There are two complaints against this business. First, I took a C6 corvette to him that had suffered water damage from flooding. The insurance company Progressive, totaled the vehicle. At the time *********** said I could remove any mods that the vehicle had that I would like back. When I contacted the owner ‘Johnny’, he volunteered to remove them and hold them for me until I picked them up. The items were a upgraded radio, a cold air induction and a tail pipe cover plate. He basically removed the items, and when I tried to pick them up, said he did not know what happened to them. I’m sure he sold them. Around the same time, he had been painting/clear coating two body parts I brought to him belonging to my other corvette, which I paid him $600.00 for. When I tried to pick them up at later date, he said he had sold them because I had never paid for the work done on them. Although I had! It took me about a month to research through my credit cards to find the statement showing that I had paid him. Then, what he did is order the parts, but only performed the ‘ finishing work’ I had paid for on one of them, $200.00, but not the other $400.00. He refused to do the work, or reimburse me the $400. 00 I previously paid him. He owes me $400.00 plus the money for the parts he removed out of my other corvette.

    Greetings!

Customer has failed to mention some key points here.  Removal of the parts from his vehicle were not done for FREE, customer has a balance due of approx $700 in labor costs, convince fees and taxes for all of the removal of the parts he requested be taken off the car before insurance picked up the totaled vehicle.  Customer has also left out another key element to this issue, that his car was originally dropped to us around October of 2020, yes, the year of 2020, today is August 16th of 2023.  He left his parts here and never came back for them, until nearly 3 years later around June of 2023.  When he finally came around again, unannounced at 4pm on a Friday, he was totally perplexed as to why we were unaware of where his radio, intake and other trim piece were..  I stated I would look for the parts and IF we came across them, we would let him know.  As customer was OVERLY assertive about where his parts were, after some further backtracking, it was determined that he had an outstanding bill for the removal of the parts which was never paid, as he states it was supposed to be done “voluntarily”, this assumption was incorrect and we do not offer free labor.  This was informed to the customer, he has NOT paid his bill as of this response and further demands money from US for parts he claims we do not have.  Customer was informed that once his bill is paid, he will receive his used parts from 3 years ago back, if he chooses to come pick them up.  We cannot offer any further resolution on this matter and customer demands are wildly excessive and categorically false.  Pay your bill sir, and you can gladly have your parts back.  We are unable to issue YOU a refund for work we previously did that YOU never paid for.

Regarding the parts customer originally dropped off, he brought in a beat used C7 Front splitter and set of rocker panels to be re finished and did pay for those, after nearly a month of having to listen to his repeated emails calling us liars and thieves, after we simply just asked to send us a receipt of the payment, which we could not find through any of our merchant account records, he finally produced a receipt, I  could not originally find myself dating back to Late 2020, showing he did pay $600 for the labor on those parts.  We could not locate those parts since nearly 3 years had passed, once that was discovered, we ordered A NEW C7 Splitter for him and custom painted that carbon flash metallic, we also ordered a BRAND NEW set of Carbon Fiber Rockers which were shipped to his house.

We went more than the extra mile here and we willing to let it all just be even, however, the customer continues to harass us with complaints online, and threats of litigation.  We are unable to put anymore time into this, we are not a free storage facility and we spent more than the original bill of $600 to replace parts at todays cost, vs 3 years ago, I felt this offering was MORE than fair given the situation, but we’re not going to continue to get beat up over it

    Have a blessed one!

    Complaint* ********

I am rejecting this response from the merchant for the following reasons: This merchant's / business owner's response can only be classified as a poorly crafted collection of false statements. There is no credible factual basis or documentation that he has provided or can provide that would support any of his claims. The only thing he could provide you with, would be falsified bill / invoice which he sent to me on 6/28 via email that I have provided above. The fact is that no such bill / invoice existed before this date, and no such agreement for him to be paid to remove the items in question was ever made, with me or *********** insurance.

As supported by the attached emails above, I was supposed to remove the items, with Progressive's approval, but he volunteered to remove them and give them to me. He never did give the items back to me. Most likely profited from their sale since he claims not to have them any longer. His claims only go to further show the level of dishonesty he is willing to engage in. While disappointed in his behavior, I am now not surprised given his poor history customer service and dishonesty, as evidenced by his customer reviews.

Unlike him, I have provided factual / documented evidence in the form of email communications and receipts that are attached to this statement.

There are two different issues concerning my claim. First, there is the issue of the items removed by him from my 2009 corvette. The car was declared a total loss by *********** insurance due to flood damage. There was an agreement between me and *********** for me to remove the items since they were considered upgrades that *********** would not cover or reimburse me for. See the above supporting emails, *********** contacted him to authorize their removal by me, which he then volunteered to remove himself. No agreement was entered into for him to be paid to remove the items, which at most would have taken just a few minutes to remove since the automobile had been partially disassembled. The only payment agreed upon was between him and *********** for his estimate / writeup of repairs for the flood damage. And he received over $400.00 for this service. Along with the emails pertaining to this, I have provided the cost for the items in question, which include a radio, cold air induction and exhaust filler plate.

The second part of my claims pertains to two new upgrade items, skirts and splitter, for my 2017 corvette that he was paid $600.00 to paint and clear coat. $400.00 to sand and clear coat the skirts, and $200.00 to paint and clear coat the splitter. I have provided a copy of my purchase for these items showing that they were new items, not a used old splitter, as he claims in his statement. I have also provided a copy of the credit card statement showing payment of $600.00 to him / Performance Corvettes for the work. Payment which he denied in his email response I ever made, A claim which he later used as an excuse as to why he had sold the items.

Faced with the evidence that I had paid for the work done, he has partially reimbued me. He did buy a new splitter, painted and clear coated it, which I later picked up, although he made it difficult for me to pick it up. He specified specific hours as to when I could do this, so much so, that I had to take a half day off from work to do this. See the attached emails. As far as the skirts, which are carbon fiber, finished in resin, he purchased new ones, and had them mailed directly to my home. He refused to sand and clear coat them or reimburse me the $400.00 I paid for that service.

After all this, I am willing to accept partial compensation for the money I am owed, since this is my last attempt to come to a mutual agreement with him regarding this matter before legal action is taken. I would accept a total of $600.00 as a resolution, $400.00 for work paid to 'finish' the original skirts, and $200.00 for the $600.00 plus radio he never gave back, and likely sold.

I would be willing to provide the BBB with any addition documentation it may deem appropriate, as well as statements *********** insurance has provided to me.

Please, be aware that the complete collection of documentation I have assembled, in preparation for a possible legal filing is quite extensive, and not appropriate to upload at this time, but will be furnished upon request.

    Thank you,

I ordered a set of Long tube headers and xpipe kit from Performance. I was told prior to them being delivered, in a rude manner, to check the website. I did and sure enough it said that the xpipe portion of the order would not be in stock at performance corvette until June 12, 2022. The headers got shipped directly from the manufacturer. So it was to my surprise that they got delivered on June 7, before they were suppose to be in stock at Performance. I took them to an installer where shortly after he informed me that it was missing a few parts. The installer contacted performance who kept pushing him off to the manufacturer and back and forth. The manufacturer, who has access to what order has been shipped where, informed my installer and later me, that they had old kit in stock. Being that the xpipe is sent to Performance Corvette, which they deny and I have the shipping label to prove it came from them, they are responsible for the missing parts and deny that they ever even sent it to me. They will not resolve the problem and keep blaming the manufacturer. Their website is very contradictory in what they are saying. The title says xpipe in stock as of june 12 but further down it says they keep in stock anything from speed engineering. Manufacturer states that they send them the kit, I know that Performance sent me the kit but they deny it.....only one common denominator here. Performance is not wanting to resolve the problem and keep pushing the blame on someone else and my car has been at the installer for 5 months now. I and my installer has given them every opportunity to resolve this and they keep passing the blame. All I want is the issue resolved and it wouldn't reach this point and I'm only missing two pipes from an old set of pipes that they had in stock. Poor business ethics if you ask me.

Business Response /* (1000, 8, 2022/10/28) */ Hello, customer notified months after purchase, stating his installer says items are missing from the order. We have spoken to this customer countless times informing him, or the other shop who is trying their best, installing these headers, they need to contact Speed Engineering to resolve the issue. We are not the manufacturer nor the installer and have exhausted all options in attempting to help. Customer will not take our advice and we cannot assist further when another shop claims there are issues with the parts. Headers have also already been installed on the vehicle, mostly, and we cannot offer a return. You are also more than welcome to bring the car to our shop so that the installation can be done properly :o)
