Both of my parents died in the last 5 years and these ghouls won't stop sending me letters about getting money through their garbage company "NOW" while I wait for my inheritance. First off, my parents left this world without anything to inherit and, second, this company is obviously a scam. My Dad has been dead for 5 years now and my Mom for 3. I receive constant mailings from this company. The most recent mailing imitated the look and feel of official tax paperwork. This isnt a coincidence, given the time of year Im sure. That was the last straw for me. Im tired of their predatory marketing strategy. I have received dozens of mailings. I shouldnt need to call to unsubscribe. Maybe just dont harass people? I finally unsubscribed officially and I better not receive any more mailings. They also harass my family at other addresses.Business Response

Prior to the receipt of this complaint, Probate Advance received a phone call from ***** on January 6, 2025, at which time he provided his name and unsubscribe code. I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:They did not acknowledge the PREDATORY MARKETING of masquerading their materials as legal/tax documents, per the original attachment that I sent. The sole reason I reached out was because that individual piece of mail looked so urgent I put it aside and paid special attention to it. Then when opening it, I was furious because I had been receiving WEEKLY mailings from them and they continued to disguise them in unique PREDATORY ways to avoid getting them thrown out in the trash where they belong. They did remove me from their list and I haven't received more mailings, but I am not satisfied unless they cease using this inappropriate and unethical marketing style.

I have been constantly been getting solicited by this company as a Heir for an estate. I am not an Heir. I am the Admin and creditor. Also My mother now gets the mail.. To my mailing address. She doesn't live there. I have called 4 times. Last phone call no one picked up. Other 3 they said they would stop the mail. This is the 5th letter. I have received 3 to me and 2 to my mother. I'm guessing they are sending this to the other heir in a different State. I never gave them my info and they just take it from Court records and ****** me. I would like this to stop and some compensation for this. Now they have my info. I never gave that to them and it will probably get sold or stolen along with my mother's. They are not very helpful and all they want to do is make money off your loved ones loose. This is upsetting to me. The person whom the Estate was was close to me and this just makes the whole difficult situation worse. I would like this to stop. Instead of telling to me and saying no more letters they send more a week later! How would you like to be reminded and pestered about someone you cared about bringing it up all the time and I have to deal with the whole estate and should be lest alone by ambulance chasers. We do regret the inconvenience in paperwork accidentally being sent to *** ***************** Prior to receiving this complaint, Probate Advance received an email sent by *** *** on October 25, 2024, where he requested that he be removed from any and all contact. At that time, consistent with our practice of promptly removing any consumer from our mailing lists upon request, ***** *** was removed from any future mailing distribution lists. Unfortunately, in error, *** **** information was not completely removed from our distribution lists and further correspondence was sent in error. This error has been corrected, and *** *** will not receive any further mailings from Probate Advance.

I find their solicitation for advancing money on my mother's estate offensive. I contacted the company and emailed the owner personally, asking him not to send me mail to my address anymore. I received letters from this company again this week. I am extremely upset. I would think that when the owner of a company is contacted, he would do something about it. I am absolutely beside myself. My father's home was in probate and I (his daughter) needed money to clean the place up. Contacted Probate Advance for an advance from the home. I got 3 advances. At first I was going to sell the home but have since decided to keep it. I informed Probate Advance of my decision. Myself, my *********** Attorney and my *********** Agent have all been trying to reach my Agent at Probate Advance (***********************) since May 07, 2024. We keep leaving voice mails with no return calls. Then call customer service and they say they'll take a message and will have the appropriate people give us a call back. No one ever calls back to solve the payoff issue. We are afraid that they are ignoring our calls so that they can keep adding on charges and then eventually take my home. I feel they are predators and they prey on the elderly, which I am elderly. I am also contacting ********************* and reporting them. They did not inform me that I would have to pay the amount I borrowed, plus there fee which keeps increasing. This is all affecting mine and my husband's health which we are both disabled in one way or another.Business Response

Probate Advances services are beneficial to those customers that prefer to receive a portion of their inheritance now rather than wait for the lengthy legal proceedings to conclude.The fundings are provided to customers via an assignment of a portion of their probate estate interest to Probate Advance; this product is a sale/assignment and not an advance.
On October 27, 2023, the complainant reached out to Probate Advance, as the sole heir of her fathers estate, to request an inheritance funding. The complainant executed three assignment agreements on October 31, 2023; November 22, 2023; and January 11, 2024, for a total purchase amount of $70,000 in exchange for assigning $176,000.00 of her interest in the probate estate. These assignments were provided on the basis that the probate estate consisted principally of the residence referred to by ****************. Accordingly, **************** promised under those assignment agreements that the property would be sold so that Probate Advance would be paid its interest in the probate estate.
On May 7th, **************** contacted Probate Advance to state her desire to stay in the residence. Probate Advance stated that if that was the case, it was willing to accept a buy-out of the assignment.While we waited for her response, Probate Advance tried to reach **************** on May 9th, 24th and 31st, June 7th and 25th without success. On June 21, 2024, Probate learned from the personal representative of the estates counsel that **************** has decided to sell the home.
**************** states that she has not received any response from customer service at ********************** since May 07, 2024. It is untrue that **************** has attempted to contact Probate since then and, in fact, Probate Advance has been awaiting a response on whether **************** would buy out the funding or sell the home as provided in her agreements with Probate Advance.
Probate Advance is not requiring that **************** sell the home she is free to buy out the funding. However, if **************** is unwilling to comply with her obligations under her assignment agreements, Probate Advance will take such action as is necessary to protect its interest in the probate estate, for which **************** received $70,000 in return.Initial Complaint

I find it completely despicable that these companies prey on grieving survivors. I have been contacted four times to remind me that my daughter passed away. Three times after I followed their directions and also called them. (This excludes the 3 letters mailed to my wife that I did not document.). This probate was completed months ago and all proceeds were distributed. This is purely harassment. I do not doubt these letters have gone out to all four other people named in the will. I used probate advance to receive 160k in January of 2023. After 3 months, I paid them back plus their commission. Nevertheless, I paid them back the required amount. $******* and they would refund me the difference from *******. Minus what I owe them which they did except 10k. Holding it like hostage till my probate court closes which doesnt make sense being that they were paid in full. I have all the receipts of the wire payment. They did wire me back the difference except 10k. They still have a lien on my property and said they will wait till my probate court finalize and they will refund it back to me . Fast forward today April 2024. My probate case has ended and is closed by the court. I have reach out to probate advance almost a year and half asking them about 10k and to no avail they never ever return a call back from them on the status. Since my probate court has ended and they been paid in full except the 10k they said they will refund back to me. I have not seen this transaction yet. When I try to reach the appropriate person who help me in the beginning.. they always say he is not available and when I finally got a hold of him , he would say I never got your messages. They are literally lying. They kept saying they would asap the issue and get back to you but no one does. There is no reason why they should still have a lien on my property since they been paid in full. I need them to release the lien off my property and deed!!! I find this to be so unprofessional and horrible business practice. First of all they have not been honest on their term of release of all lien off my estate. We spoke with her further on 4/24/2024 and remitted the remainder of the rebate (10K) to her that same day. In early 2024, I received a letter from this 'business' regarding my deceased mother's estate, which was working its way through probate court. The letter gives instructions on how to be removed from their contact list, which I followed. I continued to receive their solicitations, and in March of 2024 I submitted a complaint to the BBB. "Probate Advance LLC" responded, and I believed I would no longer be contacted. I have received further contact from this organization via **** today, 11/18/24. The sensitive nature of this should not be misunderstood - this organization is preying on those who have lost loved ones and are involved in lengthy legal battles, often entangled with complicated family dynamics. This is an evil company practicing an evil act, and I wish not to receive any communications from them.
