I went to the dealership and signed all of the paperwork. The paperwork was NEVER issued to me even after I had asked my salesman (Adonis) for it more than twice. They told me they needed to keep my car because there was a "kiss" on the front right-side bumper. They said they had to put tint on it as well that it would be ready to go within a week or so. They hounded me to get my check stubs to them after leisurely stating that they just needed them for their records, as i had already shown them my bank deposit via mobile app. Over a week had passed and they said they were not finished repairing the car. Cool. Over two or three weeks passed and the finance manager said that I just needed to call the loan financer to verify my phone number and then they "should" be able to release the car. Still weeks went by and then I got another call from someone else at the dealership (I think ****) and that is when I was told that they were having an issue with the car - they were still waiting on the title. After a month passed and not getting any returned phone calls, I finally went to the dealership and spoke with **** in person (they had issued me two "loaner cars" by this point). He told me, everything was fine, that the car was out front and that the title was coming from out of state so it would be here by THE END OF THE ****** It has now been a total of two months and I do not have my car and no one has called me. I called and spoke with ****** *** on July 231, 2024 only for him to tell me he was going to speak with **** and call me "right back". He never did.

We sold South Austin Nissan in April this year.  This is the second request from this customer.  We did not have a customer by this name prior to the sale.  This is a customer of the new ownership "City Limits Nissan".

On Jan 13 I purchased (via trade and financing) a used 2021 ****** Forester from South Austin Nissan. I was given temporary tags, and was told that the permanent plates would arrive within 4-6 weeks. The temporary tags were good until the end of March. In the middle of March, I contacted South Austin Nissan to see about my plates and registration, and was told they had not come in yet. In a follow up call after that, I was told that the entire registration and title application had to be redone, because of an error, and that I would be emailed a new temporary tag. When I did not receive that, I called today - April 30 - and was told that the business had been sold, and that I should contact an accounting department that was handling everything about the old business. I was transferred to a number that seems to be a North Austin Audi dealership and there was no one to talk to there. I called South Austin Nissan back and was given a direct number to call for the accounting department for the previous business (which seems to merely be leasing space from the Audi dealership). I called that number and got a recording telling me to email an address, *************************** with my enquiry about a title. At this point I am paying a finance company for a car I may or may not have registered in my name. I am livid and feel like I have been duped. I was NOT ONCE informed that the company who owes me plates and registration was selling their business. They made ZERO arrangements for their prior customers like me. This business is beyond shady. I expect far more from an actual Nissan dealership. If I don't receive my registration sticker and plates soon, I will be seeking legal action, as they have reneged on their signed contract.

I'm doing this on behalf of my elderly mother. Her lease was up on her car and we were going to just buy out the remaining part. We called Nissan Motor Finance and they gave us the pay off of $22,657 and said to go there to get help with financing or send in that amount to them. So we told the dealership we contacted Nissan and they said to come in to get help with financing. They kept trying to get her to buy a new car but her car had 4k miles on it and we didn't want anything new. I was trying to keep my mom from going to that place because we had already gone once and they were pouring on the lies so I made up an excuse to get us out of there. The sales lady finally sends me a text saying that her paperwork is ready and I couldn't go at the time so my mom decided to go ahead and go without me which I just knew was a mistake but I was thinking that the paperwork is ready and so all she needs to do is sign and say no to any warranty or other products they try to get her to buy. A few hours pass and I don't hear from her so I was thinking everything was fine. Her apt was at 10:00 but I get a text from her around 12:30 saying she is still there that they are doing an inspection and that the paperwork wasn't ready. Basically they saw that she came in along and knew they could take advantage of her. So the complaint is they charged her $24,268.20 for the car instead of the $22,657 Nissan said we owed and on top of that, while they were doing the "inspection", they installed this *** system WITHOUT HER APPROVAL, charge her $4k for it, and then when she asked what it was and to take it off, they told her "it's too late". Yeah it's too late because they installed it already!!! So at this point, she is scared and she just wants to get out of there so she signs the paperwork and leaves. I found out just the other day what happened and I was furious. She has to go back now so they can "uninstall" the *** but no idea what they will refund her.

We have spoken with the customer and initiated a full cancellation refund of the *************** Contract. The vehicle was certified through Nissan Manufacturer guidelines at a cost of $1695.00 / This amount can not be refunded to the customer since it was a complete 164 points of physical inspection of the vehicle performed by a Nissan Certified technician. The customer seemed satisfied with what we have done, but unfortunately ******************** ( her son ) does not. He feels we should void the entire transaction and start over. That unfortunately can not be done. We have now ( as of 4/29/2024 ) sold the dealership and are no longer licensed for this location.

I am rejecting this response because:

The problem with the inspection is they lied about it  When my mom asked where her car was, they told her that it was getting the State inspection done. She never asked for the car to be certified because it has 4K miles on it and we werent worried about adding the certification. They looked at it as a way to make an extra $1700. So when they returned with the car, not only did they lie about the State inspection, they had also put this GPS system in all before asking to do any of it. I do agree that they refunded the amount for the system but the contracted amount is still too high because all the company will do is send that amount to the bank and take it off the back end. But what they wont tell you is that raised her note probably almost $80 a month and now the only way to fix it would be for us to go through the hassle of refinancing it. Someone has to stand up to these shady dealers so they will stop taking advantage of people. So until the refund the $1700 for a certification we didnt ask for or even told was happening, and redo her contract with a lower note and interest rate, this complaint will continue. And they can hide behind the fact that they sold the dealership the next day but this transaction happened on their watch so they are responsible to fix it:

I had service done at South Austin Nissan for a noise on my 2012 Rouge. After paying $830.05 for the repair of a left front wheel bearing. They requested additional diagnostic to take my car on an extended test drive and I declined. Surprisingly the mileage in and out were exactly the same so I felt like they wanted to charge me just to drive my car. When I picked up the car I found the noise was still there. I scheduled a follow up to bring the vehicle in and told the advisor and service manager the vehicle was not driven before or after the repair was done because the paperwork shows the mileage in and out as the same. I feel that they may have just guessed what was wrong with the car. The told me they made a paperwork error and it never happens. They went on to diagnose the vehicle again and found that the right wheel bearing was bad. The advisor told me the right bearing was probably bad too the first visit and when I asked him why they didnt mention this before he had no answer. I asked why the mileage was wrong he said it was a mistake, simply an error. I asked for help on the cost of the second repair after being told it would be an additional $1100. I offered to pay for parts if they cover the labor. They said absolutely not. When I asked why the price was more this time I was told parts will probably break while doing the job so the extra costs are for those parts. I asked them if they test drove the vehicle and they confirmed that their veteran tech did. Since I didnt have the money I picked my car up. When I went to check the second invoice, again the mileage on the repair order was the same as the mileage I brought it in at. So again they lied and told me they test drove it but they didnt now I have all these additional items that could be a issue along with my bearing. It seems like they are just guessing until they get it right. I am requesting a refund because the car was not driven either time I brought it in and they just keep adding charges.

Customer came in on 6/8/23, driving **** when at hwy speeds or speeding up. Diagnosed vehicle, found front wheel bearing on driver side to be failed causing customer's concern. After we replaced wheel bearing, we recommended to customer that we take on an extended test drive, more than usual, to further test customers concern, in case we hear other noises. Customer declined the extended test drive. Customer came back 8/9/23 for same concern. I took a called a few days prior to that for a gentleman that is a fixed operations director in the ******* area, he stated he was friends with the customer. I told him to have his friend bring vehicle back in so we can diagnose problem. This time we found the right-side front wheel bearing failed. WE quoted customer to replace the wheel bearing on the front passenger side, wheel speed sensor and the labor to install. The quote is higher due to the speed sensor needing replacing as well. The speed sensor is completely rusted and will break when performing the job.

We made an error on our part by not putting the correct out miles on the repair order.

The customer asked if we could cover the labor is she pays for part, we declined that offer from customer. We did not get to do an extra test after initial repair, due to customer declining the drive.

As a consumer I feel that the documents given to the customer should be accurate. When I brought up the fact that the car was not driven the first time I was told they made a mistake. My second invoice either has the same mistake, or my car was not driven the second time. So why do an extended test drive? Also I had another shop complete the job and they didn't break any sensors. So why did you try and charge me for a sensor? I think you all tried to take advantage of me.

      1. False Advertising 2. Illegal ************* used On 3/02/23 I called about a car advertised on South Austin Nissan, was told the car is still available then when we got there was told it was sold "but since you are here, take a look at a similar car we have". Didn't want the car. They asked us if we had a car we were trading in, they took the keys to our car and disappeared with our car. We kept telling them over & over we couldn't afford those payments or that car! They withheld OUR car key for over 6 hours! And for SIX HOURS we kept saying NO we aren't interested in their deals. We are seniors living off of SS and we don't want the car or the HIGH $632.00 a month payments! After 6 LONG hours they wore us down to the point we thought the ONLY way we were going to get OUR car keys back is to sign a contract on a car we didn't want and can't afford the payments on. Three days of being sick at our stomachs over this deal I called them to talk to the General sales manager to ask him to PLEASE give us our $2,000.00 down payment back to please cancel the contract. He has purposely continued to avoid us!They BROKE the law with the ************* tactic on us! And they lied about the car we were inquiring about in the advertisement, THAT car in the ADD was NOT sold and is STILL available according to many other employees who continue to say it's STILL on the lot waiting to be bought! This car dealership is a SCAM and avoid them at all costs! They took advantage of our ages and STOLE OUR MONEY! Now we are having repossession on our credit reports BEFORE even making the 1st payment. Because there is NO WAY we can pay TWO car payments! After taking the keys of our car and then deciding they didn't want it as a trade, they deliberately and intentionally wore us down by refusing to give us our keys back, AFTER demanding more than 3 TIMES to give us our keys so we can go home! We only got them back AFTER being forced to sign on that dotted line! Falsely detaining us, for 6

We have spoken with this customer on several occasions and informed them that we are bound by the contract just as much as they are bound. They dropped the car off in the dealerships parking lot and left the keys at the receptionist's desk. The contract was funded with the finance company and with that assignment the dealership no longer has any rights to the vehicle. We have offered to rescind the contract and unfortunately the customer would not agree to the terms to do so. The contract was signed, the down payment was given and then the customer took delivery of the car and took both of their vehicle's home. The customer even attempted to cancel their credit card transaction for the down payment stating it was a fraudulent transaction. Their financial institution contacted the dealership to verify and elected to decline their request to cancel since everything was signed and delivered. We try extremely hard to please each and every customer but unfortunately that is not always possible when buyer's remorse comes into play.

      Customer Answer

      Date: 03/23/2023

      Complaint: 19617012

I am rejecting this response because: This so called business offered to rescind the contract ONLY if we agreed to forfeit our $2,000.00 down payment. They said they can't do anything about canceling the contract because they are "bound" by it, yet how is it that they can "rescind" the contract IF we forfeit our $2,000?  That sounds like to me a double standard but for THEIR benefit ONLY!! Bottom line is that they DID use  A "Bait & Switch tactic to "Lure" us into the dealership! And they can lie to everyone they want too, but they KNOW how they did us by keeping us captive by with-holding OUR car keys from us!

They hiding behind that contract, knowing full well they use a Deceptive Trade Practice:

      BUSINESS AND COMMERCE CODE

(17.46. DECEPTIVE TRADE PRACTICES UNLAWFUL. (a) False, misleading, or deceptive acts or practices in the conduct of any trade or commerce are hereby declared unlawful and are subject to action by the consumer protection division under Sections *****, *****, *****, and ***** of this code).

By placing an add on their website about the car I called and inquired about and they telling me it had been sold once I showed up at the dealership, yet for 15 days I continued to call about that same car and each time I was told it was still available "when can I come in and see it?" I call THAT being deceptive!

Don't you find it a bit strange that they can tell you there's "Nothing" they can do about rescinding the contract, but tell ME and my husband they "CAN" rescind it but ONLY if I am willing to forfeit  (loose my hard earned money) the down payment?!

And we went back and picked the car back up because they threaten to charge us for storage fees for every day we left it there.

My husband and I are seniors living on Social Security and working part time jobs because we are struggling to make ends meet. Our current car has over ******* miles on it and not good on gas. And we went there to that dealership to work a deal on a car that was advertised fo $26,999. (price on that same car as of 03/22/2023 has now dropped to $26,595) because that's was about all we could afford. Instead we got lied too about it's availability , they took the keys to our car (for a test drive) for SIX hours (until we signed a contract) so we couldn't leave, they took every dime I could scrape up for a down payment, didn't take our car as a trade (now we have TWO car payments to worry about), then the finance company they  chose to use is now making us keep the car insurance at no more that $500.00 for a deductible making it even harder on us for a higher monthly premium, but do they care about making our life even harder? If we don't make the payments or surrender it to the finance company then it's put on our credit reports as a repo for the next **** years!! What are we suppose to do? We trusted them and they made us sign a contract on a car that costs MORE than $30,000.00!

So I do NOT accept their response to the Better Business Bureau because they are flat out lying about them not being able to give us our down payment back (which we desperately need to repair our current car with) and to cancel (or as they put it, to "rescind") the contract. It's like "oh, we're willing to rescind the contract BUT it's going to cost you $2,000.00 to it".

I call them thieves for doing what they did to us!!! And if the BBB can't do anything for us at least put my complaint and rejection response as public!!  Because I want the other people out there, ESPECIALLY the senior citizens!

It's a crime of what they did to us! And they KNOW what they did and how they scam us and all the other people who "viewed" the same add, I call those views other victims!

And IF I had the money I would hire a good attorney and *** them, but I don't. As I said earlier, this dealership TOOK every dime I scraped together to try and buy us an affordable, dependable little car. Now I have to come up with (every month) a $632.00 payment AND a $422.00 car payment, PLUS $355.00 car insurance on my $14.00, 20 hour a week job!!

And my health is getting worse now because I can't sleep at night anymore worrying about all the money I have to come up with each month (when we told them over and over we can't afford that car or the payments) and pray I don't fall asleep at the wheel everyday at work, because I drive for a living! But hey, I bet they sleep good every night.

      Regards,

Sales manager was aggressive to the point he made me cry and walk out. Not listening to me and speaking over me, even after telling him my financially situation. Sales men ****** told me the car was not ready Saturday as promised but that it would be ready the following Wednesday, i was upset and told him as a compensation if he could get me 1 yr of free oil changes, at which he agreed. Driver side door lock is not working, i requested to have the car diagnosed and they checked it and told me i would need to pay out of pocket you get the door fixed.. pre owned vehicle with under 50k miles. ***** at 49k. I didn't realize that the 2nd key that i was given was not an original key, i had taken the car in for re view on the door and that is when it was identified. ****** helped me re order another key and confirmed no fee. I scheduled an oil change and told ****** that ****** gave me a year of free oil changes. ****** is not answering my calls finally calls me and says the first oil change could be covered and he would have to look in the papee work for consideration on the 1yr free oil changes. I told him he verbally mocked me. I told him he was being very shady and i knew what he verbally told me and now he is going back on his word. No one called me to pick up my contract, i had to keep following up, when i went to pick it up asked for a paper copy the guy refused. It took some nagging but he printed the papers for me even though he was upset and I could see it on his facial expression very uncomfortable. I received a phone call from ****** saying my second replacement key is ready for pickup and it will be at the front desk I go to pick it up from the front desk and I check it out to make sure it is working and sure enough it is not working I go to the service area and the guys are looking at me weird like how can you just pick up a key I'm like I don't know that's what ****** told me but I got it. Key doesnt even work!! & no one wanted to help me in any departmen

On 10/29/2022, I was rear ended while test driving a car at South Austin Nissan (pre-owned). I was told to transfer $300 for the driver who rear ended me and then the dealership told be I needed to pay an additional $1800 for the damages to the vehicle. They called it a "down payment" if I decided to purchase a vehicle from them. I just came to ***************** and am not aware of the laws but I was told the dealership could not do that. I have reached out to Nissan Corporate and they could not help me. I was taken advantage from and cannot afford to pay the cost. It is a civil problem and the police cannot help me. there is no police report for the accident as I did not know what to do and the salesman did not assist me, he simply charged me. I do not know who to turn to for help but that was not right of Nissan South Austin.

I bought a 2016 Nissan Frontier from South Austin Nissan on 01 August 2022. As of today 17 October 2022, I have yet to receive my license plates. On 22 September I contacted the dealership to inquire about my plates as the temporary plates were to expire on *********************************************************************************************************************** No one did. I checked with Texas DMV and no paperwork had been filed with them. I called the dealership again on 29 September. Again, I got nowhere. Just promises that my problem would be addressed. On 7 October I received a call from a Nissan individual who told me that the reason for the problem was that the paperwork had been rejected by DMV because there was no vehicle inspection paperwork, something they should have done. Why wasn't I contacted when supposedly the paperwork was rejected! Anyway, they sent me another set of temporary tags and ***** paperwork to send the vehicle inspection paperwork back, which I did, and they received on 12 October. Checked with DMV today and still no paperwork has been submitted.

We are actively working on getting the registration completed for ********************. I had reached out to him in reference to an updated state inspection which he agreed to get completed closer to his residence versus coming back into the dealership. We provided him a pre-paid Fed-ex to return it to us. *********** with a 3rd party titling service to assist us with completing registrations for our customers.

I am rejecting this response because:

As I have stated before, I have returned the truck state inspection paperwork to Nissan. It was received on the 12th of October. I still don't have my vehicle registered to me. I have been told before that they were working on this issue, but they were not! I will consider this issue closed when my financial institution and I have received all the proper paperwork.

      Regards,

I am a licensed attorney in the **************, however, I am writing this as a consumer who is a victim of a. false advertising , b. DTPA statute violations in *****, and c. plainly just immoral and poor business conduct by South Austin Nissan. I have not filed a lawsuit on this matter. I found a 2020 Nissan Altima online, on South Austin Nissan's website. **** was supposed to be a gift for my college kid, and was listed on their website for $20,995. After driving the vehicle the salesman presented me the numbers which were not negotiable and stated that every vehicle included a $3299 of an *** treatment in addition to $1299 of a market adjustment. (attached) The *** treatment is a detail of the vehicle which was neither requested nor needed. There were no disclaimers mentioning either of these add on charges. Egregious conduct even for a Used car Dealer. The only disclaimers stated, "Disclaimer:New vehicle pricing includes all offers and incentives. Tax, Title and Tags and recon fees are not included in vehicle prices shown and must be paid by the purchaser. While great effort is made to ensure the accuracy of the information on this site, errors do occur so please verify information with a customer service rep. **** is easily done by calling us at ************ or by visiting us at the dealership.**With approved credit. Terms may vary. Monthly payments are only estimates derived from the vehicle price with a month term, % interest and % down payment."If they are doing this to me, knowing my profession, I can't imagine what they are doing to *** Consumer. I am trying to do my part by informing the BBB and Austin Consumers of this dealership's conduct. I don't need this company to do anything for me; I would never buy a car from them if my life depended on it. However, I would want them to add these charges to their pricing and list it on their website, so other consumers are not deceived by this false advertising. Thank you. Funk

I purchased a vehicle in April of 2022 and have been awaiting my license plates. I had to get an extension because they had expired and South Austin Nissan calls me about a week later saying they noticed they havent scheduled me in for inspection to get my plates for vehicle. July 09/2022 I had my appointment and they came out saying that my vehicle wasnt submitted through a UVI in their system (Used Vehicle Inspection) so they recommended I leave the vehicle with them so they could take care of essentially what shouldve been done before selling me an unsafe vehicle to drive. I explained to them I had no issue with that however I needed it back by the following Thursday because I was heading out of town. I have to call them for updates and leave messages because I cant get ahold of anyone for a proper update on my vehicle. They day comes for my departure and they were willing to let me drive an unsafe vehicle and bring it back the following monday again for repairs. I shouldnt have to be putting my life on hold because I no longer have a vehicle due to the fact that they failed to make a proper inspection before selling me the vehicle. Now Im stuck without a vehicle and unable to retrieve my daughter until they make the necessary adjustments for me to pass inspection. Also in sales department when purchasing my vehicle I received threats about cancelling my loan for not responding accordingly to their requests about bank information which again shouldve been taken care before selling me a vehicle. I was at work and unable to interact with my phone. They stole my **** from my previous traded vehicle and tried to tell me it wasnt intentional and they crew just left it out when cleaning the car however the car wasnt cleaned when I returned to claim my final things to move to new vehicle.

I am rejecting this response because:car inspection was not the only complaint or issue I had as far as customer service. That department was at least somewhat responsible and did inform me that my vehicle was unsafe to drive. However my experience with sales department was completely irresponsible and unprofessional.
