seeking a resolution that includes a mutual release from ownership and a waiver of the outstanding past-due balance. Despite our concerted efforts to convey these requests to Fantasy World, our emails have gone unanswered. Instead, we have only received automated and impersonal notices via mail.The urgency of this situation cannot be overstated. We are in desperate need of Fantasy World's assistance in devising a plan to avoid collections and foreclosure. On October 29th, *** ******* claimed that nobody from the *** has contacted him. This is untrue. On November 2nd of 2023, *** ******* exchanged e-mails with the ***'s reservations department. Further e-mails were exchanged on November 7th, November 14th, December 6th, and December 14th, all in 2023. Then there were more communications between *** ******* and the *** in 2024 beginning on January 11th, again on January 17th. The *** has tried very hard to communicate the options available to *** ************** The problem is that *** ******* does not like the available options, not that the *** is failing to communicate with him.
Timeshare ownership isn't for everybody. It makes sense for people who can plan in advance and request their reservation as early as possible. It seems *** ******* may not be one of those people and he's blaming the *** even though the *** did not sell him his week. That's like blaming your HOA because the house you bought isn't in a good school district or is too far from your office. *** ******* may have made a bad choice for himself in purchasing a timeshare, but it was his choice. The *** was not involved at all in that transaction. The *** has fully communicated the divestment options available to *** ******* and all of the Resort owners like *** ******* who make up the ***. The *** acts in the best interest of all of its owners, not just one. There is nothing more the *** can offer *** *******.

It appears from your complaint that you may misunderstand who the various entities involved in the Vacation Villas at FantasyWorld Resort are. This all began when one developer created a subdivision consisting of approximately 300 2-story townhomesFantasyWorld Club Villas. Shortly thereafter, a different group, a timeshare developer, came in and purchased (in phases) about 200 of those townhomes and converted them into timeshareVacation Villas at FantasyWorld Timeshare Resort (which is a separate entity from FantasyWorld Club Villas which includes ALL townhomes in the subdivision, including non-timeshares). It is the timeshare developer that sold timeshare weeks, not us. People who purchased one of these timeshares are our Owners. They own a deeded interest in real estate (meaning they own real property) located in **************, *******.
The Vacation Villas at FantasyWorld Time-*******************************, is NOT a timeshare developer, nor are we in the regular business of selling timeshare intervals for profit (we have no marketing power). We do not employ salespeople or closing officers, nor do we receive any of the proceeds from the developers sales to our Owners. We are entirely separate entities.
We ARE a Florida not-for-profit corporation consisting of all the timeshare owners who own a Vacation Villas at FantasyWorld week. We call ourselves the "*******************" or simply the "Association" for short. The primary purpose of the Association is to collect a maintenance fee from each Owner and then use those fees to operate and maintain the resort (provide reservation, check-in, and check-out services, furnish and equip the townhomes, provide cleaning and maintenance services, pay insurance and taxes,etc.). We are governed by a volunteer Board of Directors elected by the Owners. Again, this is a not-for-profit organization so all the maintenance fees collected are used to pay the common expenses.
*************** operates much like a condominium or homeowners association.There is a recorded set of governing documents which attach to ownership. These documents create the Association, set forth the Association's and the Owners'rights, duties, and responsibilities, and create the framework for maintaining the resort. We cant bill some owners and not others. We must bill all owners.
Please understand that the Association was not involved in marketing or selling this week to you. We have no power to rescind a sales contract or refund a purchase price for a transaction we were not a party to. We do not employ any salespeople and cannot be responsible for the statements they made.
A review of the public records of ************** shows that your week (an Annual Gold) was sold to you in June 2014 by the developer, the ******* Resort *********************** (ORDGI) and that there was also a mortgage (with the same developer). That isnt us. It is our understanding that the developer has since gone defunct.
We understand you want us to take your week. As previously stated, we have no way to resell your week because we dont do that. Thus, if we take ownership of your week and you are no longer paying your maintenance fee, then all the remaining owners have to pay extra to make up for it. That isnt fair to them. We do have programs where we will take a week, but only in a way that is fair to the remaining owners. Again, we are not the developer who made money selling timeshares. I am writing to file a formal complaint against Fantasy World, regarding my timeshare ownership. I am seeking assistance in relinquishing ownership of my timeshare due to financial constraints and misrepresentation of prices and services during the presentation. I have owned this timeshare for several years and have never been afforded the opportunity to use my week. I have paid all my maintenance fees on time and in full. Now I am being given yet another assessment fee for Hurricane *** which I have already foolishly already paid. (*** happened two years ago). Why are they asking for more money, I already paid it once and now they want to get paid again. I have limited financial resources, which makes it impossible for me to afford this timeshare purchase. The prices and services described to me during the presentation were severely misconstrued. I was not given the opportunity to confer with anyone about this purchase. Putting any more money towards this timeshare would be foolish and would only add to my ongoing burden. I kindly request your intervention in this matter to ensure a fair and equitable resolution. We need to close our timeshare contract due to having to rely on credit cards to fulfill our timeshare payments. Whats caused the biggest issues for my finances is the shift from a dual-income to a single-income household. This change has significantly impacted my financial stability. Weve only utilized the resort twice, and not only did it not meet our expectations, but the flexibility promised in choosing locations has proven challenging and weve never been able to actually vacation where we want. Weve tried reaching out to the resort but unfortunately we havent had any progress in finding common ground to get our account closed. Vacation Villas at FantasyWorld is a timeshare that takes advantage of age and infirm costing us thousands of dollars. My wife was hit by a drunk driver a few years ago resulting in a head injury, and torn ligaments in her hip and legs. She can no longer drive and needs assistance to walk. She also suffers from degenerative *********** Disease and curvature of the spine. I have had 3 heart attacks narrowly escaping death and now have 5 cardiac stents. I also suffer from arthritis and osteoporosis with a painful pinched nerve in my neck. I have a debilitating digestive condition as well. Our health care expenses and health conditions make it impossible to use the timeshare. The Vacation Villa has refused our written notice of these issues and request to cancel our agreement. I do have a concern regarding the maintenance fees though. I made a maintenance fee payment back in December to take care of my maintenance fees, however, your company is reflecting that I still owe them. I have documentation showing that I paid you. Are you able to look into this for me? I do not believe that I owe anything additional for maintenance fees. If you are still showing charges on my account, I would appreciate the maintenance fees being waived. We have an exorbitant amount of health expenses on top of our monthly living expenses and anything you can do to assist would be appreciated. I am reaching out to express my deep concerns regarding our timeshare with Vacation Villas at FantasyWorld. My wife, *****, and I are both 87 years old, and she is currently suffering from dementia. We are living on a limited income and are facing financial constraints that make it impossible for us to continue with this timeshare obligation. Our priorities have also shifted due to our circumstances.We kindly request your assistance in terminating this timeshare account mutually. Unfortunately, we do not have any family or friends who are interested in taking over this responsibility, and selling the timeshare is not a viable option for us.
