      As mentioned, at all relevant times, our lending,fees, interest, and charges have complied with the applicable laws.

      As mentioned, CashNetUSA is a registered consumer lender with the *************** of ********* Institutions.

      On May 9, 2024, opened a $1,300.00 limit line of credit with CashNetUSA, a Utah limited liability company registered to do business in ****. When ****************** applied for the line of credit, she was presented with and required to agree to the Open End Line of Credit Agreement (Agreement) in order to take out the loan. The Agreement contains the following Jurisdiction and Execution provision:

      You understand,acknowledge and agree that we are located in ****, the Agreement is made pursuant to Section 70C of the Utah Code and that the Agreement, and any transactions hereunder, are entered into, accepted, made and performed in the State of ****. This Agreement will be governed by the laws of the State of Utah,except that the Arbitration Provision is governed by the Federal Arbitration Act ("FAA"). 

      ****************** acknowledged her acceptance to the Agreement by providing her electronic signature on May 9, 2024.

      ****************** is a ********* resident. Under Louisiana law, the parties to a consumer credit transaction may agree that the law of the place wherein the consumer credit transaction was entered into or the law of the residence of the buyer or debtor shall apply. La. Stat. ***. 9:3511.In its Opinion No. 19-0065, the Louisiana Attorney General addressed this provision in relation to loan transactions conducted via the internet between Louisiana residents and lenders from other states, and further confirmed that,[p]arties to a consumer credit transaction under the Louisiana Consumer Credit Law may agree that the laws of the state where the transaction was entered into will apply to the transaction. The Louisiana Attorney General further concluded that: 

      if a consumer credit transaction is entered into in a state other than *********, then the parties to the transaction may agree to apply that state's laws to the transaction. In such an instance, the interest rate or finance charge limitations provided by the **** [Louisiana Consumer Credit Law] would not be applicable to the loan.

      In this case, the Agreement was entered into in the State of Utah and the parties agreed that the Agreement is governed by Utah law. As a result, Utah law governs the interest rate permitted under the Agreement. Under Utah law, the interest rate cap does not apply to a loan agreement where the parties agree to an alternative interest rate.

      As mentioned, CashNetUSA disclosed the terms and conditions of the Line of Credit including the Annual Percentage Rate (APR) for Cash Advances, Paying Interest, and Fees.  The fees and interest applicable to a cash advance were fully set forth in the agreement, a copy of which was provided to her (via email) when she opened the account.

      As mentioned, ****************** has the right to make larger and/or additional payments in advance and in any amount on the line of credit at any time without incurring additional charges.

      I have been receiving emails from Cash Net, Cash Advance and Cash Advance USA all saying I owe money for loans I never took out. I feel this id fraudulent and basically harassment. I've never received money from any of this Company, I think they are all connected.

CashNetUSA is not attempting to collect any money from *********************** and has no knowledge of the situation that *********************** mentions in their complaint.

      Based on the details of the complaint, it is clear that fraudsters falsely posing as collectors have contacted ***********************. These persons are fraudulently using our trade name in an attempt to extort money from consumers by utilizing threatening tactics.

      After review of our records, *********************** applied for financial services under the name ***********************; however, we were unable to approve their application.

      It is always our prioritized goal to adhere to and comply with all regulatory requirements while conducting regular and collection business. We train our staff accordingly and follow the collection guidelines set forth by the Fair Debt Collection Practices Act (FDCPA).

      On September 8, 2020, ********************** opened a $750.00 limit Line of Credit with CashNetUSA. Before he entered the agreement, CashNetUSA disclosed the terms and conditions of the Line of Credit including the Annual Percentage Rate (APR) for Cash Advances, Paying Interest,and Fees. ********************** then signed his agreement acknowledging that he understood and accepted the terms and conditions associated with the Line of Credit.  

      Since establishing the account, HMr. ********* has requested one (1) cash advance. However,the account balance became past due. Due to successive non-payment of past due amounts, the account was sold to a third party debt buyer, ******************** (UHG) on October 28, 2021. The direct contact number to UHG is ************.

      It appears ********************** may be asserting that he may be the victim of identity theft. Please note, contrary to his assertion, our records do not indicate that he has directly contacted our customer service department to report that the above mentioned transaction was fraudulent and he was the victim of identity theft. In addition, our records do not indicate that ********************* has contacted our customer support team directly to request a copy of his loan agreement.  However, upon receipt of the BBB complaint, we have submitted his request to send a copy of the loan agreement.

      Please note, if ********************** is asserting that he may be the victim of identity theft, in accordance with our policy, in order to begin our investigation, we ask that he file a police report and provide a full copy to CashNetUSA via email or fax to:

      Cashnet USA, CNU *************** is monitoring my credit as "prescreen" though I have not asked for this or consented. When checking my ***** Nexis report, CNU *************** is imsoft inquiring my credit often. It lists CNU ***************, LLC *************************************************************************************** phone ************, I called this number and was transferred around. Agents saw I had no account and had trouble assisting, they didn't follow back up after say6they would. They did agree they were the inquirer.

      I am rejecting this response because:

      After having no response from this via BBB, last week I was able to talk to a representative from CashNet USA who got the attached information.  CNU **************** CashNet USA, has been doing soft credit checks, which are not part of prescreen mailing opt out, this is an actual inquiry to my credit, sometimes multiple times a day or week. They did verify I had no account.  I want the inquiries stopped and would like to know who opened an account or ordered CNU *************** to perform these credit inquiries.  I would also like to be mailed a hard copy of whatever information was shared by CashNet USA, CNU *************** and to which companies my data was shared with. Were any of these companies or CashNet USA profiting from my data inquiries and that information? This matter will not be considered resolved until CNU **************** CashNet USA removes me from their inquiries and provides the information requested so I can find out what damage is done and what other companies I need to reach out to to remove my information.

      The nature of my dispute is I have never taken a loan out with CashNet USA.I kept getting calls from this number ************ they have been calling for the last month or so I have ignored them so finally on 06/03/24 I answered and spoke with the most rudest ***. She said that she was calling on behalf of CashNet USA and that they where supposedly suing me for a loan I took out. She stated this came across their office( did not verify her company name either) in 2020 we are in 2024 so if I owed CashNet USA any money would I have not gotten calls of this caliber before? Harrasment calls to my number to the point I have to put my DO NOT DISTURB NOTIFICATION ON UNTIL AFTER 8PM CST TO IGNORE THEM. I have NEVER EVER AND NEVER AGAIN TAKEN A LOAN OUT WITH CASH NET USA PERIOD. The *** threat to have me and that CashNet USA advises me to get a lawyer. See there are to many schemes in the world that companies tries to do to the elderly and I am far from stupid or dumb. When I asked her when did I take such a loan the year/date and the amount she got nasty cursed at me and hung up the phone.

The outstanding balance was $588.39 and there has been no attempt to collect on this debt since the debt was sold.       I received a call from a CashNet USA representative today offering me a loan. I went through the verification process the company requires. He offered me a small loan of 500 which was not sufficient to cover my emergency situation so I ask if we could get an 800 loan. I hung up because he refused to share my information with me. I then received an email stating they were offering me a loan so I called them. The representative was very nice and professional however she informed me that they would offer me no loan at this time. This company is a liar it would appear. They claim to help anybody regardless of credit on their commercials however they do not back that claim up. That is false advertising back in my day and was a suable offense. Bottom line is don't deal with these people. They don't back their own statements.

      On June 2, 2024, *************** initiated an application with CashNetUSA. As such, our customer support team contacted **************** to assist him to complete the application process. As part of the application process, consumers must provide income verification.  We have a very thorough verification process in order to ensure responsible underwriting and protect our borrowers from potential fraud.  

      Later that same day, **************** contacted our customer support team to assist with submitted his application. As such, **************** submitted a completed application.

      However, after careful consideration, it was determined that **************** did not meet our underwriting requirements for a CashNetUSA loan. Mr. ******* application was ultimately denied for a CashNetUSA loan product, and a notice of adverse action (NOAA) was sent as required by law, informing him of the principal reason(s)his loan application was not approved.

      Please note, we provide a thorough verification process to ensure responsible lending. During our underwriting process, we use a variety of tools and techniques to verify identity, employment, banking information, and overall financial health. As such, we require certain verifications to determine a decision.

      Based on our review, ******************** concerns were escalated and he was advised of the aforementioned information.

      These liars have a bad reputation 50miles long if they know that I want nothing to do with nor would I ever accept any loan from them if they approved me. Take accountabliliy. So let me see if I get this straight. You children needs the police to run your business. If I called the police it would be you going to jailing false and dishonestly using my name to hurt my credit. Consider this the real me. I want nothing with your so called loan company. You dont have my consent not now nor ever I dont accept your childish dont know how to run a business.

      Given all the damage of you falsely and without consent using my name to hurt my credit. I would not feel remorse carting you away. Based on what Ive seen you belong in jail. Dont ever use my name again. I would not do business with you even if you were the last business.

      Dear Better Business Bureau,I am writing to file a formal complaint against individuals named *************************, purportedly a debt collector, and Attorney ***********************, who was CCd on a fraudulent email. They falsely claim that I owe a debt of $1,250.75 and assert they are associated with CashNet USA. Additionally, they have fabricated a fictitious docket number and falsely claimed there is an active warrant for search and seizure.I categorically rebuke these unfounded accusations and reject any notion of an offer to contract. I do not consent to these fraudulent proceedings and hereby refuse for cause without dishonor, pursuant to UCC *****. This scam email is a clear violation of 18 USC 1341 & 1342, which addresses mail fraud and false representations.I recently spoke with an application support representative from CashNet USA named ******* (phone number: ************), who confirmed that there is no account in my name and verified that the email is indeed a scam. I have attached proof of this communication for your reference.The actions of these individuals are deceitful, defamatory, and a blatant attempt to damage my reputation.       I started this line of credit with them back in October of 2023. After consulting with my attorney I found out that their absurd fees and APR is far outside of the limits allowed in ********. They provided an unsatisfactory response so using this forum to resolve as my attorney is advising working with a class action suit otherwise against them. Thank you.
