      am writing on a recent order I placed through the New York and Company website. Unfortunately, I received an incorrect item. Despite multiple attempts to contact customer service, I have yet to receive a response.I would greatly appreciate it if you could assist me in resolving this matter. I would like to either receive the correct items I ordered or obtain a full refund for the purchase.       I purchased 6 items from the retailer in November of 2024 totaling $359.75. The purchase was made using the brand credit card through *************. I returned all 4 items and kept 2 items, totaling $104.99. I have emailed both the credit card company and New York and Company however they still are showing an outstanding balance of $87.82. I am no longer getting responses from NY & Company and the credit card company only says I need to email them. I would like the balance of $87.82 removed from my account and once fixed I would like my account closed.

      On 3/19/2025, I received a text message saying the following and received a promotional email shortly after this text message was received. "Thanks for signing up to New York & Company! Here is your 15% off code ******** Tap to shop: ******************************************** STOP to opt-out"I never signed up for this company and I felt my data privacy was compromised and misused by someone using my cell phone number and email address. I have a serious concern that further unauthorized activity could happen without my awareness, including buying products online, etc. Please investigate this so that if this was done by a faudster, that fraudster is caught. Or, if this was done by the business itselft, that is a violation of consumer's rights and a proper action needs to be taken against the business.

      At this time, I have not been contacted by New York & Company regarding complaint ID ********.

      I requested my email be removed from their marketing list but I also want to make sure that they delete the account that they created using my email and phone number. 
      This type of registration should be initiative by the customer. It is disturbing to know that a ********************** would use whatever data that they had on the consumer to create an account. 

      I don't know what BBB can do to make it clear to their general counsel that this type of business practice should not be condoned, but I strongly believe that should be communicated to their legal department.

      I ordered merchandise from this company. It has been 10 days since I ordered and they have yet to send anything. I paid for 3-5 day shipping, When I requested to cancel they have been saying they have to wait to hear back from the warehouse. The warehouse has not yet responded and its been 2 days. They do not care about you and will not send anything just hold your money. I have had to dispute this charge now and it could be June before it is resolved. Poor customer service and no product.

      3.19.2025 I paid ***** for clothing that they were branding as Fashion to Figure. They were final sale items. I received the order today and none of the items were what I ordered. Their SKU # on the order does not match anything that I received.I ordered SKU # ********, ********, ********, ********, ********. They sent SKU# *********, ************, ************, ************, ************ Instead of canceling my order for not having the items, they sent the most random items that are not my size or similar in style. These are final sale items so I do not have the ability to return the items. Send the correct order or give the money back. I'll happily return these items to the company.

      On February 16, 2025 I placed an order for four jumpsuits and a dress. I never received any of my items. What I did receive was several shirts not my size. I reached out to the business that only seems to communicate through email. Phone calls redirect to email and operating hours say to 9pm EST time but they are closed as early as 6pm and it goes to voice ********** resposes asked me to send pictures of items with SKU codes which I did. Weeks go by I inquire and response is to send the items back that I was sent in error in order to receive a refund. At no point has the business said they would see about sending the items I originally ordered to make this right. Their concern is only on their error and receiving product that I was sent that I did not order, do not like, and can not fit.I want the items I originally ordered or all of my funds back immediately.

      I purchased items from the New York & company website. None of the items said that they were from a 3rd party. When I received the items, they were not NY&Co brand items. This is false advertising. Im requesting my money back for those items. The items are cheap quality items and not the quality of the ****** items.

      **************** was unable to assist or resolve an accidental duplicate purchase on a final sale. Despite contacting them within 72 hours of the purchase, they claimed they couldnt cancel the order. It took three weeks to receive the second product, and they refused to issue any credit or provide any adequate customer service resolutions. Their website provides no customer service phone number, only an email address, and responses appear to be automated, with no human assistance available where I could have resolved this issue much quicker so they didn't have to ship.

      On February 19th, 2025, I placed an order for a number of items on ******** and Co's website. One of the items I ordered arrived damaged and not as described. I contacted New York and company to exchange the item for a new one. They were happy to exchange the item after I confirmed that I would like an exchange over a refund. Since that day, they have not only not exchanged my item, they have continued to give excuses as to why they can't send me the label to exchange their defective item. They have continuously told me they are unable to print the return label, which I find hard to believe as they are a national business that ships and prints shipping labels daily. Instead of an exchange I would now like a refund for my item.
