Back in March 2023 I returned merchandise and it was received well before my statement closing date, however the return wasn't processed timely on ****'s end and I received interest charge that reduced my return from $62.58 to approximately $53.00, which was refunded to me via check. The check is uncashed, as I should have been entitled to the full $62.58. I sent submitted a message to **** to request a reiisuance for the full amount of the expected refund and the representative denied my request. I'd like to request reissuance of a check in the amount of $62.58. This is the second time this has happened to me with ****, which is partly why I stopped shopping at **** (other reason is quality of clothing diminished). The dishonesty of transactions left a bad shopping experience.

At this time, I have been contacted directly by New York & Company regarding complaint ID ********, however my complaint has NOT been resolved because:

Despite me contacting the business years ago via my account login, with no resolution, that prompted me to file a BBB complaint. Current status is Blbusiness refuses to manually adjust and issue replacement refund accordingly.

In order for the BBB to appropriately process your response, you MUST answer the question above.

      Sincerely,

      ********* *****

My daughter-in-law gave me gift cards to NY & Company every year for my birthday for many years. Their styles changed, the stores closed and it was hard to find something to use up my remaining gift card. On January 2 I saw a sweater I liked. I tried to order using the remaining balance of my gift card which is $15.16. I got a message saying there was an error. When I called the number on the gift card, she assured me there was $15.16 on the card. I emailed their Help link and was told they were having technical difficulties and apologized. I tried to order the sweater several times a week since Jan. 2 and got the same message and the same reply when I emailed for Help. I called the number for ******** and the man I talked to said he couldn't help me. I made a copy of my gift card and mailed it to the headquarters location and asked that they send me a check for $15.16 because I was not able to use the card on their website. The letter was mailed on March 18 and came back as not deliverable. Again, I wrote to the Help email address and they again apologized and said they were working on their site. After a dozen or more emails where they apologized that their website wasn't working correctly, then they told me that because of changes in management I couldn't use that gift card for online shopping. They have no physical stores left so if I can't use it for online shopping then I don't know what other options I have. They basically took my daughter-in-law's money and won't give me anything in return. I know you and they are probably thinking it is a small amount but it's the principal of the way they are treating long time customers. I get many emails every day but I don't know why they think I will order from them if they won't honor a legitimate gift card. I don't understand why a business would alienate a customer over $15. If they won't let me use a gift card on their website, then they should do the respectable thing and refund the $15.16.

I made a purchase and quickly attempt to contact the company to cancel and resubmit order as I realized the sizes order were wrong. I called over ***** times to receive only a recorded message that would disconnect each time. I texted the number as advised, no response. I then emailed and received a return email asking my reason for cancellation but did not have any further follow up until 2 days later saying the order had been sent. This purchase is deemed non returnable and rhr company refuses to respond. I only wanted to change the sizing, but one I will no longer ship with this company after doing so for over 20 years. Poor customer service and poor customer loyalty recognition. I will be deleting this company from shopping go-toos.

Complaint Against: New York & Company Order Number: ******** Issue Type: Sales Misconduct / Return Policy Violation I am filing a formal complaint against New York & Company regarding my recent online order (Order #********), which involves misleading sales practices and poor customer service.Upon delivery of my order, I attempted to initiate a return for four items that did not fit. I promptly logged into my account on the *********************** website to begin the return process. At no point during the checkout process or on my digital receipt were these items marked as Final Sale or indicated to be non-returnable. This lack of transparency directly influenced my purchasing decision, as I believed these items were eligible for return or exchange. The website does not provide clearly accessible or transparent return policy information. Due to this, I reached out to the company via email and was informed that my items were non-returnable because they were Final Sale. I responded to clarify that there must be a mistake, as none of the items were labeled as such either on the website during purchase or on the receipt.Additionally, the package I received included a return label, which further implies that the items should be eligible for return. This contradiction led me to believe that the customer service representative provided false or misleading information.I made multiple attempts to contact the company via phone and followed up through email, but I have yet to receive a resolution. Initially, I simply wanted to exchange the items for a larger size. However, due to the company's lack of response and the misinformation I was given, I now request a full refund for the unworn merchandise. The failure to properly label items as Final Sale, refusal to accept a return based on false information, and the complete lack of customer support response constitutes sales misconduct. I feel misled and unfairly treated as a customer and am seeking a resolution.

I purchased 6 items from the retailer in November of 2024 totaling $359.75. The purchase was made using the brand credit card through *************. I returned all 4 items and kept 2 items, totaling $104.99. I have emailed both the credit card company and New York and Company however they still are showing an outstanding balance of $87.82. I am no longer getting responses from NY & Company and the credit card company only says I need to email them. I would like the balance of $87.82 removed from my account and once fixed I would like my account closed.

On 3/19/2025, I received a text message saying the following and received a promotional email shortly after this text message was received. "Thanks for signing up to New York & Company! Here is your 15% off code ******** Tap to shop: ******************************************** STOP to opt-out"I never signed up for this company and I felt my data privacy was compromised and misused by someone using my cell phone number and email address. I have a serious concern that further unauthorized activity could happen without my awareness, including buying products online, etc. Please investigate this so that if this was done by a faudster, that fraudster is caught. Or, if this was done by the business itselft, that is a violation of consumer's rights and a proper action needs to be taken against the business.

I requested my email be removed from their marketing list but I also want to make sure that they delete the account that they created using my email and phone number.
This type of registration should be initiative by the customer. It is disturbing to know that a ********************** would use whatever data that they had on the consumer to create an account.

I don't know what BBB can do to make it clear to their general counsel that this type of business practice should not be condoned, but I strongly believe that should be communicated to their legal department.

      Sincerely,

I ordered merchandise from this company. It has been 10 days since I ordered and they have yet to send anything. I paid for 3-5 day shipping, When I requested to cancel they have been saying they have to wait to hear back from the warehouse. The warehouse has not yet responded and its been 2 days. They do not care about you and will not send anything just hold your money. I have had to dispute this charge now and it could be June before it is resolved. Poor customer service and no product.

3.19.2025 I paid ***** for clothing that they were branding as Fashion to Figure. They were final sale items. I received the order today and none of the items were what I ordered. Their SKU # on the order does not match anything that I received.I ordered SKU # ********, ********, ********, ********, ********. They sent SKU# *********, ************, ************, ************, ************ Instead of canceling my order for not having the items, they sent the most random items that are not my size or similar in style. These are final sale items so I do not have the ability to return the items. Send the correct order or give the money back. I'll happily return these items to the company.
