I owed Scott and associates because of a debt with Portfolio recovery. I paid the debt with Scott and associates in one lump sum payment. I was told that I didnt have to do anything else and Scott and associates would send confirmation to the court that I paid. Well one month later I received something from the court that I did not appear in court and I owe a judgment. I called the court and they said Scott and associates never sent them anything showing that I paid. It has been over 30 day since I paid. The lady at the courthouse said they are probably trying to get extra money out of me. I have to file an appeal and go to court so they dont try to charge me twice. This is horrible. just send the information!

Please contact Portfolio Recovery and advise them that I was given a setttlement and have paid my debt so this can be updated on my credit report. My credit report still shows a balance due and has been this way for over 30 days

New Wave Card/WEBBANK Account number ********* PETAL CARD 2/WEBBANK Account number ************ ************************************ (ARC)Account number ********************************** is trying to sue me for debt that I did not sign with them. I asked for debt validation and I got 2 responses back which will be uploaded. Instead of them trying to validate the debt...they reported to my credit profiles resulting in low fico scores. Though the above accounts are 3 different types, after doing research they are all tied together which is a clear violation of my consumer rights. One of the accounts has no credit history just data unknown. This 3rd party trying to come after me for debts that I did not sign with them. I asked for the original documentation stating that this debt is mine and I got nothing. Also ************************************ (***) is also involved with the same debt. Back on 12/19/2024 Scott & Associates attempted to serve for with a lawsuit on a debt owed to **********. I consolidated all of my credit cards with ****************************** in June 2023 which included this Credit One account. I immediately reached to ****************************** and we settled on 12/23/24 with a signed stipulation agreement. This server has continuously come out in attempts to serve me and I advised ****************************** that informed the stipulation agreement was received by Scott &Associates so the process server would stop coming out. This was not the case the young and continuously come out in attempts to serve and this past Thursday not only did she come out but there was confrontation. This young said out loud during the confrontation, at night that I was still being sued and that I needed to pay my bills. Why does she know my business and saying out loud for my neighbors to here, which is all on my ring camera that I sent over to ****************************** as well. This is harassment we settled almost a month ago and they've received their first payment so why are they still trying to serve me? Even with the confrontation that take place the lady still left with the papers she brought to serve me with. I also receive emails on each serve attempt that states they've missed and have legal documents for me every time she comes out as well to backup how many times she's been out since we've settled. On that same day as well I received a letter from Scott and Associates about the settlement agreement as well. I've reached out to the **** about this situation as well. If this continues I will reach out for legal advise against them because this is harassment and for her to yell my business out in public should be some type of breach of my personal information and why does she know I'm being served for? They can keep on and I'll be seeking a dismissal because I have my proof and camera footage.

      Customer Answer

Process server came out again on 01-30-25  and this was settled with the stipulation agreement and the payments are being made. Scott & Associates are harassing me even I've agreed to their terms.

I do not accept this response at all. ****************************** confirmed submitting this stipulation agreement to Scott & Associates and we settled as of 12-23-24. My other concern is the unprofessionalism of the process server yelling out my business in my front yard and the process server taking a picture of my car tag last night as well which is all on my ring camera. Also Scott & Associates received their first payment on January 10th but you're saying the stipulation wasn't received until Jan 13th so with the initial serve attempts being made December 21st and the document dated December 19th how and why was the payment accepted on Jan 10th after no response from that judgment. I also have a letter dated January 1st from Scott & Associates that confirmed the settlement and amounts. Scott & Associates have been very negligent and inconsistent throughout this entire process. If Scott and Associates pursue wage garnishment and I haven't defaulted, I will seek legal counsel. I have all documents and footage to substantiate my claim.

      Customer Answer

I have attached files from the judgment with the date showing 12-19-24 and confirmation of settlement with agreed amounts from Scott & Associates dated 01-01-25. I have already attached the stipulation agreement that was for in December. I'm not sure why they are bringing up a date of 01-13-25.

I have been paying on this debt for 7 years and had almost paid off the balance. Our family has been in a hardship situation for many years but have continued with the payments until last year. I called and told them I could no longer pay and started getting behind. They tacked on court fees which were taken off before because of my behind status. I have called many times and talked with supervisors but I am not getting anywhere. I also sent them a copy of all my payments we make monthly. I owe ***** for the actual debt which was thousands originally and the court fees are 300 or so. I also have offered to pay the ***** and called this acct paid in full. They are unwilling to do as well.

I signed and mailed the Payment Stipulation Agreement with Scott & A** on June 13, 2024, as an arrangement was made with Beyond Finance, myself, and this debt collector. Since June 27, 2024, and each month thereafter, regular payments of $1,542.50, have been made to Scott & A** per the Payment Stipulation Agreement. On November 13, 2024, I was served a Trial Setting for January 23, 2025. I contacted Scott & A** and was told over the phone that the signed Payment Stipulation Agreement had not been received by **************************** so I emailed a copy of the Payment Stipulation Agreement to *************************************************************** on November 13, 2024 (I have the email). After calling a week later to follow up on their receipt of my signed Payment Stipulation Agreement, I as told that it was recieved, but I would not get confirmation of that. Also, the spokesperson for Scott & A** verified that regular payments were received by them and applied to the remaining balance. I called again a week later, and was basically told the same thing. I then mailed another copy of the signed Payment Stipulation Agreement to Scott & A** P.O. *************************************, on November 20, 2024, by Certified Receipt ************* Mail. The letter has not been accepted by Scott & A** according to **** Tracking - (I have a copy). When calling ************, I get a message that the phone system is down at this time. After not being able to contact Scott & A** to confirm receipt, I mailed another signed Payment Stipulation Agreement by ****, Certified Priority 2-Day mail, on December 17, 2024. I do not have confirmation that Scott & A** have received it as of today. I never received any communication that Scott & A** had not received the orginial signed Payment Stipulation Agreement that I mailed on June 13, 2024, and was unaware that it was missing (according to **************************** If the trial date is not dismissed, I will present all the evidence I have to prove I have adhered to the agreed upon terms.

I was just recently served papers from a process server that states that this office is suing me on behalf of a **** *************** due to a credit card. I had debts in a consolidation program and once I decided to end my business with ********************, they immediately turned me over to debt collectors. **** funding held 7 of my debts. 5 of which I have either paid off or worked out a payment arrangement with them through their payment site Resurgent. This particular account was listed on the court documents is also listed on the Resurgent website but was locked. I was never allowed to access or pay for this one. After getting served with papers, I see why. This company preferred to sue me instead for a $650 credit card (Now over $1200 with their fees added). I am under the impression that due to the federal Fair Debt Collection Practice Act, I was supposed to be notified of the existence of this Scott & Associates PC as well as be given written notice of their intent to take legal action against me. I have no voicemails, nor any written documentation that they have provided to me and therefore I believe they are in violation of the ****** I have reached out to the company, leaving emails requesting not only a reference number to the account to access the information on line, but asking them to supply me with the documents that prove that they tried to inform me of their intent to sue me, without response.

I am rejecting this response because:

I have still not shown proof of the letter this legal office claims to have supposedly sent to me informing of the intent to sue me. According to the Fair Debt Collection Act , they are required to inform me that you intended to sue me. I have request what I believe will be my fourth time now , for a copy of the letter that they claim to have sent to me prior to filing court documents and having me served with papers at my home. Therefore I am going to ask , one more time. I am certain that being a legal office, they must keep records on file of records of communications that are time stamped, in the event their records are subpoenaed.

      Business Response

      Date: 02/28/2025

The validation notice required by the ***** was mailed to you on or about September 23, 2025.  When that letter was not returned as undeliverable and the validation period elapsed, the Firm moved forward with legal collections, which as you know, included filing a lawsuit to collect the unpaid debt. Neither the ***** nor Texas state debt collection rules require a notice of intent to sue letter.

      Customer Answer

      Date: 02/28/2025

Three-year retention period. Section 1006.100 requires a debt collector to maintain records that are evidence of compliance or noncompliance with the ***** and this part starting on the date that the debt collector begins collection activity on a debt until three years after the debt collectors last collection activity on the debt or, in the case of telephone call recordings, until three years after the dates of the telephone calls. Nothing in  1006.100 prohibits a debt collector from retaining records that are evidence of compliance or noncompliance with the ***** and this part for more than three years after the applicable date.

      1006.42 Sending required disclosures.

      (a) Sending required disclosures

      (1) In general.  A debt collector who sends disclosures required by the Act and this part in writing or electronically must do so in a manner that is reasonably expected to provide actual notice, and in a form that the consumer may keep and access later.

With this being said, please show me the letter you send to me the record of your attempt to notify of the intent to sue, or to collect even.

I responded to a proposed debt that has been circling around different collection agencies now for years and it has been disputed with the original creditor and have disputed it with the other agencies until now this agency has it. Its a vicious cycle.. I disputed the debt with a letter dated November 13th that they signed for via certified mail on November 18, 2024, 10:43 am. I sent validation of debt request to them as other prior agencies did not and cannot provide proof of this debt as it was incurred fraudulently while i was undergoing cancer treatment and under doctors care. The original creditor was notified about the unauthorized charges but did nothing to help me and at that time I was stage 4 cancer and was given months to live so I could not pursue further action with the original creditor. Pennsylvania's statute of limitations of debt is four years from the most recent payment or original due date and this has expired. Then on November 26th 2024 I recieved another notice from them asking me to provided hardship documents which is a direct violation of the ***** as they were told to cease and desist any further communication with me as my first letter was within the 30 day notice to dispute the validity of the debt. Title 15 U.S.C. 1692c limits the way debt collectors can communicate with consumers locatin and third parties. I included in my first letter that the address they sent the first notice was NOT my address any longer and I had moved and provided them with my mailing address but they NEGLECTED to update my address and mailed the second letter to my old address once again and the new tenants reached out to me and once again provided mail to me that the postal service is negligent in forwarding my mail. 1692g requires debt collectors to provide consumers debt validation notice and I did dispute the debt in my first letter and they neglected once again to adhere to the federal law by asking me to provide hardship. I am seeking damages
