**** 605B - Mandatory Fraudulent Accounts and Inquiries Block
Under 15 U.S.C. 1681c-2 (**** 605B), once I have provided notification that these accounts and inquiries are fraudulent, TransUnion is legally required to block them within four business days and inform the furnisher that the accounts and inquiries have been flagged as fraudulent.
Failure to comply makes TransUnion liable for damages under **** 616 & 617.
Legal Precedents Holding TransUnion Accountable
- ******* v. MBNA America ****, NA, 357 F.3d 426 (4th Cir. 2004) - Credit bureaus must conduct reasonable investigations of disputed accounts and inquiries.
- ******* v. TransUnion, 115 F.3d 220 (3rd Cir. 1997) - Credit bureaus CANNOT rely solely on the furnishers word and must independently verify the data.
- ****** v. ******************** 29 F.3d 280 (7th Cir. 1994) - Failing to properly investigate disputed accounts and inquiries creates legal liability.
Additionally, under the Fair and Accurate Credit Transactions Act (FACTA), 15 U.S.C. 1681s-2(a)(6) and 1681c-2(a), TransUnion is required to take immediate action when a consumer identifies fraudulent activity. Failure to conduct a proper investigation will be deemed a reckless disregard for my consumer rights, and I reserve the right to escalate this matter to federal authorities.
I have provided sufficient documentation proving that I did not authorize or open these accounts and inquiries, including:
1. A copy of my government-issued ID (drivers license).
2. A bank statement confirming my identity and address.
3. A FTC Identity Theft Affidavit.
Since these accounts and inquiries are fraudulent, they must be removed immediately under the law.
**** 611: Demand for Method of Verification & Prohibition of Conflict-of-************* Sources
If TransUnion attempts to verify these accounts and inquiries instead of blocking them, I am invoking my rights under **** 611 (15 U.S.C. 1681i) and demand the following non-negotiable documentation:
1. A detailed, written explanation of TransUnions verification procedure - "verified" is not an acceptable response.
2. The name, contact details, and title of the person(s) responsible for verifying these accounts and inquiries.
3. A certified copy of the original WET-INK SIGNED CONTRACT proving I opened these accounts and inquiries. A digital or electronic signature is insufficient unless TransUnion provides IP address, geolocation, and device fingerprint data.
4. Copies of all internal notes, system records, and communications related to these accounts and inquiries, including any exchanges between TransUnion and the furnisher.
5. A sworn affidavit signed by a representative of TransUnion, stating that the accounts and inquiries are accurate and that the verification process meets the ***** legal standard.
6. Proof that an independent third-party source verified these accounts and inquiriesNOT any subsidiary or affiliated data furnisher owned by TransUnion.
7. If the furnisher of this information claims they have a signed fraud affidavit or any other supporting documentation confirming I opened these accounts and inquiries, I demand a copy of such documentation. Failure to provide this will be treated as an admission that no such document exists, making further reporting of these accounts and inquiries a willful violation of **** 1681s-2.
Prohibition of *************** Furnishers
I hereby demand that TransUnion DOES NOT use any of the following credit bureau-owned or affiliated data furnishers to verify these accounts and inquiries:
- Equifax: The Work Number, Equifax Luminate, Equifax DataX
- Experian: ***************** Experian RentBureau, Experian Decision Analytics
- TransUnion: TLOxp, FactorTrust, TransUnion Rental Screening Solutions
- LexisNexis Risk Solutions (a third-party data aggregator with a documented history of inaccurate consumer reporting)
Additional prohibited entities: Innovis, CoreLogic, *********************, MIB, National Consumer Telecom & Utilities Exchange (NCTUE), Advanced Resolution Services, SageStream, Early Warning Services, G2 Risk Solutions, LCI.
Any attempt to verify these accounts and inquiries using these sources constitutes a clear conflict of interest and a willful violation of **** 616 & 617, as well as **** 611, which mandates an independent reinvestigation.
**** 1681i(a)(1)(A) & **** 1681s-2(a)(3) - Immediate Temporary Suppression of Disputed Accounts and Inquiries
Under **** 1681i(a)(1)(A) and **** 1681s-2(a)(3), I am demanding that these disputed accounts and inquiries be suppressed from my credit file until the reinvestigation is completed.
1. Immediate Removal During Reinvestigation - All reporting of these disputed accounts and inquiries must be immediately removed from my credit file until the investigation is complete.
2. Elimination of Negative Remarks - Any balance amounts, charge-offs, delinquencies, or other derogatory remarks associated with these accounts and inquiries must be removed immediately during the dispute process.
3. Exclusion from Credit Scoring Models - These accounts and inquiries must not be factored into any credit scoring models or lending decisions until full verification is completed.
Criminal Liability for Willful Noncompliance
Under 15 U.S.C. 1681q, willfully furnishing false information on a consumer report is a federal crime punishable by fines and imprisonment.
Legal Consequences for Noncompliance
If TransUnion fails to:
- Block these fraudulent accounts and inquiries within four business days ( 605B)
- Provide the required verification details in writing ( 611)
- Ensure compliance with maximum accuracy requirements ( 607(b))
- Use only independent, third-party sources for verification
- Temporarily remove these accounts and inquiries from my credit file until verification is completed ( 1681i & 1681s-2)
...I will take immediate action, including but not limited to:
1. Filing a formal complaint with the *** and my state Attorney General to document TransUnions failure to comply with federal law.
2. Pursuing legal action under **** 616 & 617, seeking statutory damages ($1,000 per violation), punitive damages, and full attorney fees.
3. Initiating a lawsuit for injunctive relief requiring the immediate removal of these accounts and inquiries from my credit file.
4. I demand written confirmation that TransUnion has submitted a ************** Form (***) update to remove these accounts and inquiries from my file. This confirmation must include a copy of the *** reflecting the deletion or suppression of these accounts and inquiries.
Additionally, if this matter is not resolved promptly, I will exercise my private right of action under the **** and FACTA by filing a lawsuit in small claims court.
Sincerely,
