    Southwest Airlines Co. Violations of 49 U.S.C. § 41712 and 14 CFR Part 259; Docket DOT-OST-2023-0001

    On December 18, 2023, the U.S. Department of Transportation (DOT) announced a $140 million civil penalty against Southwest Airlines for numerous violations of consumer protection laws during and after the operational failures that cancelled 16,900 flights and stranded over two million passengers over the 2022 Christmas holiday and into the New Year.

    The penalty is in addition to the more than $600 million in refunds and reimbursements that DOT already ensured Southwest provide passengers who faced travel disruptions during the operational meltdown.

    In total, Southwest will pay over $750 million for the holiday meltdown — with the vast majority going to passengers for refunds, reimbursements, rapid rewards, or future compensation — due to DOT’s actions.

    In its investigation, DOT found the company violated consumer protection laws by:

    • Failing to provide adequate customer service assistance
    • Failing to provide prompt flight status notifications
    • Failing to provide refunds in a prompt and proper manner

    The U.S. Department of Transportation’s investigation and enforcement action has taken the following actions to benefit consumers:

    • Requires Southwest to establish a $90 million compensation system for future passengers affected by significant delays and cancellations
    • Penalizes Southwest $140 million for violating consumer protection laws – deterring Southwest and other carriers from committing similar violations in the future
    • Ensured passengers were refunded and reimbursed over $600 million for significant delays and cancellations during the 2022 holiday season

    The agreement was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.

      I am an extremely frequent Southwest customer. Recently my partner and I registered for the Southwest airlines companion pass promotion, and my partner booked and traveled on a flight in order to become eligible to have a companion pass from August through October. Southwest airlines claimed we never registered for the promotion (it only involves clicking a button on the website). They admit that my partner traveled during the time that the promotion required, yet they withhold the pass on the basis of the registration. Southwest is lying about my partner registering for the promotion. We clicked the button. We spent money on the flight for this specific reason. And we would lose more than $700 on travel this fall as a result of their dishonesty. We will miss three family events, too, since we planned with SWA. I have contacted Southwest customer service at multiple levels, and I was told over email by Mason ***** that Southwest cannot make "exceptions" to their "promotional requirements." I want to be very clear that I did not ever ask Southwest to make an exception for us. In fact what I am asking is for Southwest to adhere to basic business ethics, basic business ethics and adhere to their own promotional requirements: we registered, we bought the flight, and we traveled on the flight. Since I don't work for the Southwest IT department, I do not know why the airline does not have a record of our registration in the promotion. But it is the responsibility of the airline to make this right rather than continue advertising fraudulent promotions. I do not appreciate the way that I was addressed in these emails-- as though I was asking for some service for free, or for a special favor-- as a customer. I know for sure that we registered in the promotion because we registered for the Hawaii-related promotion in the same exact way, and the customer service representative say (see attached) they can see that we have registered. So clearly the issue was not on our end.

      Wow what a poor unhearted service. They cancelled flight to ORD bc air traffic control also they were cancelling flights for ****** and *********. Service help in ********** was horrible. They said no flights until 2 days later. Also they didnt want to find out or accommodate better or other flights. They didnt accommodate us to a hotel to stay over. They just didnt care at all.
