      I am writing in reference to *** *****'s complaint. American Mint received an online order from *** ***** on January 18, 2021 for a ****** ***** - Battle commemorative coin. The ****** ***** - Battle commemorative coin is a .585 solid gold item and is part of The Speeches of ****** ***** commemorative coin collection. American Mint received a credit card payment of $136.90 (the coin was $129.95 with $6.95 shipping). Enclosed for your review is a copy of the order received from *** *****. On January 25, 2021, American Mint instructed its distributor to ship a ****** ***** - Battle commemorative coin. 

      At the time *** ***** placed her order online, American Mint offered the item *** ***** ordered as part of a collection under the "Collect and Save" option. *** ***** selected the "Collect and Save" option. Per the terms of the public offer then clearly stated on the website, *** ***** was also shipped one (1) ****** ***** - Pledge commemorative coin on February 12, 2021 as an authorized future issue to preview with no additional obligation to purchase. The ****** ***** – Pledge commemorative coin is also a solid .585 gold coin.

      American Mint did not receive the ****** ***** - Pledge commemorative coin as a return nor payment for that item. Therefore, *** ***** continued to receive monthly invoices, acquired late fees and her account was referred to a collection agency on January 13, 2022. *** ***** alleges that she received collection notices from the collection agency for items that she did not purchase. Contrary to *** *****'s allegations, American Mint only shipped and billed *** ***** for merchandise in compliance with the terms of the order form. 

      To resolve this complaint, American Mint made a onetime exception and has written off the remaining balance of $159.40 due for the ****** ***** - Pledge commemorative coin. *** ***** has a zero account balance. Enclosed is an account cleared letter. *** ***** should allow up to thirty days for all collection activity from the collection agency to completely cease.

      I am writing in reference to *** *******'s complaint. *** ******* placed an order for an introductory item in The Speeches of ****** ***** commemorative coin collection. Pursuant to the terms of the public offer clearly printed on the order form which *** ******* voluntarily marked up and returned to American Mint, he was sent one (1) ****** ***** - Energy commemorative coin as an authorized future issue in the collection to preview with no additional obligation to purchase. Upon expiration of the free preview period, American Mint began to bill *** ******* for the ****** ***** - Energy commemorative coin after he never returned nor paid for that item. 

      *** ******* alleges that he received invoices for merchandise that he did not order nor receive. American Mint denies these allegations. Enclosed, are copies of *** *******'s order form and check # 9496 which he voluntarily marked up, signed and returned to American Mint. The order form and check clearly demonstrate that *** ******* placed an order for a ****** ***** - Battle commemorative coin. *** ******* never contacted American Mint regarding his order. American Mint has processed *** *******'s order as a post loss and cleared his remaining balance due for the ****** ***** - Energy commemorative coin. *** ******* will receive a refund check in the amount of $16.90 within the next 2-4 weeks for the ****** ***** - Battle commemorative coin. 

      The relevant facts are as follows. American Mint received an introductory order form in the mail from *** ******* on May 27, 2022 for a ****** ***** - Battle commemorative coin. This item is part of The Speeches of ****** ***** commemorative coin collection. We received payment of $16.90 (the coin was $9.95 plus $6.95 plus sales tax) via check # ****. Enclosed for your review is a copy of the order form and check voluntarily marked up and returned to American Mint. 

      As offered to the public, an initial order in the collection entitles all orderers to receive future issues in the collection. Specifically, as clearly printed on the form, "By returning this form, you will have the privilege of receiving future issues in the collection through our FREE in-home approval service. No further action is required on your part. If you do not wish to preview future issues in the collection, please x-out this paragraph." *** ******* did not x-out this paragraph. 

      Moreover, in its "Satisfaction Guarantee" American Mint informs each orderer that they have the right to refuse receipt of future issues. American Mint explains: "You will be billed at the regular price for the items you decide to keep, plus applicable shipping and sales tax. Shipments arrive about once a month. You are under no obligation! If you are not satisfied with any item that is shipped to you, you may send it back within 90 days at our cost for replacement, credit or refund." Moreover, American Mint points out to each orderer that, "[y]ou can cancel this service at any time by calling toll-free 1-877-807-MINT." 

      On May 31, 2022, American Mint instructed its distributor to ship a ****** *****- Battle commemorative coin along with one (1) ****** ***** - Energy commemorative coin as an authorized future issue in the collection to preview with no additional obligation to purchase. Pursuant to the terms of the public offer, *** ******* had ninety days to preview the ****** ***** - Energy commemorative coin for free. He also had the right to cancel the authorized future service at any time by contacting American Mint at its toll-free number. American Mint did not receive the ****** ***** - Energy commemorative coin as a return nor payment for that item. Therefore, *** ******* continued to receive monthly invoices. 

      In conclusion, *** ******* was shipped merchandise pursuant to the terms of the public offer clearly printed on his order form. *** ******* alleges that he did not receive his above- mentioned order. American Mint has processed *** *******'s order as a post loss and cleared his remaining balance due for the ****** ***** - Energy commemorative coin. Enclosed is an account cleared letter. *** ******* will receive a refund check in the amount of $16.90 within the next 2-4 weeks for the ****** ***** - Battle commemorative coin.

      I purchased an individual collector's coin from Americanmint.com online and paid using ******. I received a receipt from ****** for that purchase. I received the coin I ordered. However, a month later another coin that I did not order arrived in the mail asking for payment of $155.30 if I'd like to purchase this coin or I can return it and not be charged. I did not ask for this coin, so why then would I have to return something I did not ask for and further more pay for shipping to send it back! I phoned the company ************** and they said I had enrolled in the collection program (which I told them I did not). I asked them to show me proof where it says I opted in for such a program and they could not, but instead explained how I enrolled myself in this program. So I repeated the question and asked them if that is the case, where in writing is my confirmation of enrollment and they couldn't answer that. I asked them to tell me how I would have enrolled and they told me where the option for that was at check out. I followed their instructions to see this option and saw there was no such option when checking out. What is really most strange is this is the 2nd verse coin which is not even available on their website to purchase, nor any information about a 2nd verse coin when purchasing the coin I did to say there is 2 coins available in that collection. They said they would send me a shipping label with shipping paid for to my email address. No label was received. I called back few days later and asked them to resend. They confirmed the email address but still no label. I called them 3rd time and asked them to send the shipping label to my husbands email address and again no label was received. Please assist me in this matter as this is a con or a scam! I certainly do not want to be sent a charge or collections note for a coin I did not request to purchase. The coin I ORIGINALLY purchased is the one on their website "God Save the Queen".

      I am writing in reference to *** *********'s complaint. On September 8, 2022, *** ********* placed an online order for a 1st Verse - National Anthem commemorative coin. This is the introductory item in the God Save the Queen Collection. *** ********* remitted a credit card payment of $28.10 (the coin was $19.95; the shipping and handling was $6.95 plus sales tax) for the 1st Verse - National Anthem commemorative coin. *** ********* was shipped one (1) 1st Verse - National Anthem commemorative coin on September 12, 2022. Pursuant to the terms and conditions clearly stated on the website at that time, *** ********* was later shipped one (1) 2nd Verse - National Anthem commemorative coin on October 17, 2022 as an authorized future issue in the collection to preview with no additional obligation to purchase. *** ********* alleges that she was enrolled in the collection program although the collection program and its terms and conditions were never disclosed to her. American Mint denies these allegations. 

      American Mint voluntarily ceased selling merchandise online as part of collections, also known as continuity plans, approximately on September 30, 2022. Therefore, the terms and conditions of the continuity plan no longer appear on the website. At the time *** ********* voluntarily placed her order online on September 8, 2022, the continuity plan was still offered on the website under the "Collect and Save" option. Since *** ********* chose to purchase the introductory item at the advertised discounted price under the "Collect and Save" option, she gave her affirmative consent to receive authorized future issues in her collection to preview with no additional obligation to purchase pursuant to the terms and conditions of the public offer that were clearly stated on the website. Enclosed, is a sample order form like the one that *** ********* voluntarily completed and submitted to American Mint online on September 8, 2022. In addition to the product page, I have also enclosed copies of the shopping cart page and the checkout page which each clearly disclose that *** ********* would receive authorized future issues to preview in her collection. Thus, *** ********* was informed three separate times before check out that she would receive authorized future issues in her collection to preview. 

      It appears that *** ********* recently searched American Mint's website after September 30, 2022 in order to locate the existence of the collection program she voluntarily enrolled in as well as its terms and conditions. *** ********* would not have located the collection program she enrolled in nor would she have found its terms and conditions anywhere on the website since American Mint ceased selling items as part of collections on September 30, 2022. The item *** ********* purchased, the 1st Verse – National Anthem commemorative coin, is still offered on American Mint's website. However, it is now only offered as an individual item only at the item's regular price. 

      *** ********* admits to receiving the introductory item and authorized future issue in her collection. Subsequent to the receipt of her authorized future issue, *** ********* called American Mint twice on November 4, 2022, once on November 8, 2022 and she e-mailed American Mint on November 9, 2022. After each contact with the customer, American Mint customer service promptly e-mailed *** ********* a postage paid, self-addressed mailing label to use to return the 2nd Verse - National Anthem commemorative coin per her request. 

      In total, *** ********* was e-mailed four postage paid, self-addressed mailing labels to use to return the 2nd Verse - National Anthem commemorative coin. Enclosed is a confirmation page showing that four separate prepaid labels were generated for *** *********. This page also shows that according to the labels' tracking number, *** ********* did not use any of the labels to return her merchandise. *** ********* admitted to American Mint customer service in an e-mail dated November 9, 2022 that she received the latest prepaid label. Enclosed, is a copy of this e-mail from *** ********* to customer service. As of the date of this response, *** ********* did not use any of the prepaid labels to return the 2nd Verse - National Anthem commemorative coin or the 1st Verse - National Anthem commemorative coin. 

      On November 4, 2022, *** ********* called American Mint regarding an invoice she received for the 2nd Verse - National Anthem commemorative coin. She alleged that she ordered and received the 1st Verse - National Anthem commemorative coin, but later received an additional unordered coin, the 2nd Verse - National Anthem commemorative coin, and invoice although she alleges that it was not disclosed to her on the website that the item would be shipped or billed to her. American Mint denies these allegations. 

      Contrary to *** *********'s allegations, the customer service representative explained to *** ********* that when she placed the order for the 1st Verse - National Anthem commemorative coin on September 8, 2022, she was opened into a collection per the terms and conditions clearly stated on the website. The representative explained that *** ********* was given two choices, either the "Collect and Save" option or the "Individual Item Only" option and that she opted to purchase the introductory item at the discounted price under the "Collect and Save” option. Therefore, she gave her affirmative consent to receive authorized future issues in her collection to preview pursuant to the terms and conditions of the Satisfaction Guarantee paragraph clearly stated on the website at the time the order was placed. *** ********* was advised that at the time of her order, she could have purchased only the 1st Verse - National Anthem commemorative coin at the regular price if she had selected the "Individual Item Only" tab, and that the website advised her that the item was part of a larger collection before she clicked "Add to shopping cart." 

      *** ********* stated that when you purchase the 1st Verse - National Anthem commemorative coin on the website, there is only one option, the "Individual Item Only" option, and that there was no mention of a collection or a "Collect and Save" option to select. Instead, she states that you click 1 total, then click "Add to shopping cart" and then pay for the item. Contrary to *** *********'s allegations, she only saw the "Individual Item Only" tab on the website when she recently viewed it because American Mint ceased selling collections on its website on September 30, 2022. *** ********* was advised that she selected the "Collect and Save" option when she placed her order on September 8, 2022 wherein, she opted to receive the 1st Verse - National Anthem at the advertised discounted price of $19.95 (plus shipping and sales tax) and to receive authorized future issues in her collection to preview with no additional obligation to purchase. 

      *** ********* stated that she was not interested in keeping the 2nd Verse - National Anthem commemorative coin. At this time, *** *********'s collection was cancelled. She was e-mailed a postage paid, self-addressed mailing label per *** *********'s request. *** ********* was advised to place the 2nd Verse - National Anthem commemorative coin back in its original package and properly secure the package, place the prepaid label over the package and hand it over to her local mail carrier. *** ********* was advised that once she shipped her returns, she could call customer service to confirm that American Mint received her returns. American Mint can track packages that utilize its mailing labels. 

      On November 4, 2022, *** ********* called customer service again later that day. She indicated that she had not yet received the prepaid shipping label in her inbox. *** ********* was advised that it showed on the account that the prepaid label was created and sent. At this time, the representative resent a second postage paid, self-addressed mailing label to *** *********. *** ********* was advised that for prepaid labels e-mailed, it should take 3-5 minutes to receive. *** ********* was advised to call back if she did not receive the prepaid label. 
      On November 8, 2022, *** ********* called customer service and stated that she still did not receive the shipping labels previously sent to her e-mail address. *** ********* was advised that two prepaid labels were previously sent to her e-mail address. *** ********* gave customer service her husband's e-mail address to see if he could receive a prepaid label. At this time, customer service sent *** *********'s husband a postage paid, self-addressed label to use to return the 2nd Verse - National Anthem commemorative coin. 

      On November 9, 2022, American Mint received an e-mail (enclosed) from *** ********* wherein she alleged that she still had not received any of the prepaid labels previously sent to her. In her e-mail, *** ********* essentially reiterated all the allegations she previously made. American Mint denies all the allegations *** ********* made in her e-mail for the same reasons set forth above. 

      On November 9, 2022, customer service sent *** ********* an e-mail (enclosed) wherein they attached a fourth postage paid, self-addressed mailing label for use with returning the 2nd Verse - National Anthem commemorative coin. On November 9, 2022, American Mint received a second e-mail (enclosed) from *** ********* wherein she admitted that she received the fourth postage paid, self-addressed mailing label. 

      In conclusion, *** ********* placed an online order on September 8, 2022 for a 1st Verse - National Anthem commemorative coin. This item is the introductory item in the God Save the Queen Collection. American Mint clearly and conspicuously disclosed the existence of its continuity plan and all the material terms and conditions of its collection program at or before the time of purchase. *** ********* could not locate these disclosures for the item she ordered online after recently viewing the website because American Mint no longer sells merchandise online that is part of continuity plans. As of the date of this response, *** ********* has not used any of the prepaid labels to return the 2nd Verse - National Anthem commemorative coin although she admitted to receiving the most recent prepaid label. American Mint acts in good faith with its customers. Although American Mint never received the 2nd Verse - National Anthem commemorative coin as a return nor did it receive payment for that item, it made a onetime exception and wrote off the remaining balance due for the 2nd Verse - National Anthem commemorative coin. Enclosed is an account cleared letter. In addition, although American Mint never received the 1st Verse - National Anthem commemorative coin as a return, American Mint will make a onetime exception and issue *** *********'s credit card a full refund of $28.10 for the 1st Verse - National Anthem commemorative coin. *** ********* should expect to receive her refund within the next 3-5 business days.       On July 20, 2022 I helped my father (94 years of age) ordered a knife through an advertisement that came in his name with an account number to this company. A check of $36.90 was sent with the order through the mail. The knife was received along with another knife that wasnt even mentioned in the original order and a bill of $113.77 was sent along with the knife that had been ordered. Interestingly, the knives arrived with a different account number under a variation of my name rather than my fathers name. In my first conversation I was told that there was no longer any record of my father or his account number only one in my name. My name should have never been associated with any of this transaction. The knives were both sent back and a refund was requested. I have called numerous times and told multiple stories concerning this refund and have never been allowed to speak to a supervisor. I have made five different attempts to resolve this by phone. It has now been 13 weeks since this began. All I get is the runaround and the whole thing has been nothing but a scam. It is true that my father can afford to lose $36.90. My frustration lies in the fact that there are likely many senior citizens that are being taken advantage of by this company with the deceit that I have encountered.       I am writing in reference to *** ******** *******s' complaint. *** ******** assisted her father, ******* *******, in placing an order for a Buffalo **** ***** Knife. This is the introductory item in the Wild West ***** Knives Collection. Pursuant to the terms of the public offer clearly printed on the order form which *** *******/*** ******** voluntarily marked up and returned to American Mint, they were sent one (1) Wild **** ****** ***** Knife as an authorized future issue in the collection to preview with no additional obligation to purchase. 
      *** ******** admits that they received the Buffalo **** ***** Knife, but she alleges that they also received an additional unordered knife along with an invoice. American Mint denies these allegations. American Mint does not send its customers unordered merchandise. *** *******'s order form, which *** *******/*** ******** voluntarily marked up and returned to American Mint, clearly expressed that they would receive authorized future issues in their collection to preview with no additional obligation to purchase and that they could return unwanted items at American Mint's expense within ninety days for a full credit or refund. 

      American Mint received *** ********/*** *******'s order form on July 26, 2022. Enclosed, is a copy of the order form which *** ********/*** ******* voluntarily marked up, signed and returned to American Mint. The order form was addressed to ******* *******, ***** ** ***** **., Vashon, WA **********. The order form bears the signature of "**** *******." Along with the order form, American Mint received a payment check # **** in the amount of $36.90 for the cost of the Buffalo **** ***** Knife. Enclosed, is a copy of the payment check received. Please note that ******* ** *******, ******** ** ********, and ****** ** ******* are listed as account holders. The check bears the signature of ******** ********. Please also note that on the payment check, only **. ********s address is listed. *** ********' address is not listed on the check, and she did not provide her address. When American Mint receives an order form and/or payment from an individual different from whom the order form was addressed to, American Mint opens an account in the payor's name. Here, American Mint's keyer inadvertently opened an account under the name "******** *******" rather than "******** ********" at *** *******'s address. American Mint will change the name on the account to ******** ********, so that a refund check may be issued in her name. 

      As offered to the public, an initial order in the collection entitles all orderers to receive future issues in the collection. Specifically, as clearly printed on the form, "By returning this form, you will have the privilege of receiving future issues in the collection through our FREE in-home approval service. No further action is required on your part. If you do not wish to preview future issues in the collection, please x-out this paragraph." *** ******** did not x-out this paragraph. 

      Moreover, in its "Satisfaction Guarantee" American Mint informs each orderer that they have the right to refuse receipt of future issues. Pursuant to the terms of the public offer, *** ******** had ninety days to preview the Wild **** ****** ***** Knife for free. She also had the right to cancel the authorized future service at anytime by contacting American Mint at its toll-free number. 

      On August 8, 2022, *** ******** called American Mint and requested a postage paid, self-addressed mailing label to return all her merchandise. At that time, *** ******** was advised of the then remaining balance due for the Wild **** ****** Knife. *** ******** was advised that she was sent the Wild **** ****** Knife as an authorized future issue in her collection to preview with no additional obligation to purchase pursuant to the terms of the American Mint Satisfaction Guarantee paragraph. *** ******** was mailed a postage paid, self- addressed mailing label to use to return her merchandise. *** ******** was advised that it would take seven to ten business days to receive the prepaid label. *** ******** requested a refund in the amount of $36.90 for returning the Buffalo **** ***** Knife. *** ******** was advised that as soon as American Mint received her merchandise as returns, a refund check would be issued. *** ******** was removed from the mailing list per her request. 
      American Mint received the Buffalo **** ***** Knife and the Wild **** ****** ***** Knife as returns on September 1, 2022. American Mint promptly processed and credited the returns on September 2, 2022. On September 6, 2022, American Mint mailed *** ********/*** ******* a refund check in the amount of $36.90 for returning the Buffalo **** ***** Knife. *** ********/**. ******* are not due a refund for returning the Wild **** ****** ***** Knife as they never paid for this item. By returning the Wild **** ****** ***** Knife, *** ********/*** ******* cleared the balance due for that item. 
      In response to several subsequent telephonic inquiries from *** ********, she was advised by customer service that her refund check was mailed out on September 6, 2022 and to allow additional time to receive it. 
      On October 19, 2022, per *** ********' request, a supervisor called and spoke to her regarding her above-mentioned account. The supervisor advised *** ******** that her refund check was sent on September 6, 2022. *** ******** requested that her refund check be cancelled and that a new refund check be issued. The supervisor advised *** ******** that it was too soon to cancel the refund check and reissue a new one and she advised to allow up to ninety days to receive the refund check. 
      To resolve this complaint, American Mint has cancelled the refund check sent to *** ********/*** ******* on September 6, 2022. American Mint will reissue *** ******** a refund check in the amount of $36.90 for returning the Buffalo **** ***** Knife. The check will be made out to ******** ********. This time, American Mint will send the refund check via overnight *** ** mail, signature required. 
      Please have *** ******** confirm if American Mint should send the refund check directly to *** ******** at her address listed on the instant complaint or if the refund check should be sent to *** ******* at his address. Whoever receives the refund check will need to sign for its delivery. Thank you for your assistance in settling this matter.

      I am writing in reference to *** ********' rebuttal. As explained in my initial response, American Mint's policy is to open an account in the name of the payor. American Mint received a check listing *** ******** and *** ******* as co-account-holders and which was signed by *** ********. American Mint inadvertently opened the account under the name "******** *******." American Mint has offered to remedy this situation by issuing a refund to either *** ******** or to *** *******. Per *** ********' request in her rebuttal, American Mint will send a refund check made out to ******* ******* at his address. The check will be sent via ***** two- day shipping. I have enclosed the ***** tracking number for the refund check. It is expected to be delivered to *** *******'s address by Thursday, November 3, 2022 before 8:00 p.m. 

      American Mint did previously send a refund check issued to "******** *******." American Mint cancelled the refund check issued in the name of "******** *******." If *** ******* does receive the refund check issued to "******** *******," he should discard it. American Mint denies *** ********' allegation that it targets the elderly. American Mint has no record of *** *******'s age.

      I placed an order on line from American Mint on August 26, 2022. Order #***** for amount $95.59. for 2 Presidential gold coins. I was charged for the order. As of 9-19-22 I have not received my item. I have contacted customer service on 8-30-22 for a tracking number. On 9-6-22, 9-8-22-and 9-12-22. I have placed several emails with no responds to the order. I called ###-###-#### and spoke to customer service. I explained that the tracking number that I finally received shows no package delivered to the USPS Carol Stream, IL location. As of today there has been no movement on the order. Customer Service told me she could not reimburse me since I placed the order even though USPS shows no parcel or scan. This is very bad business practice and stealing. I wish to have a refund for the order I have not received. American Mint will not help me. Tracking # *** *** *** *** **** **** ****** via USPS. ****** ***** was the original shipper which was to be delivered to USPS. Please can you assist me in getting my refund. Please.

      I am writing in reference to *** ******'s complaint. *** ****** alleges that she placed an online order for two presidential gold coins, but as of September 19, 2022, she had not received her item. She further alleges that customer service told her that she could not be refunded for the item although the tracking number for her package showed no movement. American Mint denies these allegations. 

      Contrary to *** ******'s allegations, she placed an online order on August 25, 2022 for one (1) MAGA commemorative coin. As advertised, this item is a gold-layered coin. Enclosed, is a sample internet order form similar to the one that *** ****** voluntarily completed and submitted to American Mint. On August 30, 2022, American Mint instructed its distributor to ship one (1) MAGA commemorative coin. 

      Also enclosed, please find a copy of the United States Postal Service ("USPS") tracking data for *** ******'s package. The last entry on the USPS tracking data was on September 2, 2022. American Mint's shipping partner still had the package in its possession as of September 2, 2022 at its Carol Stream, IL facility. American Mint's shipping partner never handed over possession of the package to the USPS to complete the package's delivery. The package was likely lost in transit sometime after September 2, 2022. 

      *** ****** sent several e-mails to American Mint customer service regarding the status of her order. Specifically, she sent e-mails on September 1, 2022, September 9, 2022, September 13, 2022, September 19, 2022 and September 22, 2022. Customer service attempted to respond to the e-mail address *** ****** provided on file, but each time, the e-mails came back as undeliverable due to some issue with *** ******'s e-mail. Therefore, a customer service representative called *** ****** on September 1, 2022 and left a voicemail indicating that her order had been shipped. On September 13 and 14, *** ****** spoke to customer service by phone and was provided the same information she requested by e-mail. On September 22, 2022, a customer service representative mailed *** ****** a post loss form wherein *** ****** could have indicated whether she wanted a refund or replacement sent to her. American Mint did not receive *** ******'s completed post loss form. 

      On September 13, 2022, *** ****** called American Mint to check the status of her above-mentioned order. A customer service representative advised *** ****** that her above- mentioned order was shipped out on August 30, 2022 and that it would arrive by USPS. She was provided with her USPS tracking number. 

      On September 14, 2022, *** ****** called American Mint again regarding the status of her above-mentioned order. *** ****** stated that she placed an order with American Mint around August 25, 2022. She confirmed that she had the USPS tracking number previously provided to her by American Mint customer service. She stated that there was no movement on the package since September 2, 2022. She asked if the package was lost. *** ****** stated that she paid for something of value and that she either wanted a refund back to her credit card or she wanted a replacement. 

      The customer service representative advised *** ****** that she placed an order for one MAGA commemorative coin and that the item was shipped on August 30, 2022. At the time of *** ******'s call, it had just been about two weeks since the package was shipped. *** ****** was advised that her package was still in transit and to allow a little more time for the package to be delivered. *** ****** was advised that if she still did not receive the package thirty days after its shipment, the package would be considered lost. *** ****** was advised that she could then receive a refund for the item. 

      American Mint processed the MAGA commemorative coin as a post loss on September 23, 2022. On September 23, 2022, American Mint issued *** ****** a full credit card refund in the amount of $95.59 for the MAGA commemorative coin. *** ****** should allow up to 3-5 business days for the credit to show on her credit card statement. She did not remit the sales tax due for the item. On August 26, 2022, American Mint wrote off the sales tax due for the item as a goodwill gesture. 
      *** ******* never paid for nor returned the ****** ***** - Business commemorative coin. Upon receipt of *** *******'s correspondence letter on August 26, 2022 wherein she alleged that she did not receive the ****** ***** - Business commemorative coin, American Mint had the ****** ***** - Business commemorative coin processed as a missing item. *** *******'s account balance was cleared on August 29, 2022 and she has had no account balance since that time. The invoice *** ******* attached to her complaint is dated August 29, 2022. This invoice was generated and mailed out prior to *** *******'s account balance being cleared. *** ******* has no account balance.       I am writing in reference to *** *******'s complaint. *** ******* has been an American Mint customer since 2017. During the period from May 3, 2017 until March 2, 2022, *** ******* placed forty-two orders for different introductory items and three complete sets. Pursuant to the terms of the public offers clearly printed on the order forms which *** ******* voluntarily marked up and returned to American Mint, he was shipped nine (9) authorized future issues in his collections to preview with no additional obligation to purchase. 

      *** ******* was clearly aware of American Mint's return policies and procedures as he returned nearly all the authorized future issues within American Mint's return period. American Mint had sent *** ******* several postage paid, self-addressed mailing labels to use to return any unwanted merchandise. *** ******* continued to voluntarily place new orders with American Mint and timely remit payments. 

      In his complaint, *** ******* alleges that over the past five years he made purchases with American Mint totaling about $5,000.00 in coins and coin collections. American Mint denies this allegation. Contrary to *** *******'s allegation, he made purchases with American Mint from 5/3/17 - 3/2/22 totaling $1,361.45. *** ******* appears to have purchased additional coins from other companies who are not affiliated with American Mint. For these purchases, he will need to follow up with those respective companies. 

      *** ******* alleges that American Mint made representations in its advertisements as to the value of the coins and coin collections he purchased. He further alleges that he took all the coins he purchased to a coin dealer on July 26, 2022 and was informed that the coins were "worthless fakes." American Mint denies these allegations. 

      American Mint never makes any representations as to the current or future value of the coins and other collectibles it sells. Furthermore, American Mint does not sell any coins or other collectibles for investment purposes. This is so because the value of solid gold and silver, for example, fluctuates depending on market conditions. American Mint's advertisements only state the price of the merchandise for sale. 

      Furthermore, all American Mint's advertisements clearly represented that the items offered for sale were either gold-layered or silver-plated replica or commemorative coins. The replica coins that *** ******* purchased were never advertised as actual legal tender coins. Most of the coins that *** ******* purchased were either gold-layered or silver-plated commemorative or replica coins. *** ******* only purchased two solid 14k gold legal tender coins and they were advertised as such. *** ******* also purchased three solid 14k gold coins that are non-legal tender coins. These coins were advertised as such. *** ******* purchased three .999 pure gold coins that are non-legal tender coins. They were advertised as such. In all cases, *** ******* received exactly what was advertised at the advertised prices. 

      The coin shop that *** ******* took his coins to is only interested in making a profit. Therefore, they will only offer the lowest possible prices based on the meltdown price of gold, silver, copper, etc. 

      American Mint sells high-quality merchandise. The values of American Mint's coins are determined by several factors including the rarity and design of the specific coins as well as their circulation. *** *******, in placing multiple mail orders with American Mint, was aware in each case of what items he purchased as well as their purchase prices. In each case, he voluntarily chose to place his orders by returning his properly completed order forms and payments. 

      If *** ******* was not satisfied with any of his purchases, he could have contacted American Mint within its return period for a postage paid, self-addressed mailing label to return any of his merchandise for a full refund. *** ******* understood American Mint's return policy and procedures as he previously utilized American Mint's prepaid labels to return merchandise throughout the entire time he made purchases. 

      It is the policy of American Mint to accept returns of merchandise following 90 days from its date of purchase for a full credit, replacement or refund. Here, *** ******* wants to return all merchandise purchased going as far back as May 3, 2017 for a full refund. American Mint previously accepted and credited all of *** *******'s returns that he timely sent back in 2017. More recently, American Mint accepted and credited *** *******'s timely returns from 2022. However, American Mint cannot now accept additional returns of merchandise from 2017, 2018 and 2021 due to the significant amount of time that has elapsed since the date of purchase. 

      To resolve this matter, American Mint will make a onetime exception and permit *** ******* to return all merchandise purchased from American Mint from January 1, 2022 until 
      the present. American Mint has enclosed a copy of a detailed account statement showing all merchandise *** ******* purchased from American Mint in 2022. 

      *** ******* should only return merchandise he purchased from American Mint from January 1, 2022 to the present. Any merchandise returned that is outside of this timeframe, or any merchandise returned that *** ******* did not purchase from American Mint, will be returned to him. *** ******* will receive full refunds for merchandise returned from 2022 which he previously paid for. *** ******* does not have an account balance with American Mint. 

      American Mint will mail *** ******* via *** ** overnight mail a postage paid, self- addressed *** ** return label that he may use to return the merchandise listed on the attached statement of account. *** ******* will need to sign for the mail. *** ******* should include his name and account number with his returns.

Pursuant to the terms of the public offers clearly printed on the order forms which *** ******* voluntarily marked up and returned to American Mint, he was sent two (2) authorized future issues in his collections to preview with no additional obligation to purchase. *** ******* alleges that he purchased a ****** ***** commemorative coin from American Mint in 2021. He further alleges that when he made the purchase, he was offered two additional coins that he did not accept. He alleges that he recently received a letter from American Mint that stated he was recently placed into collections for not paying for the two additional coins. *** ******* alleges that he did not receive the two coins and does not have the coins in his possession. 
      American Mint denies these allegations. Contrary to *** *******'s allegations, he was not sent unordered merchandise. *** *******'s order forms, which he voluntarily marked up and returned to American Mint demonstrate that he placed introductory orders for three items. The order forms clearly expressed that he would also receive authorized future issues in his collections to preview with no additional obligation to purchase and that he could return unwanted items at American Mint's expense within ninety days for a full credit or refund. American Mint did not receive the two authorized future issues as returns nor payment for those items, but as explained in more detail below, American Mint processed both items as missing items on July 28, 2022 and cleared the balances due for those two items. 
      Although *** ******* does not mention this in his complaint, he still has a remaining account balance of $241.62 for the Complete Collection of U.S. Presidents coin set. Enclosed, is a detailed statement of account showing *** *******'s remaining balance of $241.62 due for the Complete Collection of U.S. Presidents coin set. *** ******* will continue to receive monthly invoices for the Complete Collection of U.S. Presidents coin set until he either returns or pays for the item. His account has not yet been referred to collections. In order to clear *** *******'s account balance, he will either need to pay $241.62 or return the Complete Collection of U.S. Presidents coin set using a prepaid *** ** label. American Mint will mail *** ******* via *** ** overnight mail a postage paid, self-addressed *** ** return label so that he may use it to return the Complete Collection of U.S. Presidents coin set. *** ******* will need to sign for the mail. *** ******* should include his name and customer number with his returns. 
      The relevant facts are as follows. We received an introductory order forms in the mail from *** ******* on July 11, 2021 for an ******* ******* commemorative coin and a ********'s Valley Campaign commemorative coin. These items are part of the Northern Leaders of the Civil War Collection and the Sesquicentennial American Civil War Collection respectively. We received a credit card payment of $53.77 (the ******* coin was $29.95 and the ********'s Valley Campaign coin was $19.95 plus sales tax). Enclosed for your review are copies of the order forms voluntarily marked up by *** ******* and returned to American Mint. 
      As offered to the public, an initial order in the collection entitles all orderers to receive future issues in the collection. Specifically, as clearly printed on the form, "By returning this form, you will have the privilege of receiving future issues in the collection through our FREE in-home approval service." 
      Moreover, in its "Satisfaction Guarantee" American Mint informs each orderer that they have the right to refuse receipt of future issues. American Mint explains: "You will be billed only for the items you decide to keep, plus applicable shipping and sales tax. If you pay by credit card, future shipments will not be charged until 25 days after the invoice date. If you are not satisfied with any item that is shipped to you, you may send it back within 90 days at our cost for replacement, credit or refund." Moreover, American Mint points out to each orderer that, "[y]ou can cancel this service at any time by calling toll-free 1-877-807-MINT.” 
      On July 14, 2021, American Mint instructed its distributor to ship one (1) ******* ******* commemorative coin, one (1) ********'s Valley Campaign commemorative coin and one (1) ****'s Tennessee Campaign commemorative coin as an authorized future issue in the Sesquicentennial American Civil War Collection with no additional obligation to purchase. Pursuant to the terms of the public offer, *** ******* had ninety days to preview the ****'s Tennessee Campaign commemorative coin for free. He also had the right to cancel the authorized future service at any time by contacting American Mint at its toll-free number. 
      American Mint did not receive the ****'s Tennessee Campaign commemorative coin as a return nor payment for that item. Therefore, *** ******* continued to receive monthly invoices. 
      On July 22, 2021, American Mint received an introductory order form in the mail from *** ******* for a ****** ***** commemorative coin. This item is part of the U.S. Presidents Crystal Inlay Collection. American Mint received a credit card payment of $26.83 (the coin was $19.95 with $4.95 shipping plus sales tax). Enclosed for your review is a copy of the order form voluntarily marked up by *** ******* and returned to American Mint. That order form expresses the same terms and conditions as the order form discussed in detail above. 
      On July 23, 2021, American Mint instructed its distributor to ship a ****** ***** commemorative coin along with one (1) ****** ********** commemorative coin as an authorized future issue in the collection to preview with no additional obligation to purchase. Pursuant to the terms of the public offer, *** ******* had ninety days to preview the ****** ********** commemorative coin for free. He also had the right to cancel the authorized future service at any time by contacting American Mint at its toll-free number. 
      American Mint did not receive the ****** ********** commemorative coin as a return nor payment for that item. Therefore, *** ******* continued to receive monthly invoices. 
      On August 4, 2021, American Mint received an introductory order form in the mail from *** ******* for a U.S. Presidents Complete Set of coins. Enclosed is a copy of *** *******'s order form. As *** *******'s order form demonstrates, he chose to make four monthly installment payments via his credit card. At the time when *** ******* placed his order form the complete set of coins, the item was on backorder. 
      On September 20, 2021, after the U.S. Presidents Complete Set of coins became in stock again, American Mint charged *** *******'s credit card in the amount of $80.55 as the first installment payment for the U.S. Presidents Complete Set of coins. On that same date, American Mint instructed its distributor to ship a U.S. Presidents Complete Set of coins. 
      American Mint never received the U.S. Presidents Complete Set of coins as a return nor did it receive any further installment payments toward the item. Therefore, *** ******* continues to receive monthly invoices. 
      On July 28, 2022, American Mint processed the ****'s Tennessee Campaign commemorative coin and the ****** ********** commemorative coin as missing items and cleared the balances due for those items. 
      In conclusion, American Mint shipped *** ******* merchandise in compliance with the terms clearly printed on his order forms. *** ******* never returned nor paid for the ****'s Tennessee Campaign commemorative and the ****** ********** commemorative coin. *** ******* alleged that he did not receive the ****'s Tennessee Campaign commemorative coin and the ****** ********** commemorative coin. American Mint processed the ****'s 
      Tennessee Campaign commemorative coin and the ****** ********** commemorative coin as missing items on July 28, 2022 and cleared the balances due for those items. 
      As explained above, *** ******* still has a remaining account balance due for the U.S. Presidents Complete Set of coins. *** ******* will either need to pay $241.62 or return the U.S. Presidents Complete Set of coins using a prepaid *** ** label. American Mint will mail *** ******* via *** ** overnight mail the prepaid *** ** label which he may use to return the U.S. Presidents Complete Set of coins. *** ******* will need to sign for his mail. *** ******* should include his name and account number with his return.

      I am writing in reference to *** ********'s complaint. After a reasonable search of our records, American Mint located one existing customer who provided *** ********'s address as his own. His name is ****** ******. After a reasonable search of online records, American Mint believes that *** ****** resides at *** ********'s address and is a relative of *** ********. American Mint has enclosed a copy the order form and online address information which shows that *** ****** lives with *** ********. As is discussed in more detail below, American Mint received an introductory order form in the mail that was signed by both ****** ****** and ***** ********. This response will therefore address the allegations *** ******** raises in her complaint concerning *** ******'s account with American Mint. 

      American Mint received an introductory order form in the mail from *** ****** and *** ******** on April 22, 2022 for a 1933 ******* Double Eagle replica coin. This item is part of the Historical Gold Eagle Reverse Proof Collection. We received a credit card payment of $18.31 (the coin was $9.95 with $6.95 shipping plus sales tax). Enclosed for your review is a copy of this order form. Please note that both ****** ****** and ***** ******** signed the order form. Furthermore, either *** ****** or *** ******** handwrote on the order form the **** credit card number ending in ****. American Mint believes that this credit card belongs to *** ********. American Mint also believes that the phone number handwritten on the order form belongs to *** ******** as well. American Mint has enclosed online information showing that the telephone number handwritten on the order form belongs to *** ********. This order was keyed under ****** ******'s name and account.

      As offered to the public, an initial order in the collection entitles all orderers to receive future issues in the collection. Specifically, as clearly printed on the form, "By returning this form, you will have the privilege of receiving future issues in the collection through our FREE in-home approval service. No further action is required on your part. If you do not wish to preview future issues in the collection, please x-out this paragraph." *** ****** and *** ******** did not x-out this paragraph. 

      Moreover, in its "Satisfaction Guarantee" American Mint informs each orderer that they have the right to refuse receipt of future issues. American Mint explains: "You will be billed at the regular price for the items you decide to keep, plus applicable shipping and sales tax. Shipments arrive about once a month. You are under no obligation! If you are not satisfied with any item that is shipped to you, you may send it back within 90 days at our cost for replacement, credit or refund." Moreover, American Mint points out to each orderer that, "[y]ou can cancel this service at any time by calling toll-free 1-877-807-MINT." 

      On May 3, 2022, American Mint instructed its distributor to ship a 1933 ******* Double Eagle replica coin along with one (1) 1861 Paquet Double Eagle replica coin as an authorized future issue in the collection to preview with no additional obligation to purchase. Pursuant to the terms of the public offer, *** ****** and *** ******** had ninety days to preview the 1861 ****** Double Eagle replica coin for free. They also had the right to cancel the authorized future service at anytime by contacting American Mint at its toll-free number. 

      American Mint did not receive the 1861 ****** Double Eagle replica coin as a return nor payment for that item. Therefore, *** ****** continued to receive monthly invoices. On July 8, 2022, in compliance with the terms of the order form, American Mint charged the credit card provided on the order form in the amount of $86.65 for the 1861 ****** Double Eagle replica coin. 

      On July 11, 2022, American Mint instructed its distributor to ship the next item in the Historical Gold Eagle Reverse Collection, the 1797 Turban Head Eagle replica coin, as an authorized future issue in the collection to preview with no additional obligation to purchase. 

      *** ****** and *** ******** have never contacted American Mint, until July 13, 2022 when American Mint customer service received an e-mail from ****** ****** that contained a message from ***** ********. Enclosed, is a copy of this e-mail. In her July 13, 2022 e-mail, *** ******** made similar allegations to those she made in her complaint. *** ******** alleges in her complaint that American Mint keeps charging her debit card although she does not have nor ever has had an account with American Mint. American Mint denies these allegations. 

      As described above, American Mint received the enclosed order form which appears to be signed by two different people (both *** ****** and *** ********). Either *** ****** or *** ******** handwrote her **** credit card number on the order form. If *** ****** provided *** ********'s credit card number on the order form and signed *** ********'s name without her knowledge and consent, then *** ******** should contact her local law enforcement authorities. 

      American Mint had no reason to believe that someone other than *** ******** signed her name on the properly completed order form it received in the mail along with the credit card payment. American Mint also had no reason to believe that *** ******** did not authorize her credit card number to charged since it was handwritten on the order form as the payment method. 

      To resolve this complaint, American Mint has placed a payment halt on the account. *** ********'s credit card will not be charged for the 1797 Turban Head Eagle replica coin. Although *** ****** never paid for nor returned the 1797 Turban Head Eagle replica coin, American Mint made a onetime exception and wrote off the $94.18 balance due for that item. *** ****** and *** ******** never returned nor paid for the 1933 ******* Double Eagle replica coin and the 1861 ****** Double Eagle replica coin. American Mint made a onetime exception and wrote off the remaining balances due for these items. Enclosed is an account cleared letter. 

      American Mint has issued the **** credit card ending in **** two credit card refunds. On July 12, 2022, a credit card refund of $18.31 was issued for the 1933 ******* Double Eagle replica coin and an additional credit card refund of $86.65 was issued for the 1861 ****** Double Eagle replica coin. The cardholder of the **** credit card ending in **** should allow up to 6-12 business days for the payment to show on its account. American Mint has closed out *** ******'s account. 

      On July 13, 2022, American Mint customer service received an e-mail from ****** ******'s e-mail address with a message from ***** ********. Enclosed is a copy of this e-mail. The e-mail is written by ***** ********. She provided one of her telephone numbers. Like her complaint, she alleged that her credit card keeps being charged, but she does not have an account with American Mint and that she does not collect coins. American Mint denies these allegations. As explained above, and as this e-mail further demonstrates, *** ****** and *** ******** are related. One or both of them signed the enclosed order form and remitted payment by handwriting *** ********'s credit card number as the payment method. American Mint had no reason to believe anything was amiss with the order, and upon receipt of the properly completed order form and full payment, American Mint shipped *** ****** merchandise in compliance with the terms clearly printed on the order form. *** ******'s account balance is cleared, and *** ********'s credit card was fully refunded on July 12, 2022.       American Mint has sent me multiple products, commemorative coins, that I did not order and sends threatening letters that insist on payment. The amount of money they demand changes from letter to letter. They threaten collection action.

      I am writing in reference to *** *******'s complaint. *** ******* placed an online order for an introductory item in the America's Greatest Battles Collection. Pursuant to the terms of the public offer clearly stated on the website, American Mint shipped *** ******* one (1) Battle of Midway commemorative coin as an authorized future issue in the collection to preview with no additional obligation to purchase. *** ******* alleges that he was sent multiple commemorative coins that he did not order and threatening dunning letters. American Mint denies these allegations. *** ******* was sent one (1) introductory item and one (1) authorized future issue for free preview. *** *******'s order form, which he voluntarily completed and submitted to American Mint, clearly expressed that he would receive authorized future issues in his collection to preview with no additional obligation to purchase and that he could return unwanted items at American Mint's expense within ninety days for a full credit or refund. *** ******* was sent no additional merchandise. Upon expiration of the free preview period, American Mint began to bill *** ******* for the authorized future issue in compliance with the terms of the order form. To resolve this complaint, American Mint made a onetime exception and wrote off the remaining balance due for the Battle of Midway commemorative coin on July 6, 2022. 

      The relevant facts are as follows. We received an online order from *** ******* on September 4, 2021 for a D-Day commemorative coin. This item is part of the America's Greatest Battles Collection. We received a credit card payment of $30.44 (the coin was $19.95 with $6.95 shipping plus sales tax). Enclosed for your review is a sample copy of the online order form similar to the one that *** ******* voluntarily completed and submitted to American Mint. 

      As offered to the public, an initial order in the collection entitles all orderers to receive future issues in the collection. Specifically, as clearly stated on the website, "By ordering a product at the discounted price, you will have the privilege of receiving future issues in the collection through our FREE in-home approval service. No further action is required on your part. If you do not wish to preview future issues in the collection, please select the Individual Item Only tab above." *** ******* did not select the Individual Item Only tab. 

      Moreover, in its "Satisfaction Guarantee" American Mint informs each orderer that they have the right to refuse receipt of future issues. American Mint explains: "You will be billed only for the items you decide to keep. You are under no obligation! If you are not satisfied with any item that is shipped to you, you may send it back within 90 days at our cost for replacement, credit or refund." Moreover, American Mint points out to each orderer that, "[y]ou can cancel this service at any time by calling toll-free 1-877-807-MINT." 

      On September 8, 2021, American Mint instructed its distributor to ship a D-Day commemorative coin. 

      On September 27, 2021, American Mint instructed its distributor to ship the next item in the America's Greatest Battles Collection, the Battle of Midway commemorative coin, as an authorized future issue in the collection to preview with no additional obligation to purchase. Pursuant to the terms of the public offer, *** ******* had ninety days to preview the Battle of Midway commemorative coin for free. He also had the right to cancel the authorized future service at any time by contacting American Mint at its toll-free number. 

      American Mint did not receive the Battle of Midway commemorative coin as a return nor payment for that item. Therefore, *** ******* continued to receive monthly invoices and acquired late fees. American Mint had no contact with *** *******. 

      In conclusion, *** ******* placed an order for an introductory item in the America's Greatest Battles Collection. Pursuant to the terms of the public offer clearly printed on the order form which *** ******* voluntarily completed and submitted to American Mint, he was sent one (1) Battle of Midway commemorative coin as an authorized future issue in the collection to preview with no additional obligation to purchase. To resolve this complaint, American Mint made a onetime exception and wrote off the remaining balance due for the Battle of Midway commemorative coin. Enclosed is an account cleared letter. American Mint removed *** ******* from its mailing list on July 6, 2022. Since American Mint's ads are preprinted, please allow up to 90 days for all advertisements to completely cease for advertisements already printed. I trust this resolves the complaint. Please let me know if you need anything further. Thank you for your assistance in settling this matter.
