And they are refusing to give me the release letter for both UCCS so i can move forward with my business. They holding me back from proceeding with my business.       Hello,
      ************************** recently submitted a request to terminate his agreement with Triumph Financial on 5/22/2024. From that date, the end of the agreement,in accordance with his signed agreement with Triumph Financial,  would be thirty (30) days, 6/21/2024.  Part of the ending of said agreement is that the user, ******************, meet all ******************** obligations and or any balances owed,paid. Once paid, posted, and applied the termination process *** proceed. As of 5/28/2024, ****************** has not met the required marks to have his UCCterminated and released by Triumph Financial, as representatives have actively been reaching out to the listed contact information to have ****************** released from Triumph Financial. Once all that is required, complete, Triumph is happy, eager, and willing to assist in the expedition of ******************** requests.

      THE BUSINESS ARRANGEMENT BEGAN IN LATE 2021 WITH TRIUMPH BUSINESS CAPITAL TO FACTOR THE INVOICES FOR OUR TRUCKING COMPANY. WE WERE NOTICING INCONSISTENCIES EARLY THIS YEAR AND REACHED OUT TO OUR ACCOUNT REP FOR GUIDANCE. WE WERE CONSIDERED A "RECOURSE CLIENT" WHICH MEANS THEY CAN TAKE BACK ANY ***** ADVANED TO **, SHOULD THE CUSTOMER FAIL TO PAY THE INVOICE TO **********************. WE ASKED FOR A LIST OF THEIR TERMS AND DEFINITIONS THAT IS NOT PROVIDED IN THE CONTRACT OR ANYWHERE ONLINE THAT WE'VE FOUND, AND THEY REFUSED TO PROVIDE SUCH A THING. WHEN WE INQUIRED ABOUT THE INCONSISTENCIES WITH FEES CHARGED,CHECKS COLLECTED,RESERVE ***** ETC WE WERE TRANSFERRED FROM PERSON TO PERSON TO PERSON STILL WITH NO ANWERS. EMAILS NOT ANSWERED. WE DECIDED IN MARCH OF THIS YEAR TO STOP USING FACTORING AND GO BACK TO IN HOUSE INVOICING. WE NOTIFIED TRIUMPH OF THAT AND AWAITED FOR SUCH A TIME AS OUR A/R BALANCE REACHED ZERO AND WE WOULD BE ABLE TO COLLECT THE ***** IN OUR RESERVE ACCOUNT MINUS THE EARLY TERMINATION FEES PER THE CONTRACT. WE'VE REACHED OUT SEVERAL TIMES, CHECKS FROM ENTITIES ARE STILL ROLLING INTO THE TRIUMPH SYSTEM ON OUR BEHALF. WE ACUTALLY HAVE A NEGATIVE A/R BALANCE AND MORE THAN TEN GRAND IN RESERVES THAT THEY REFUSE TO RELEASE BECAUSE WE NO LONGER WISH TO USE THEIR SERVICES. UNSURE WHAT WE CAN DO OUTSIDE OF LEGAL ACTION.

      Hello,
      ************, of **** EXPRESS CORP. , signed a contract with Advance Business Capital LLC d/b/a Triumph Business Capital in late 2021. At the time of signing the client did sign as stated,a Recourse Contract. That has continued to present day as the contract auto renews on a 12 month, annual, basis.
      ************ has been contacted by and spoken to representative at Triumph regarding the mentioned inconsistenciesto help answer any questions or issues he may be experiencing. His dedicated account executive has asked for documentation of his alleged inconsistencies, and his account executive, as of 5/20/2024,  has not received any correspondence back.
      ************ mentioned he is trying to collect the funds from his reserve minus the termination fee. At this time, the negative A/R balance mentioned by ************ is the hold up for the inability to terminate the contract and collect said reserves.
      ************** account executive did reach out and request additional documentation to help resolve the negative A/R balance, thus allowing for the reserves of ************ to be used for the early termination fee, the remaining of the reserve be sent to him, and subsequent release of contractual obligations, as stated in the submission.
      At this time there are no monies coming to Triumph on behalf of ************, as mentioned. We believe negative A/R balance is what is being referred to. As mentioned above, there are necessary documents needed from ************ to resolve this portion of the submission and on the account with **********************.
      ************ did surface a request to terminate the contract in February of 2024.
      ************ is not able to be released at this present time, due to the mentions above, and the mentions made in the submission, the negative A/R balance.
      At this time Triumph is unable to help or accommodate the mentions in the BBB complaint submission, due to the lack of documentation provided by ************. If we can get the needed documentation,we can assist and move forward with the next steps of ************** requests.

      01/16/**** I reach out to ***** at Triumph Dispatch llc located at *********** ** about renting a 53 foot trailer, after we agreed on the price I sent a 400 dollars deposit for trailer and later find out triumph dispatch doesn't own any trailers for rent they been using amazon trailer to make money. I spent two days driving around going to different Amazon facilities looking for trailer with no success, then I ask ***** for a refund instead giving me my money back he block my number, then I call the main line and I talked to **** just to find that ***** told him I did receive a trailer and I had the trailer for a month na d mind you the first time I got in contact with ***** was on the 16 of January ****. I feel like there's only one thing left to do is to get a lawyer involved doesn't matter if I end up spending more money.

We did not receive any funds from **********************, we would not be refunding any monies to **********************. We are not a dispatch service but a ****************** Though similar in name and in the 'trucking' arena, we are not one in the same.       Should be zero stars. This company is unbelievably incompetent. They pass the blame on to whoever they can for THEIR s**** **** This is the second time for no reason my account *** been locked. They tell me 24 to 48 hrs but then its weeks. They put me in such a financial bind where i couldnt pay employees or contractors.God help you if you have a payment issue and need to speak to someone. Their favorite thing is to "write a ticket" on your issue and get back to you. Good luck dealing with this mess. I will no longer process any payments through this joke of a company. I want my account unlocked immediately so my monies can be released

      After review of the client's complaint, we wanted to provide specific feedback on both the terms of the contract and the steps taken to help accommodate the client's request: 


      - The client's agreement states a 90-day notice to end their factoring account. The client submitted their request more than 90 days after their renewal date (187 days later than the agreement requires). According to the terms, the contract renewed for another year. 

      - A client can terminate the contract by paying an early termination fee. Based on the terms of the agreement, the termination fee should have been $7800. After review, we offered to lower it to $4,000. 

      - The client was also in discussions with another factoring company, which could buyout the contract and pay the early termination fee on the client's behalf.

      - Triumph then offered a waiver of $3800 to further help accommodate the client's request. 

      - To date, we have not received additional feedback from the client, nor the other factoring company on a buyout. 

      We are prepared to move forward with the buyout once we receive additional communication from the other factoring company.

      The policy reads that it's a percentage of what was factored in the last 6 months. We have not factored with them in over 3 years. We also never put in a written notice to renew the only . They are picking and closing amounts in which legally we don't owe them $7800, $4000 or $3800. We haven't responded because we reached out to attorney General and the BBB to help us because they are still trying to charge us. What can you do? Continue to argue with them when they know they are in the wrong?

      We have been in business since May2020 never used a factory company. We started factoring withTriumph Capital in late January 2023.. we was told if a ******* doesnt pay them for a load they will not come after us for the money, well that was a LIE! Also they spoke to the ******* & the ******* agreed to pay Triumph Capital. They always verify with *******(s) before they give funds. So if they the ******* agreed to pay Triumph Capital how!!??? was we still held accountable. Not only that but several times i was waiting days even weeks for my funds. We call & ask hey whats up we havent heard back from them the *******; if you like you can call them to speed up the process soo we pay you TriumphCapital to factor our loads & We have to also do your job? While you take percentages %. We are a trucking company diesel cost $5 a gallon 200gallons is $1,000.00 every work day! For every truck in operation. Not having funds can & did cause countless issues in our operation. At the moment we submit an invoice for $1000.00 they gave me $153.00 we have screenshots if anyone needs proof of testimony what was 153 supposed to do?? Nothing.. So within the next 2days we submitted $4700 total $5700.00 to pay back & get away from *********** held it said i didnt sign rate but WE never sign! Than i knew for sure this was intentional! Imagine running a company cost thousands a ************************************************** is holding your funds for days even weeks soon youll be out of business dealing with these scammers! *** asked severally time for a LETTER OF RELEASE! Was told once i pay back what the ******* didnt pay I can terminate my contract! We hve used them for a total of 3months! The worsts 90days of business! Anyone whom reads this PLEASE DO NOT DO BUSINESS WITH THESE PEOPLE?? If you do youll be the next one on here leaving one of these reviews. The inconvenience, the stress, the headaches , the doing your job & also theirs, the funds being late! COMPLETE S*** SHOW ?? Lets not for get the $2500 cancellation fee ??

      In reviewing the clients complaint and our own internal notes, we are trying to understand better the desired outcome.

      To address the individual concerns listed in the complaint:
      - Yes, we did ask that the negative balance be restored before a letter of release could be issued for that particular customer.
      - As part of the terms in our contract, a client can terminate early, but it would be subject to an early termination fee.

      We consider the account active and continue to purchase invoices. We do not have a current termination request. If the client would like to review his account, we can set up time to review any pending questions related to the complaint.

      I used their service a few times years ago. When I signed up for their service I was told it was a year contract and after that I was free to move on where ever I wanted. I havnt used their service in over a year . I went to sign on and it said that my account was inactive. So I thought of course my account has been canceled. I opened a totally separate company that has nothing to do with the company I that was signed up for triumph services . I came to find out that they not only control everything factoring related for the company you signed up with but every other company that you have forever until you cancel with them . They automatically renew your contract annually no mater how long it remains inactive . So my new company has nothing to do with my trucking company but still requires factoring for services that triumph dosnt factor. I called in on the 2/20/23 to cancel . They answered, was polite, and easy process . Said wait 48 hrs and they will send me a cancelation letter . I waited till the following Monday. I called back in wondering why I didn't receive it yet. They said I see where you called in but nothing was filled . I said who did I speak to, they didn't know (convenient) So I was told to email terminations and my account manager. I sent the email . They sent the form right away filled it out and was told with a automated message to wait 48 hrs and I will receive the letter. It's been a week and have had no response. I spoke to my account manager and he sent them a email that was never responded to. I've called multiple times with no luck. People that work there have no access to termination other than email and people in that department don't respond . I would recommend not doing buisness with this company . They will be kind and responsive with everything but completely unresponsive when you want to leave even when it's been a year since you used them . Also I was told they might charge me $2500 cancelation fee . Shady company. Stay away

      1st 3 yrs of issues deleted because of too many characters We are entering year four of doing business with Triumph and within the 1st week of ************** our account is placed in the negative by $4455. We have no clue how this could have taken place but with the way things in the economy are these days it's not the time to be making these types of mistakes. When we call we can't get our account executive on the phone. No one seems to know what happened. Clearly it's not anything we done wrong there's no warning of it but yet it happened and we just have to deal with it. Instead of continuing to go through this cycle of financial inconvenience we will invoice or clients directly and be done with Triumph. But noooooo we can't without a Letter Of Release which we can't get because they automatically renew our contract with no reminder email phone call or text. Which just took place 1-8-2023 it's NOWHERE in the contract and we have no outstanding accounts receivables. Even the negative reserve has been brought current. Out of the blue I receive a call from ****** who refuses to give any information on who he is but yet knows EVERYTHING about us. Calls and ask us at 1:49pm CST on 2-21-2023 why we are terminating the contract. In the process of telling him he is clearly distracted because I can hear him fumbling with stuff in the background. Then he tells us that we have to pay a $2500 early termination fee because we failed to write a letter 30days before our contract renewed automatically. I told him it's not written in the contract and he said it was. He then disrespectfully repeated himself horrible customer service, and that's when I asked to speak with someone else anyone but him. Conclusion since when is it ok to force a business to do business with you when they are clearly unhappy with your service? How do you enforce a contract that doesn't state the words AUTO RENEW and then enforce a $2500 early termination fee? Especially after 3 years!

      After additional conversations and review of the client's account and contract, the following was determined:

      We received the client's request for termination more than a month after the automatic renewal date (Renewal: 1/8/2023; Received from client: 2/17/2023). The contract requires a written, 30-day notice to initiate the request for termination.

      A client can prematurely terminate their contract but are subject to an early-termination fee (detailed in Section 3: ***************** As the contract renewed (1/8/2023), the early termination fee would be required to initiate termination process.

      Additionally, a client cannot be released from their contract if there is an outstanding balance on their account. The charges the client refers to represent the balance outstanding at the time the complaint was sent.

      The above was explained to the client along with the recommendation to continue the contact to avoid early termination fees.

      We have signed up for their factoring service with Triumph. They paid us the first week on time too get us thru the door. After the first couple weeks they completely have stopped paying us. They do t fund our company with the loads that we have completed. They don't return our calls they constantly lie too us. We have asked them too release us so we can go somewhere else. They have ruined our company we can't pay or bills we can't book loads or pay our drivers. Their truly horrible people. Where at the point where we want too seek legal help now. And we will make sure everyone knows and stays away from these people. We want our release.

      I am a truck driver (carrier) and have been waiting to be paid for the loads that I have carried. The companies I have carried the loads for have already paid Triumph, but Triumph Business Capital have not gotten back to me even after I contacted them in September. I broke my contract with them in July, so I no longer get my payments through them. I have contacted them in order to get my payments released, but they have not gotten back to me. One of the companies I carried for, USAT, told me they have paid Triumph and they sent me the payout reports to prove that. The name I go under is ** Transport and the MC # is XXXXXX. Redwood has also paid to Triumph Business Capital and I have not gotten a response for payment for these either. I have attached payment reports for both of these companies below. Please let me know what else I can provide in order to get this resolved.
