      I ran a $900 load for a broker back on Nov. 14th 2024. The broker sent the payment immediately after delivery to Triumph Financial Services who was my former factoring company by mistake. The broker cant pay the funds to my correct company because Triumph wont ***ly to broker request of what is the refund status. I know Triumph has my money because the broker has provided several receipts such as the account number it was sent to and also the receipt IDs. Ive called ********************** on 3 occasions and each time they say they will look and if they find it they will reach out to me. They have no public emails you can reach out to. Every time Im told Ill get a call back by a customer service *** I know that I wont hear back. This is the reason I left Triumph because they have very negative attitudes towards customers until you tell them youre leaving and they want to reel you back in. I deeply question the morals and integrity of how they treat clients especially with the amount of profit they make off their contracts.

      I (********************) have been factoring with Triumph Business Capital since 2018. My company got out of business on December 01 2024. I requested the company transfer of my reserve balance ($6854) halfway in December, 2024. They said I need to wait until Accounts Receivable are cleared, which I understood and been waiting for the clearance. As of 01/06/2025, theres $4450 uncollected balance, which $3700 is past due for 75 days. Im politely requested if the $2400 can be paid to me today as I really needed the funds. I was told my contract was renewed automatically on October, 29 and I owe $500 per month ($5500) the remaining ***************************************************************** confirmation of the renewal by email or mail. This is what you get for staying loyal for more than 6 years while receiving several offers from other respected factoring companies with buyout and lower rate offers.

In addition, all invoices have pa dates through their partner pay platform Triumph Pay.. They also advised, with Pay dates, Triumph Business capital should release my customers but they refuse to do ********************** in GOOD FAITH.

      Good morning,

      Somac LLC is bound to Triumph Financial by a commercial security agreement in an accounts receivable factoring arrangement.  ********************************** is bound to Triumph Financial under a personal guaranty. Despite the clear terms of the agreement, ********************** has requested, by his Desired Settlement, to have all customers released.  Under the agreement and Article 9 of the Uniform Commercial Code, customers of Somac LLC are account debtors and ********************** has lien rights in ALL accounts of Somac LLC until all indebtedness is paid to Triumph in full.

      Thus, Mr.********** request is premature and not able to be completed until all obligations under the agreement are satisfied by Somac LLC.  The agreement requires a Complete Termination (defined below) in order to trigger a release of any account debtors.  Because Triumph remains owed a sum of money under the agreement, Triumph is fully entitled to enforce its lien rights as a secured creditor. 

      Once Triumph is fully paid, Triumph will work on expediting all documents needed to quickly release Somac, LLC from any further obligations.  Nevertheless, under the clear terms of section 12.2 of the agreement, Triumph will require a signed release from Somac LLC.  Somac LLC has expressly waived rights under section ***** of the Uniform Commercial Code.

      Sections 1.7,1.7(a) and (c), & 12.2, below, directly from said contract for more clarity.

      12.2. No Lien Termination without Release. In recognition of Triumphs right to have a Complete Termination, notwithstanding payment in full of all Obligations by Client, Triumph shall not be required to record any terminations of any Financing Statement or satisfactions of any of Triumphs ownership rights or Security Interest in the Collateral unless and until Complete Termination has occurred. Client understands that this provision constitutes a waiver of its rights under ***** of the Uniform Commercial Code.
      1.7. Complete Termination in connection with the Term of this Agreement, occurs upon satisfaction of the following conditions: (a) payment in full of all Obligations of Client to Triumph; (b) if Triumph has issued or caused to be issued guarantees, promises, or letters of credit on behalf of Client, acknowledgement from any beneficiaries thereof that Triumph or any other issuer has no outstanding direct or contingent liability therein and (c) Client has executed and delivered to Triumph a general release in a form prepared by and acceptable to Triumph.
      1.7(a) and (c) have not been completed, and 12.2 requires those to be completed before a release is given.

      After i paid off my fees they are refusing to give me the release letter for both UCCS. And I've been communicating with Triumph business capital / Advanced business capital via email and phone. And they are refusing to give me the release letter for both UCCS so i can move forward with my business. They holding me back from proceeding with my business. Triumph business capital / Advanced business capital is thee WORST company to do business with.

      ************************** recently submitted a request to terminate his agreement with Triumph Financial on 5/22/2024. From that date, the end of the agreement,in accordance with his signed agreement with Triumph Financial,  would be thirty (30) days, 6/21/2024.  Part of the ending of said agreement is that the user, ******************, meet all ******************** obligations and or any balances owed,paid. Once paid, posted, and applied the termination process *** proceed. As of 5/28/2024, ****************** has not met the required marks to have his UCCterminated and released by Triumph Financial, as representatives have actively been reaching out to the listed contact information to have ****************** released from Triumph Financial. Once all that is required, complete, Triumph is happy, eager, and willing to assist in the expedition of ******************** requests.

      THE BUSINESS ARRANGEMENT BEGAN IN LATE 2021 WITH TRIUMPH BUSINESS CAPITAL TO FACTOR THE INVOICES FOR OUR TRUCKING COMPANY.       Hello,
      ************, of **** EXPRESS CORP. , signed a contract with Advance Business Capital LLC d/b/a Triumph Business Capital in late 2021. At the time of signing the client did sign as stated,a Recourse Contract. That has continued to present day as the contract auto renews on a 12 month, annual, basis.
      ************ has been contacted by and spoken to representative at Triumph regarding the mentioned inconsistenciesto help answer any questions or issues he may be experiencing. His dedicated account executive has asked for documentation of his alleged inconsistencies, and his account executive, as of 5/20/2024,  has not received any correspondence back.
      ************ mentioned he is trying to collect the funds from his reserve minus the termination fee. At this time, the negative A/R balance mentioned by ************ is the hold up for the inability to terminate the contract and collect said reserves.
      ************** account executive did reach out and request additional documentation to help resolve the negative A/R balance, thus allowing for the reserves of ************ to be used for the early termination fee, the remaining of the reserve be sent to him, and subsequent release of contractual obligations, as stated in the submission.
      At this time there are no monies coming to Triumph on behalf of ************, as mentioned. We believe negative A/R balance is what is being referred to. As mentioned above, there are necessary documents needed from ************ to resolve this portion of the submission and on the account with **********************.
      ************ did surface a request to terminate the contract in February of 2024.
      ************ is not able to be released at this present time, due to the mentions above, and the mentions made in the submission, the negative A/R balance.
      At this time Triumph is unable to help or accommodate the mentions in the BBB complaint submission, due to the lack of documentation provided by ************. If we can get the needed documentation,we can assist and move forward with the next steps of ************** requests.

      01/16/**** I reach out to ***** at Triumph Dispatch llc located at *********** ** about renting a 53 foot trailer, after we agreed on the price I sent a 400 dollars deposit for trailer and later find out triumph dispatch doesn't own any trailers for rent they been using amazon trailer to make money. I spent two days driving around going to different Amazon facilities looking for trailer with no success, then I ask ***** for a refund instead giving me my money back he block my number, then I call the main line and I talked to **** just to find that ***** told him I did receive a trailer and I had the trailer for a month na d mind you the first time I got in contact with ***** was on the 16 of January ****. I feel like there's only one thing left to do is to get a lawyer involved doesn't matter if I end up spending more money.

      Should be zero stars. This company is unbelievably incompetent. They pass the blame on to whoever they can for THEIR s**** **** This is the second time for no reason my account *** been locked. They tell me 24 to 48 hrs but then its weeks. They put me in such a financial bind where i couldnt pay employees or contractors.God help you if you have a payment issue and need to speak to someone. Their favorite thing is to "write a ticket" on your issue and get back to you. Good luck dealing with this mess. I will no longer process any payments through this joke of a company. I want my account unlocked immediately so my monies can be released

      Their saying i owe them ***** to leave my contract i haven't used them in 3 years and they contract dont say early termination fee of ***** their holding me hostage because they have my ucc filing on my company.

      After review of the client's complaint, we wanted to provide specific feedback on both the terms of the contract and the steps taken to help accommodate the client's request: 


      - The client's agreement states a 90-day notice to end their factoring account. The client submitted their request more than 90 days after their renewal date (187 days later than the agreement requires). According to the terms, the contract renewed for another year. 

      - A client can terminate the contract by paying an early termination fee. Based on the terms of the agreement, the termination fee should have been $7800. After review, we offered to lower it to $4,000. 

      - The client was also in discussions with another factoring company, which could buyout the contract and pay the early termination fee on the client's behalf.

      - Triumph then offered a waiver of $3800 to further help accommodate the client's request. 

      - To date, we have not received additional feedback from the client, nor the other factoring company on a buyout. 

      We are prepared to move forward with the buyout once we receive additional communication from the other factoring company.

      The policy reads that it's a percentage of what was factored in the last 6 months. We have not factored with them in over 3 years. We also never put in a written notice to renew the only . They are picking and closing amounts in which legally we don't owe them $7800, $4000 or $3800. We haven't responded because we reached out to attorney General and the BBB to help us because they are still trying to charge us. What can you do? Continue to argue with them when they know they are in the wrong?

      BBB is unable to locate the business.
      We have been in business since May2020 never used a factory company. We started factoring withTriumph Capital in late January 2023.. we was told if a ******* doesnt pay them for a load they will not come after us for the money, well that was a LIE! Also they spoke to the ******* & the ******* agreed to pay Triumph Capital. They always verify with *******(s) before they give funds. So if they the ******* agreed to pay Triumph Capital how!!??? was we still held accountable. Not only that but several times i was waiting days even weeks for my funds. We call & ask hey whats up we havent heard back from them the *******; if you like you can call them to speed up the process soo we pay you TriumphCapital to factor our loads & We have to also do your job? While you take percentages %. We are a trucking company diesel cost $5 a gallon 200gallons is $1,000.00 every work day! For every truck in operation. Not having funds can & did cause countless issues in our operation. At the moment we submit an invoice for $1000.00 they gave me $153.00 we have screenshots if anyone needs proof of testimony what was 153 supposed to do?? Nothing.. So within the next 2days we submitted $4700 total $5700.00 to pay back & get away from *********** held it said i didnt sign rate but WE never sign! Than i knew for sure this was intentional! Imagine running a company cost thousands a ************************************************** is holding your funds for days even weeks soon youll be out of business dealing with these scammers! *** asked severally time for a LETTER OF RELEASE! Was told once i pay back what the ******* didnt pay I can terminate my contract! We hve used them for a total of 3months! The worsts 90days of business! Anyone whom reads this PLEASE DO NOT DO BUSINESS WITH THESE PEOPLE?? If you do youll be the next one on here leaving one of these reviews. The inconvenience, the stress, the headaches , the doing your job & also theirs, the funds being late! COMPLETE S*** SHOW ?? Lets not for get the $2500 cancellation fee ??

      In reviewing the clients complaint and our own internal notes, we are trying to understand better the desired outcome.

      To address the individual concerns listed in the complaint:
      - Yes, we did ask that the negative balance be restored before a letter of release could be issued for that particular customer.
      - As part of the terms in our contract, a client can terminate early, but it would be subject to an early termination fee.

      We consider the account active and continue to purchase invoices. We do not have a current termination request. If the client would like to review his account, we can set up time to review any pending questions related to the complaint.
