Additional Information for Wesley Financial Group, LLC

BBB has been made aware that on 8/8/2023, the United States District Court for the Middle District of Tennessee, Nashville Division granted in part and denied in part a motion for Partial Summary Judgment by Westgate Resorts (Doc. No. 263) in Case No. 3:20-cv-00599 in the matter of Westgate Resorts, LTD., et al., v. Wesley Financial Group, LLC (WFG), and Charles William Mcdowell, III.  This is a civil case and not a government action. Among the Court's findings were that:

WFG “engaged, and apparently continues to engage, in the unauthorized practice of law, and the manner in which it does so constitutes a deceptive practice in violation of the [Tennessee Consumer Protection Act (TCPA)], insofar as it has led and tends to lead its customers—and Westgate’s owners—to believe that Wesley’s system for canceling timeshares is based on some legitimate legal grounds”

WFG's "false offering of credit repair services as part of the package of services it provided to its customers, along with its purported cancellation of the customers' timeshares violated the TCPA" .

The Court denied Westgate's motion for a preliminary injunction pending trial.
