I'm receiving a random letter in the mail from them tomorrow. Basically, saying it's one I'm hearing, let's something about my dad's inheriternce It's been given to my mom completely. *** ******* complains about receiving marketing materials from Probate Advance and believes that we are spamming her and her family. Probate will market its services to potential consumers, in this case potential probate beneficiaries. Nothing about doing so based on publicly available records is predatory in nature and its customers are never under any duress to do business with Probate Advance. Consumers must apply for inheritance funding and nothing supports the idea that they are doing so under pressure. Probate Advances services are beneficial to those customers that prefer to receive a portion of their inheritance now rather than wait for the lengthy legal proceedings to conclude. And as a practical matter, the fundings provided to customers are a product of their assignment of a portion of their probate estate interest to Probate Advance; this product is a sale/assignment and not a loan.
Prior to receiving their complaint, Probate Advance did not have any contact with or received any requests from *** ******* or her family to be removed from future mailings. Consistent with our practice of promptly removing any consumer from our mailing lists upon request, we have proactively removed her and the estate from any future mailing distribution lists. Unfortunately,any correspondence received by *** ******* after their request was already in process at the time and could not be intercepted.Customer Answer

On approximately June 16th 2025 I contacted probate advance and was put in touch with the underwriter ****. After relaying all of my information that was requested case number my father's name date of birth date of death and other information that I did not understand that was pertinent such as my social security number where I was born etc and the very beginning **** was very helpful in obtaining court documents and records and agreement was reached for $20,000 advanced against the probate of the will for a return of $36,900 all documents were signed electronically and notarized and return to **** at probate advanced I was told by **** that on June 27th close of the day at 4:00 p.m. the money would be transferred to the account that I provided with routing number account number and name on account. After checking numerous times the money never reached the account and was never transferred by wire as was explained to me. Monday and Tuesday the following week I contacted the bank and verify that no money was pending and waiting for deposit at that time I contacted **** and can get no response he has not returning phone calls at which time I contacted requesting to speak to a supervisor I spoke to twice and said that this would be taken care of at this time I cannot get response from either **** nor the supervisor and at this time no money has been deposited into the account and has been mentioned above. I would like all paperwork resend it all signatures that were made under duress to be nil and void at this time. Probate Advance appreciates the opportunity to address ***-******* ******* complaint. He complains that around June 16, 2025, after he provided information about his father, the court case and other private information, he signed paperwork with Probate Advance for a $20,000 cash advance but did not receive any money to his account.
Prior to receiving this complaint, Probate Advance last had contact with *** ****** by email on June 20, 2025, as a follow-up to see if ********* wished to discuss how Probate Advance could assist him with his case. There was no response. Upon further review, Probate Advance does not have any signed paperwork by *** ****** for his case. We believe he has followed up with the wrong company and needs his attorney to reach out to the correct company for assistance.
In light of the fact *** ****** has contacted the wrong company, he needs to contact his attorney regarding the next steps. For that reason, we consider this matter closed.

Absolutely predatory lending! I had called for an advance on my dad's estate. I was told I could get $15,000. Once it was said and done, paperwork signed and all I was only e er given $5,000. I was told the other $10,000 would be made available AFTER I pay back the $15,000 plus the amount charged for the loan. Now the agent I worked with. His name is **** by the way, refuses to give me an amount that will satisfy the loan. It's only being disclosed to the executor of the estate and/or the attorney for the estate! I have asked to speak to a supervisor and I am ignored completely. This company is an absolutely awful group of people. There is absolutely NO WAY this is even legal.Business Response

******** complained that she was approved for a $15,000 inheritance advance and had not received the remaining $10,000 balance as of the date this complaint was filed. She also complained that Probate Advance was not willing to work with her. Probate Advance has worked with *** ***** to try and clarify what is needed to release the remaining holdback funds provided in her assignment agreement with Probate Advance.
On December 24, 2024, *** ***** executed an assignment agreement assigning up to $39,000 of her interest in a probate estate in exchange for an immediate cash payment of $5,000 and a subsequent cash payment of $15,000.00. Under her assignment agreement, the subsequent cash payment was conditioned partly on the sale of the estates property. On June 9, 2025, ****** ******** the estate attorney, contacted Probate Advance to confirm what paperwork needed to be completed by *** ***** for her assignment agreement. On June 10, 2025, ********** contacted Probate Advance for payment instructions and confirmed she was waiting on the heir to sign off on the closing of the estate so funds could be distributed. She confirmed on June 18, 2025, that the estate and property had been sold and a wire would be sent out on the same date. On June 24, 2025,payment of the subsequent cash came in the amount of $15,000.00 was issued to *** ****** in addition to rebate amounts owed to her under the assignment agreement.

Under the terms of *** ****** assignment agreement, the release of holdback funds was partly conditioned upon Probate Advances determination that there were sufficient assets in the probate estate to satisfy the assignment to Probate Advance. Instead the representative sent a message to me the following day saying "I know you do not like us very much but do you still want this money." I find it very distasteful that a company who is supposedly trying to help someone during a difficult time in their life with the passing of a father would taunt someone. Probate advance gave me a advance offer of ******. They sent me paperwork to sign and credit card. But they only advanced me ****** of the ****** agreed on. Then they stated they needed to make sure I was 50% heir to the estate in which I sent them prior court proceedings proving I was. Now I can't get anyone to answer my phone calls..emails or texts?? Probate Advance appreciates the opportunity to respond to *** ****** complaint. *** ***** complains that he was promised an inheritance advance of $40,000 but that he has only received $20,000 of that amount, and that he is responsible for repaying his funding based on the $40,000 amount. ******** is mistaken as to how his assignment amount will be calculated and the terms of his inheritance advance.
*** ***** is correct that the total maximum of his advance under his assignment agreement is $40,000, but that is only a maximum. Under the terms of his agreement, he would be advanced $20,000, and Probate Advance would provide him with an additional $20,000 if the following conditions were met: (1) there is a determination of heirship confirming *** ***** as a 50%heir of the estate, and (2) Probate Advance has confirmed that there are sufficient estate assets to fully satisfy all of Probate Advances assignment agreements with ********************************* has been determined to be a 50% heir of the estate, the second condition has not been met as the real property associated with and constituting a majority of the estates assets is currently occupied by *** ****** uncle, which he was aware of at the time of executing his assignment agreement, but neglected to disclose. Given that the occupant has rights to a life estate and might reside in the property for years until it is sold, it is not possible to determine the likelihood that there will be sufficient assets to satisfy Probate Advances assignment. Once Probate Advance determines that sufficient assets are available to ensure its assignment will be honored, the remainder of the inheritance advance will be disbursed.
If the conditions are not met, *** ****** assigned amount will reflect a prorated amount based on the amount of the inheritance advance provided under his assignment agreement. *** ***** may also seek a cancellation of his assignment agreement at any time within the next 2 weeks (until 4/23/2025), if he is willing to return the $20,000 he has been disbursed by contacting **** ********* at ***********************************************************.Customer Answer

The main reason I filed a complaint is that Probate Advance informed me just like in their rebuttal, they stated as soon as they establish my 50% heirship..they would honor our agreement and send me the other 20k promptly. I understand that you guys want your compensation and that's fine. But that's the deal we signed therefor u just admitted you have established that im 50% heir so I need you to promptly forward my compensation. If not..there are grouds for breach of contract here and our contract is in black and white. Thank u for your service. Just honor our contract and collect the 40k profit that u made off my inheritance. As stated in Probate Advances prior responses, under the terms of his agreement, *** ***** would be advanced $20,000, and Probate Advance would provide him with an additional $20,000 if the following conditions were met: (1) there is a determination of heirship confirming ******** as a 50% heir of the estate, and (2) Probate Advance has confirmed that there are sufficient estate assets to fully satisfy all of Probate Advances assignment agreements with *** *************** apologize for our prior mistake, but after further review of the probate matter docket, we have learned that the first condition has not been met. While a motion has been filed, no determination has been made as to heirship. If such an order has been entered, *** ***** should share that immediately.
Thus, for the above reason, and the reasons previously stated, neither condition has been met, and Probate Advance will not disburse the remainder of the inheritance advance until those conditions have been met.

Both of my parents died in the last 5 years and these ghouls won't stop sending me letters about getting money through their garbage company "NOW" while I wait for my inheritance. I receive constant mailings from this company. The most recent mailing imitated the look and feel of official tax paperwork. This isnt a coincidence, given the time of year Im sure. That was the last straw for me. Im tired of their predatory marketing strategy. I have received dozens of mailings. I shouldnt need to call to unsubscribe. Maybe just dont harass people? The sole reason I reached out was because that individual piece of mail looked so urgent I put it aside and paid special attention to it. Then when opening it, I was furious because I had been receiving WEEKLY mailings from them and they continued to disguise them in unique PREDATORY ways to avoid getting them thrown out in the trash where they belong. They did remove me from their list and I haven't received more mailings, but I am not satisfied unless they cease using this inappropriate and unethical marketing style.

I have been constantly been getting solicited by this company as a Heir for an estate. I am not an Heir. I am the Admin and creditor. Also My mother now gets the mail.. To my mailing address. She doesn't live there. I have called 4 times. Last phone call no one picked up. Other 3 they said they would stop the mail. This is the 5th letter. I have received 3 to me and 2 to my mother. I'm guessing they are sending this to the other heir in a different State. I never gave them my info and they just take it from Court records and ****** me. I would like this to stop and some compensation for this. Now they have my info. I never gave that to them and it will probably get sold or stolen along with my mother's. They are not very helpful and all they want to do is make money off your loved ones loose. This is upsetting to me. The person whom the Estate was was close to me and this just makes the whole difficult situation worse. I would like this to stop. Instead of telling to me and saying no more letters they send more a week later! How would you like to be reminded and pestered about someone you cared about bringing it up all the time and I have to deal with the whole estate and should be lest alone by ambulance chasers. **** ***** complains that he and his mother (who does not reside at his address) are receiving constant mailing materials from Probate Advance and believes that we are engaging in some form of predatory marketing. We regret any inconvenience to *** ***** and his family. Probate Advance relies on public probate documents to reach consumers, and its customers are never under any duress to do business with Probate Advance.
Prior to the receipt of this complaint, Probate Advance received an email asking that he and his family not be contacted on December 20, 2024. Consistent with our practice of promptly removing any consumer from our mailing lists upon request, we have removed ***** and the entire estate from any future mailing distribution and marketing lists.Initial Complaint

We do regret the inconvenience in paperwork accidentally being sent to *** ***************** Prior to receiving this complaint, Probate Advance received an email sent by *** *** on October 25, 2024, where he requested that he be removed from any and all contact. At that time, consistent with our practice of promptly removing any consumer from our mailing lists upon request, ***** *** was removed from any future mailing distribution lists. Unfortunately, in error, *** **** information was not completely removed from our distribution lists and further correspondence was sent in error. This error has been corrected, and *** *** will not receive any further mailings from Probate Advance.
