On March 28, 2023, Secure Ticket Purchase, LLC (Secure) and owner John Urich entered into an Assurance of Voluntary Compliance with the Pennsylvania Attorney General for alleged violations of Pennsylvania’s Unfair Trade Practice and Consumer Protection Law. The Assurance settles allegations that during the COVID-19 pandemic and the subsequent cancellation of events, such as music concerts, Secure Ticket Purchase, through the reseller website, www.boxofficeticketsales.com, changed its refund policy to only offer “store credit” for purchasers of tickets for canceled shows due to safety concerns. Secure previously guaranteed ticket buyers a full and immediate monetary refund for a canceled event. Secure then changed their refund policy, without notice and against Pennsylvania law, to a mandatory store credit and refused to provide monetary refunds for canceled shows, according to the AG’s investigation.

 In response to the Commonwealth's allegations and assertions as detailed herein, Secure Ticket Purchase LLC d.b.a. Box Office Ticket Sales ("Box Office Ticket Sales") states that not providing refunds to Pennsylvania consumers in accordance with its prior website terms and conditions was neither deceptive, fraudulent, misrepresenting, or a cause of confusion or misunderstanding with its customers. Box Office Ticket Sales agrees, however, that its customers who were Pennsylvania consumers and to whom a refund may have been owed for a canceled event under the prior terms and conditions, and that was not provided, may have a breach of contract claim. This claim is subject to the force majeure clause within the website terms and conditions, both prior and current, that allows Box Office Ticket Sales to suspend its contractual obligations in the event of an "epidemic." The Covid pandemic was an unforeseen by the ticketing industry as a whole and the mass cancelation of events created the financial necessity of offering credits instead of refunds to many customers.

Under terms of the Assurance, Secure has agreed to fully refund any Pennsylvania consumer who purchased a ticket before November 19, 2021 to a show which was canceled, and has not yet received a monetary refund. Secure has also agreed to immediately take appropriate steps to comply with the Pennsylvania ticket resale statute. Finally, Secure will pay restitution to the Commonwealth and for the costs of the investigation.
