    Pattern of Complaint:

    On June 17, 2020, Better Business Bureau recognized a pattern of complaints from consumers regarding the lending services provided by Target Cash Now. Consumers allege borrowing money from the business and having to pay back much more than they borrowed due to the interest rates attached to the loan.

     

    On June 17, 2020, BBB reached out to Target Cash Now with the following suggestions, and requesting a response to the consumer complaints:

     

    1. The APR should be clearly visible above or next to "Click here to apply" on your website
    2. Your website should clearly show a consumer the full amount they will be required to pay if they borrow “X” amount of money, example:

     

    “$500 Loan Paid Bi-weekly

    10 Month Term

    21 Bi-weekly Payments of $140.22

    725% APR

    Total Payment $2,804.40”

    On July 06, 2020, Target Cash Now responded to Better Business Bureau with the following:

     

    “Target Cash Now is in receipt of BBB’s review letter dated June 17, 2020, which was received by us on June 23, 2020.  We take all comments, complaints, and reviews (good or bad) very seriously and will address the items noted.   First, we would like to take this opportunity to provide you with some background information on our company, its business practices, and our actions in response to your letter.  Target Cash Now is committed to complying with the spirit of all applicable federal laws and the laws of the Fort Belknap Indian Community. 

     

    Regarding our products and their terms and conditions (including repayment options), they are all explained at the time of loan origination.  Target Cash Now discloses the total cost to a borrower if only the minimum payment schedule is followed, and we inform our customers that this is an expensive form of borrowing.  We also encourage customers to pay off early with no pre-payment penalty to save on interest charges. 

     

    As to the APR, it is disclosed both on the Target Cash Now website, as well as the loan documents that are reviewed and signed by the customer.  All rates and loan fees are prominently displayed within the loan contract and are acknowledged at each point by mandatory electronic signature.  Furthermore, we advise our customers that our products should be used as a short-term source of funds – not a long-term financial solution.

     

    Out of all the complaints received during the last twelve months, only one (1) response was not accepted by a complainant.  Most importantly, to put the volume of complaints in perspective, the complaints received over the last twelve (12) months make up less than 0.07% of Target Cash Now’s originated loans during that time.   

     

    Regardless of the above, Target Cash Now appreciates the BBB reaching out, as we always strive to offer a superb product and the best customer experience possible.  Target Cash Now specifically understands the importance BBB’s recommendations in above-referenced letter, and we would like to let you know that our website already has these recommendations implemented in a similar format.  You can find this information by going to the Target Cash Now website and clicking on the Rates tab.  From there, you will be able to use the Target Cash Now Payment Calculator to get an approximate payback amount.  Furthermore, as previously mentioned, all rates and loan fees are prominently displayed within the loan contract and are acknowledged at each point by a customer’s mandatory electronic signature.

      I received an email today from target cash now, targetcashnow.com, saying my account is past due and is going to collections. I called the number in the email, and one rep told me a load in the amount of $800 was deposited into my account on June 16,2022, I told her that was not true, as I was looking at my account right now, and nothing was deposited and I never heard of their company. She passed me on to escalations, and that rep told me a different amount, $1003 was deposited into my account ending in ****. They had all my information, but I never got a loan from them. I called my bank to verify this. They are running scams.

      First,we would like to take this opportunity to provide you with some background information on our company, its business practices, and our actions in response to our customer.  ********************** is committed to complying with the principles of federal consumer protection laws and regulations, as well as the laws of the Fort ******* Indian Community.  Target Cash Now discloses the total cost to a borrower if only the minimum payment schedule is followed, and we inform our customers that this is an expensive form of borrowing.  The APR is disclosed on the Target Cash Now website and is prominently displayed in loan documents that are reviewed and signed by the customer.

      Second, ********************** informs our customers that this is an expensive form of borrowing, and we even encourage our customers to prepay (with no penalty) to reduce the overall cost of borrowing.  We go further and inform our customers that our product is not meant as a long-term financial solution.  We also allow our customers to cancel their payment obligations under their Loan Agreement (at no cost), no later than 3:00 p.m. Mountain time of the next business day immediately following the Disbursement Date.

      Third, we certainly understand that everyone faces financial difficulties from time-to-time, but the loan agreement signed by ************************* is legally binding.  Thus, we have every right to expect payment as scheduled in the agreement.  To date, ************************* has only made a partial repayment towards the total outstanding loan balance.  Our records indicate ************************* utilized the self-service portal on June 24, 2021, requesting a deferred payment for the upcoming scheduled regular payment for July 2, 2021.  This regular scheduled payment was successfully added to the end of the life of the loan per *************************** request.  Our records also indicate on January 2, 2023 Target Cash Now advised ************************* of the identity theft process.  To date, Target Cash Now has not received any supporting documentation of possible identity theft and/or a valid police report regarding this matter.  Once this documentation is received, Target Cash Now will follow our identity theft process.

      Nevertheless, to amicably resolve this matter, Target Cash Now will settle *************************** account for the remaining principal balance only.  Target Cash Now will apply what has been paid to the principal, and once the remainder has been paid, we will consider this matter closed.  This will be notated in *************************** file, and we will block their identifying information in our system unless indicated otherwise by them in writing. We will be following up with ************************* with an email confirmation of this resolution.  Correspondingly, *************************, at their convenience, may call our customer service line, and they will be directed to a representative who can assist them with any additional questions.

      Hi. My complaint with Target Cash Now begins on Dec. 28, 2022. I borrowed $600 from TCN and the original due date for repayment of $672 was due on Jan. 3, 2023, but in installment payments (please see attachments). However, TCN request that if I wanted to pay off the total amount of $672 to call it in 3 days early. I have done this for the last 4 months of doing business with them and paid them off. However, this time they took the monies out of my account early which caused me to go into the red with my bank account. On Dec 27 2022 I visited their website to see if I could set up payment for them to receive full payment of the loan of $672. But decided not to use their system because the way in which it is set up was not conducive to when I wanted them to collect their money therefore I called to speak with one of their TNC agents via the phone number ************** and schedule the full payment of $672 to come out on Jan 1, 2023. I made this call on Dec. 27, 2022, and spoke with an agent for 3 minutes according to my recent phone call listing. I am unable to attach a copy of the phone call due to being unable to attach it to my phone's Gmail for some reason, however, I am able to attach and send it as a cell phone text message. The Agent I finally got the opportunity to speak with after several phone calls today and speaking with one of their website agents by the name of ******* or something like that told me that they have no record of me speaking with their Agent on Dec. 27, 2022. And she insisted that I made the arrangement for them to pull their monies from my account as of today's date 12/28/2022. I told her I did look at the calendar and did not want to use it so I called to speak with their TCN agent to make sure that the monies were taken out on the best date without my account going into the red but their system took the monies out anyway and I have yet to receive proof that such request went through using their system. It may be a glitch.

      Second,we certainly understand that everyone faces financial difficulties from time to time, but the loan agreement signed by ************************* is legally binding.  Thus, we have every right to expect payment as scheduled in the agreement.  To date, ************************* has no obligations regarding this loan.  Our records indicate ************************* utilized the ************ Portal on December 14, 2022, completing a principal pay down.  ************************* then utilized the ************ Portal on December 27, 2022, successfully creating the pay off.  On December 29, 2022, our records also indicate Operations Support did in fact address that the final pay off created by the customer via the ************ Portal does take 3-5 business days to clear.  Confirmation of the successful pay off letter was sent to ************************* email address on file on December 29,2022.

      Nevertheless,to amicably resolve this matter, Target Cash Now will acknowledge ************************* account has been paid, and we will consider this matter closed.  Target Cash Now will not be issuing a refund as the paydown discount as well as the payoff discount was applied to this account.  This will be notated in ************************* file, and we will block their identifying information in our system unless indicated otherwise by them in writing.  We will be following up with ************************* with an email confirmation of this resolution.  Correspondingly, *************************, at their convenience, may call our customer service line, and they will be directed to a representative who can assist them with any additional questions.

      I spoke with Target Cash Now on October 24 over the phone, not electrically signing anything. I agreed to take out $950 loan, and that my payments would be $167.92. The money went in 2 days later, and the next week the first payment came out. I didnt think anything of it. Then the next week the same payment came out weekly! I never agreed to a weekly payment schedule, I cannot afford that! Then I was finally able to log on to an online portal, and I see that not only are my payments weeklythe interest rate is 795%! Thats is obscene and vile, and literally robbery. At no point did anyone ever tell me these numbers. By the time I was able to speak to someone, they have now deducted almost $1400 from my account, and I still owe almost $2300 towards my principal! Only $12 went to that. My pay off is $1100.53 as of yesterday, but it goes up like $20 a day! I would have NEVER put myself in this position. They are so misleading. I tried speaking to their company to file an appeal, but they were absolutely so rude to me and would not explain anything to me. One gentleman, however, did tell me that they did not tell me the interest rate or the weekly payment schedule and the call is being reviewed now. I issued a stop payment with my bank from them being able to deducted and I halted payments until they could provide me proof that I agreed to those terms. I NEVER agreed and would have never agreed. This has put me in such a worse position than I was and caused problems for my family. I only make $422 a week and they immediately take $167.92 of that. I need to help get this done and I dont know what to do. They are not in the business of helping anyone. I never physically signed anything, however when I was on the phone with them I was told to sign for the agreed amount by opening and scrolling and they waited on the phone while I did it, and wasnt til after this that the interest and payment schedule were put in there. I was not able to view that til weeks after.

      I received an email today from Target Cash Now stating that I logged into my account (which I did not) and changed my home mailing address, cell phone, home phone, work phone, email, bank account number and bank routing number. I was informed by this email to contact this company (Target Cash Now) immediately if I did not make these changes. I did as soon as I received the email. I was put on an extended hold and was told by *** there was a glitch in their system and someone would have to call me back. This was several hours ago. I am actually on hold with them again now since no one called me back as promised. I asked *** earlier today what was the cell phone number she had on file for me and she gave me a phone number that has never belonged to me. Someone is trying to take a loan out using my maiden name information (I am recently married as of this past year) and I do not want this to happen. I am unable to prevent any action from happening since no one at this company will talk to me, make a report or even attempt to try at the very least to resolve this issue when my identity and personal information is on the line. Please help me. I have almost been on hold another hour with this company and no one has addressed me. I thank you in advance for any assistance you can offer.       After further review on ********************* account with Target Cash Now, it has been brought to our attention that the application is in a pending status, meaning the application is needing further verification with the customer and a customer service representative over the phone. At this time there are no financial obligations with Target Cash Now.       After contact with customer service, multiple times, paying three times the amount of the $400 loan provided ($1286.06), they sent me to collections stating that I owe even more money. Despite paying triple the amount and that they no longer have my loan documents. They have been issue a cease and desist from providing unlicensed loans is other states and refused to provide license information. Additionally their mailing address is states away and is the business address of 2 other lenders.

      I am rejecting this response because: Paid $1286.01 towards a $400.00 loan, claim to be governed by the Fort ******* tribe with a listed address of a P.O. box in ***********, however, 30 mins from the physical reservation. However, a physical address appears as ***************************************************************************, two other businesses share this same address, Lendrev (no address provided on the website) and ***************** ****************** When asked to provide a license to lend in **********, stated that they could not provide that information and sent me to collections for an additional sum despite already paying over $800.00 over the original loan amount, directly violating ********** lending practices. The department of financial innovation and protection in ******** issued a cease and desist without a license in 2019 and there are several class action lawsuits pending due to predatory lending.

      I borrowed $1000 from Target Cash Now on 10/24/22 and have since paid $529.15 to date and my account is showing that I still owe $2596.64. I am requesting to settle my account for the remaining amount owed."Payday lenders must be licensed and post a $50,000 consumer protection bond with the state. There are also caps on the interest they may charge, for example, $15 on loans up to $250. Theres also a 30 percent annual rate ceiling. ***** has a $2,000 limit on payday loans offered in the state. The terms of payday lending in ***** are very restrictive, while there is no limit to the length of the loan term, the loans are subject to small loan cap of 30% APRs for loans up to $2,000. The finance charges should not exceed $5 for a loan up to $75; $15 for $75-$250 loans; and $25 for loans above $250. Criminal actions are prohibited."I have revoked any and all ACH authorizations with the company from debiting any and all of my personal accounts, per Federal law, ******************** Section ****** Preauthorized transfers until this matter has been resolved.I would like to come to an agreement that is fair between both parties involved. I feel that I am stuck in a predatory cycle that will not end and am seeking help.Thank you for your time.

Target Cash Now is a wholly owned and operated entity of the ************************************ (Tribe) on the Fort ******* Reservation of *******.  Target Cash Now was established for the Tribes economic benefit and is organized and licensed under and operates pursuant to Tribal law.  Both our website and our consumer loan agreement explicitly describe the sovereign status of Target Cash Now and clearly require the application of Tribal law to any business dealings with Target Cash Now.

      Second, we would like to address the complainants assertion that this loan was predatory.  Target Cash Now discloses the total cost to a borrower when only the minimum payment schedule is followed, and we inform our customers that this is an expensive form of borrowing.  Specifically, the APR is disclosed both on the Target Cash Now website, as well as the loan documents that are reviewed and signed by the customer.  All rates and loan fees are prominently displayed within the loan contract and were acknowledged at each point by mandatory electronic signature.  Furthermore,we would also like to address the assertion that Bright Lending solicited you for a Payday Loan, which is unfounded. Target Cash Now offers consumers closed-end installment loans, not Payday Loans.

      Target Cash Now certainly understands that everyone faces financial difficulties from time-to-time, but the loan agreement signed by ***************************** is legally binding.  Thus, we have every right to expect payment as scheduled in the agreement.  To date, ***************************** has only made a partial repayment towards the total outstanding loan balance.  

      Nevertheless,to amicably resolve this matter, Target Cash Now will *************************** ******** account for the remaining principal balance only and once the remaining principal balance has been paid, we will consider this matter closed.  This will be notated in ******* ******** file,and we will block their identifying information in our system unless indicated otherwise by them in writing.  We will be following up with ***************************** with an email confirmation of this resolution. Also the statement that the laws do not apply to them. They cannot be easily contacted, and they make it impossible to even access my own information. *************** an attorney on this matter.       I got a $700 loan with Target Cash Now. I am a full-time college student and full-time employee working two jobs at ********* and 24-Hour Fitness. Unfortunately, due to financial hardships and low credit, I was forced to take a payday loan out with the above company. I did this as an absolute last resort so that I could complete my car payment. I am making payments of $138.00 every two weeks and have not missed any even though they are severely impacting me. My issue with the company is that whenever I try to access the company website to pay my loan manually, access my loan document, or even claim "rewards" the website pops up as 403 Forbidden on all devices. Upon further research, I realized this was a common issue among many loan applicants and it seems as though the company purposely does this to make it harder on applicants so they can not reach the company to resolve issues. I have reached out to customer service and all they said was to try on other devices and call back to see if I was still unable to reach the website, which I never was. I cannot download my loan document either because it directs me to the company website which doesn't work.

      I agreed with the companys option to pay off only the principal. However, because I complained about Target Cash Now to the BBB website, I was told that their system automatically turned off my ACH payments which made them late. I was unaware of this since I didnt receive a notice & my payments were automatically debited from my account every 2 weeks,& I have receipts to prove it. I was charged a late fee & was told by 3 employees that the fee would be waived but it is still considered late. Another thing is there was an ongoing investigation about an authorization to pay off the remaining principal the day after Target Cash Now made me that offer, which I never authorized. Finally, I was trying to send off my last payment early, when I noticed I was sent to collection. I never missed a payment!! I dont think this is entirely legal and the employee refused to give me his employee ID or his last name. He told me everything was being documented & his supervisor was going to reach out to me with 24 hours and I heard nothing. The guy on the phone admitted he was just as confused as I was. Legal action is the next step for me as this loan company has completely destroyed my credit when I have done nothing but make my payments. The only issue is my complain to the BBB. I urge everyone to stay away from this company as it will only leave you worse off than you were already.

      We would like to apologize to the customer as a supervisor did not return their call as promised.  In regard to the customers statements concerning an ongoing investigation, Target Cash Now is unclear what the customer is referring to and would be happy to assist if provided with additional detail. 

      Nevertheless, we have further reviewed *************** account and see that an additional charge of $13.87 was inadvertently added to the customers last settlement payment.We will be issuing a refund for this additional charge to the account we have on file.  We apologize to the customer for the inconvenience and confusion caused by this oversight.  Currently, ******************** has no further financial obligations to Target Cash Now as the loan has been paid in full as of December 23, 2022. 

      We would also like to address the complainants assertion that Target Cash Now has impacted their credit.  Target Cash Nows process should not affect the customers FICO score.  We do not perform hard pulls with the three major credit reporting bureaus, but we may use alternative providers to verify identity data points and active military status.
