The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On August 6, 2025, the Maryland Attorney General announced that his Consumer Protection Division has entered into a settlement with Probate Advance, LLC, a New York-based company. Probate Advance, LLC provides cash advances to people who have an unverified claim as an heir to an estate. In exchange, these consumers must agree to sign over all or part of their future inheritance to the company when the estate is settled and distributed. The Division alleges that in doing so Probate Advance has violated Maryland’s Consumer Protection Act and lending laws.
The settlement with Probate Advance, LLC requires the company to return nearly $2.7 million in restitution to Maryland residents. In addition, Probate Advance, LLC has agreed to pay $275,000 to the Consumer Protection Division of the Attorney General’s Office. Under this settlement, Probate Advance, LLC has agreed to cease advertising, marketing, offering, or providing cash advances to Maryland residents or to consumers in connection to an estate administered in Maryland. The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On
July 8, 2024, the Connecticut Department of Banking announced a Consent Order
with Probate Advance, LLC d/b/a InheritFast after an investigation into its
activities. As a result of such investigation, the Commissioner alleges that
from at least December 20, 2018 to August 24, 2023, Probate Advance, LLC:--made at least 31 small loans to Connecticut borrowers without the required
small loan license; offered a small loan to a prospective Connecticut borrower or solicited a
Connecticut resident for a small loan without the required license; received payments in connection with small loans made to Connecticut borrowers
without the required license; and advertised small loans in this state without the required license.
Probate Advance, LLC agreed that it shall not violate Section 36a-556(a) of the
2024 Supplement to the General Statutes by, including, but not limited to,
making small loans; offering, soliciting, brokering, directly or indirectly
arranging, placing or finding a small loan; engaging in any other activity
intended to assist a prospective Connecticut borrower in obtaining a small
loan; advertising small loans; and receiving payments in connection with small
loans made to Connecticut borrowers, without having first obtained a small loan
license.
Probate Advance, LLC also agreed to pay a civil penalty of $10,000 to the
State, an additional $2,400 as payment for back licensing fees, and to refund
all amounts received in excess of an annual percentage rate of twelve (12) %,
directly or indirectly, from a Connecticut borrower in connection with a
transaction in the amount of $15,000 or under made by Probate Advance while not
licensed as a small loan lender in Connecticut.
