I've dealt with debt collectors daily over The Wooten Company's fraudulent business structure. Months after moving out we heard that we owed for damages they haven't had any pictures of, any documents of fixing, and when we explained we are filing a claim in civil court that let's us show pictures of how it looked when moving out, they sent it to a debt collection agency in ****************. The debt collectors explained how to pay under protest, and how to file with consumer affairs oversight groups and later file for a refund in civil court. I'm paying it slowly off because our family lives check to check and we don't bail on debts we owe. But we still don't know what the money is even owed for and when we asked and went to dispute it, they sent it to a collection agency. We are hung up on and have recordings of all of the calls.Business Response

In review of the complainants case we have found the file was placed with an outside collection agency. Upon move out the household is sent the move out documentation and reconciliation to the address provided. If the balance is unpaid within a specific period of time as notified on these documents it will transfer to collections. Attached you will find a copy of the Notice to Vacate and Acknowledgement of Departure. Per this document a household member agreed to be present on 9/30/2020 at 11:30am for the Move Out Inspection. It was further agreed they would be responsible for any damage beyond normal wear and tear with examples provided. Upon move out pet damage and odor was found and documented on the Move Out Inspection. The complainant was provided electronic access to review all photos within their Tenant Portal. The attached Move Out Inspection reflects this damage. Per the signed Pet addendum it states in the event of flooring damage related to pets the complainant agrees to restore the flooring to its original condition to include labor, pet odor treatment, and replacement. This flooring was new at the time of move in, 2018. As a result the complainant was charged per the agreed policies and procedures of their signed contractual agreement. This invoice and pet policy is attached for reference. Although we do not admit any wrong doing, in good faith and sympathy with the complainant we are choosing to write off any remaining balance owed with the collection company. I am rejecting this response because: This isn't me. Possibly I didn't explain best in my original complaint. ***************************** is my wife and her number is ************, the Wooten Company called last Thursday and said they'll look into her issues, still haven't called back and the debt collectors still try to use my bank card for payments after I asked them to stop. She's my wife and it's hurting me and her, but the Wooten Company is doing this to us both from her stay there. *****************************

Attached is the requested information for the complainant. Similar to the prior response this is a past file and no longer with The Wooten Company. This was placed with an outside collection agency and all communication is handled through that organization. Due to the complainants statements and concerns we were able to contact the collection agency. We have further researched the information they have provided. Although we do not admit fault we are sympathetic to the complainant and recognize their frustrations. A renters insurance plan paid for a large portion of the damages, as a result we have chosen to waive the remaining balance. we have lived here 6 years for the last month we have had no air conditioning. it has been in triple numbers most of this time. it ranges from 80 to 94 at the highest in my apt. i met several times with this co. i was given a fan for the bed room . i have 2 other fans i am diabetic my husband has c pap and breathing problems. we have been told by supervisor our unit is over 25 years old and parts are not avaliable so why did he say we wouldnt be able to get a replacment . he said a new one was expensieve and would not last but 3-5 years. our rent is always on time we obey all the rules here we cant go on any longer. i am66 years my husband is 72. we cant just move our lease says we have working heat and air. today is sat. right now it is 101 degrees. 87 in my living room. my dog has vomited several times from the heat. all of our extra money is spent for take out becauce we cant turn on the oven. we are on housing and a strick income. please help a worker at the company laughed when i said i was giving them till wed, then i was filing with you. i couldnt wait that long its to hot.they refused to help us this is a health issue for us. please help us.can you please contact them for me we have no one to stay with. we pay for a 2 bed room apt. we can only stay in the bedroom efere the little cooler is it is not an air conditioner it is a fan set on 62 degrees but it is like 80 in the bedroom. ***** *******. p.s. we would like an adjustment on our rent for june and july since we couldnt use all of our apt.Business Response

We appreciate the long period of time the complainant has leased from The Wooten Company L.L.C. We hope that our continued dedication and service to our tenants is one of the many reasons they have chose to renew so many times. In review of the complainants statement they are correct regarding several weeks of excessive temperatures. In addition to national supply shortages these excessive temperatures have further impacted several cities, counties, and states through the Midwest. We have chose to use all resources available nationwide, contractors, and internal HVAC tech's regardless of cost to provide the best service possible. At times these impacts have caused delays as the part, replacement, new unit, or required licensed technician may not physically exist. In this case you will find the attached service request was created on July 7th 2022. Due to the supply chain issue we chose to purchase and provide portable air conditioners. These have generally cost over $600 each and we have chose to do this for numerous tenants required reasonable accommodations throughout our company. As of July 18th 2022 the required parts arrived and were installed. This was monitored through July 20th 2022 and continues to be in the required working condition. We can not predict when an issue may arise or what part may be required but ask for patience when working through future service request. In the event additional service is required outside of the resources we provide, there may be additional agencies that may provide further assistance for the medical concerns stated by the complainant. We do not provide this type of care and would recommend speaking to a medical care provider. Once again we appreciate the complainant making our community home for so long.Initial Complaint

I am a renter at Bradford **** apartments, owned by Wooten. I have been living here for a few years, I have put in several maintenance tickets regarding various issues I have had with my unit, dishwasher backing up, shower backing up, mold, leaks. All issues of which no one has addressed. Currently I am experiencing an issue with the roof of my shower leaking, causing mold and water damage from the unit above me leaking. Just for this issue alone I put in a ticket months ago with no resolution and its just getting worse. Im not seeking any kind of apology but I need someone to help me get Wooten to make their units in a livable condition for its tenants.Business Response
