      My credit report contains a false EXETER FINANCE LLC discrepancy that needs to be removed. I sent them letters demonstrating errors on my credit report, and I have receipt numbers **** **** **** **** **** 66. I wrote them a letter on 06-23-2023, but I never heard back, and this account is harming my credit rating. If they don't reply, I'll launch a lawsuit.

      Exeter has an obligation to the Fair Credit Reporting Act which requires all accounts to be reported accurately and factually. Exeters records were reviewed, and it was determined an update was necessary to reflect the account as a charge-off sold to ***************************** (JCS). ****** should allow up to 45 days for the updates to be reflected on their credit profile.  

      The claims of Exeter receiving correspondence from ****** dated June 23, 2023, and Exeter not responding are unable to be substantiated. All disputes received were responded to within the required time frame.
      As of March 19, 2019, the account was sold to JCS. The account was reported to the credit reporting agencies (CRAs) as sold and was closed by Exeter with a zero balance. Exeter does not delete tradelines on accounts that are sold, paid, or settled in full. Please contact JCS to discuss any updates regarding their tradeline. You may contact JCS at **************.

      I ******************* have been being harassed my Exeter Finance LLC. Exeter Finance sent me a statement in the mail stating that I owe them money on the 19th of every month for a loan that they gave me. It is a fact that I do not owe Exeter Finance anything. I feel there has been a mistake because they didn't give me anything of value therefore, I do not owe them anything. I demand Exeter Finance to send me the original contract and an audit trail of all accounting including the source of origination from where the lawful money was sent to me.

      On August 5, 2023, all required information regarding the contract terms were disclosed on the contract as required by law. The signed Contract shows that ***** agreed with the terms and conditions. ***** will remain responsible for the contractual terms, which they agreed upon, including making payments.

      Please note that falsely alleging that the account is paid in full, when, in fact it is not, constitutes fraud.

      Based on Whites specific request, Exeter has placed a cease-and-desist status on the account to prevent any future collections calls or communications by Exeter.This will leave White responsible to contact Exeter on their own regarding their account and to make payments. Please note, however, that Exeter may notify White in writing of its invocation of specified remedies under the Contract should the need arise in connection with the increasing delinquency on the account.

      Under separate cover, a copy of the executed Contract and a Statement of Account,showing all account activity through October 4, 2023 for Whites review.       I am rejecting this response because:  Exeter has sent me a false and deceptive form pursuant to 15 USC ****j(a). Exeter has called my phone about 5 times a day in attempt to collect a debt but pursuant to 15 USC 1962d (4) it is harassment and that is a violation because the time of contact was not a good time to contact me. Exeter assumed it was a good time but in fact it was not.  Also pursuant to 15 USC ****k (2)(A) Exeter holds civil liability and will owe me the Consumer $1000 per violation.

        Pursuant to 15 USC 1635(a) the company has to send paperwork to the consumer within 3 business days in regard to the right of Rescission since I did participate in a consumer credit transaction (not a loan because Loan is not defined under the ******* in connection with my open end credit plan. Exeter did not send me any information in regard to the right to resend within in 3 days of the consumer credit transaction which means I have 3 years to do so pursuant to 15 USC 1635(f).  pursuant to 15 USC 1605(A) the finance charge is the sum of all charges which isn't payable by cash and the finance charge includes Life, Accident, health insurance premiums pursuant to 15 USC 1602(b) and Property Damage and ******************* Premiums pursuant to 15 USC 1605(c)

      Pursuant to UCC ***** I  have to right to request an audit trail of all accounting. Which Exeter Did not send. Which is a violation.

      I don't have a contract with Exeter Finance LLC. on 9/28/2023 I asked for the original contract and an audit trail of all accounting including the source of origination from where the lawful money was taken and given to me, I was not given any type of paperwork that I have requested. I feel there may have been a mistake because they didn't give me anything of value therefore, I don't owe them anything. I wish not to be harassed any longer and I wish that they release any liens from my property; I was forced to make complaints to the Attorney General, CFPB, the **** and the Office of the Comptroller of the Currency.

      Exeter Finance for account ***************** has violated my rights by reporting and selling my information to a company named NCB management ************ phone number ************. sold the vehicle at an auction and by law did not serve either party certified mail of a balance.       On December 15, 2014, ******* signed a Motor Vehicle Retail Installment Sales Contract Simple Finance (Contract) for the purchase of a vehicle with **********************, **** (Dealer), which assigned the Contract to Exeter.

      The vehicle was repossessed on November 7, 2020, due to non-payment. The vehicle was sold at auction because of the repossession, and ******* was sent an Explanation of Calculation of Surplus or Deficiency (Notice) to the address on file that outlined the gross proceeds and the balance due after the auction sale of the vehicle. The Notice was sent via **** mail as the **************,in which the Contract was executed does not mandate such Notices to be sent certified mail as stated in this complaint. A copy of the Notice will be re-sent to ******* under a separate cover.

      According to the guidelines set by the **************** Services (***), a ****-C form is required to be filed when a debt of $600 or more is discharged. As of the date of this response, there has been no discharge of such debt in relation to ******* account, rendering the filing of a ****-C form inapplicable.       As of March 23, 2023, ******* account was sold and is now serviced by NCB ********** Services, ****(NCB). Exeter is unable to act with respect to this account regarding any matters that occurred after the sale of this debt. ******* will need to contact NCB at ************** to discuss any updates regarding their tradeline.

      ******* cites to statutes and regulations either wholly unrelated to Exeter Finance or otherwise inapplicable to the circumstances surrounding their account. As a creditor, Exeter has an obligation to report its consumers account information in accordance with the guidelines stated in the Fair Credit Reporting Act. The information reported to credit reporting agencies is accurate, no adjustments are necessary.

      We are unable to substantiate ******* claim that Exeter has violated their rights as stated in the complaint and will not honor their request to remove the valid tradeline from their credit file based on the claims presented in this complaint.

      Hello. I am reaching out to the BBB in regards a situation that transpired between me and 2 representatives at Exeter Finance. My car was recently placed a hold status due to non-payment. Upon discovering this action, I immediately reached out to Exeter Finance to make amends to the matter. I called an spoke to **** ******* and she advised me that I needed to pay a total of $1117.00 to bring the account current because the account is 59 days past due. I advised her that I didn't have that amount, so she advised me on the amount that was needed to bring the account under 59 days. I paid $418.42 as advised. I later called back to get detailed information to recover my vehicle and was advised to pay $744.83 and it was due in 10 days. ******* ***** also stated that the September payment would be due in 10 days as well, and the call ended. I called back today 9/27/23 to review the prior call and make preparations to fulfill payment and was later advised of a different amount totaling $1,443.66. I questioned the amount because I was advised of another. I was also told my vehicle would be stationary until the 10 days expire and that was not factual. ******* advised me today that it has be relocated to ***********, ** and my personal property is located in ****************, **. I was very upset to learn this information today. ******* apologize on the other reps ******* but I feel like compensation needs to be awarded for the incorrect information provided. I am now left to pay an additional $ ****** and drive 3 hrs. away to redeem my vehicle, so my kids and I would have transportation to and from school, this a total inconvenience. Leadership teams are in place for a reason. There is no need to misspeak on a subject that isn't your area of expertise. I did speak with a supervisor who said she couldn't waive any amounts, but I would love to speak to someone who could to resolve this matter. **************** and effective communication is key!

      On August 15, 2023, a Notice of Right to Cure was mailed to Legares address on file advising that the current amount that was due now was $767.83.  The notice informed ****** that the account was currently under default and failing to process the payment on or before September 7, 2023, could result in Exeter exercising their right to repossess the property.

      On August 21, 2023, a payment in the amount of $372.41 was processed on the account.  That payment did not satisfy the amount due.  Another payment was processed on September 22, 2023, in the amount of $418.42 which satisfied the full balance of the July 24, 2023 payment due date.  Subsequently, on September 20, 2023 ,the vehicle was secured prior to the payment being processed.

      On September 21, 2023, ****** spoke to a representative of Exeter who advised that they had ten days to process payment in the amount of $744.83 to redeem the vehicle.  The representative failed to advise ****** that if the vehicle is redeemed after the next payment due date of September 24, 2023, that the balance will be increased by $744.83 for redemption.

      On September 27, 2023, ****** was prepared to process one payment of $744.83 and was told that the balance to redeem the vehicle increased to $1,443.66.  Due to the misinformation the call was transferred to a manager who advised she will review the calls and provide coaching feedback to the representatives manager.  The manager also advised they would waive the late charge balance in the amount of $46.00 as a courtesy.

      A member of management reviewed the phone calls associated with the repossession,and it was determined that the information provided was not clearly communicated to ******.

      A review of Exeters records indicates that on October 2, 2023, a member of management did speak to ****** and apologized for the agent providing misinformation.  Exeter has waived the repossession fee in the amount of $495.00. Also, the late charge balance in the amount of $46.00 has been waived as well.  Exeter sincerely apologizes for any inconvenience this may have caused and for any service ****** received that did not meet their expectations.

      I am rejecting this response because:  The credit to my account happened AFTER the fact. As stated to the representative and the manager when I learned this information, why couldn't something be done right there? The information to me was no error on my behalf, but on the representative that works for Exeter. I am a firm believer that if you're of something its always best to ask your leadership team, before relaying incorrect or misleading information. I am grateful that I was in a place to make the addition amount due to redeem my vehicle, but thats not the principle of the matter. My vehicle is my only means for transportation, So with that being said, what if I wasn't able to make the amount due before the sold date then what because of incorrect information? Therefore, as said previously, I would like a refund for having to pay the difference, or have the credit made to my upcoming payment!  Please advise.

      Secondly, I have made multiple calls to Exeter Finance because my vehicle was damaged during the recovery process. The managers so I spoke to advised me to email ********************************************** then call ************ to follow up. I sent the email it was undeliverable, and the phone number rings as invalid. I then called back on Wednesday 10/18/23, spoke to another rep who told me the system shows returned calls were being made. As I told her, I reviewed my call log and a call, nor message was left from Exeter Finance with a contact number of, **************. As I mention someone needs to reach out to get my vehicle repaired this is unacceptable. The damage shown is marks of a tow truck, photos are attached. In conclusion, a prompt follow-up response to both matters would be greatly appreciated.

      I am rejecting this response because: I feel like the ********** of the ********* refuses to see the principle of my complaint. I am not arguing the fact that the repossession charges needed to be applied. My argument is the additional money I had to pay because not being educated properly.  As stated by every representative, calls are "monitored and recorded for a quality and training purposes." If that is true, why cant the calls be reviewed for a clear understanding on why I'm requesting to be compensated. The representatives that handled my calls prior to obtaining my vehicle did a poor job and was not very knowledgeable of the matter. It took several calls into Exeter before speaking with someone who communicated effectively. As stated previously, the leadership team is put in place for a reason and if there were any doubts on what was correct, the calls should've been handled by another team member.  

      In regards to the damages, I made several calls to Exeter to understand what I needed to do after notes on my account indicated that calls were made to me, but no one was ever able to make contact. I found that to be very strange because no one ever left a voicemail indicating whom to callback.  Therefore, I continued calling to file the report. I was finally successful and provided the correct information on 10/30/2023 of who to contact.  Agent information below.

      To whom it may concern,I am writing to address a discrepancy in the payment application on my account with ********************** for my Dodge Caravan. On 04/05/23, I made a payment of $1200 specifically to cover outstanding late fees. However, the payment was incorrectly applied towards interest, which resulted in an outstanding balance on my account. This mistake has caused the balance to continue accruing additional charges.Furthermore, I would like to highlight that two of your employees had confirmed to me that the fees would be corrected and removed no later than 9/25/23. Exeter has thoroughly investigated the complaint and made the following determination.

      Please note that this is a simple interest account, as set forth in the Contract,which means interest accrues daily and must be collected first out of each payment received. Exeter applies all payments received as follows: first to earned and unpaid interest, second to principal, and third to other amounts owed under the Contract (e.g., late fees). Late payments, partial payments, and extensions will impact the amount of interest accruing on the outstanding principal balance.

      On January 16, 2023, ******* account was granted a two month extension to cover the November 22, 2022 and December 22, 2022 payments.  The payments were to resume on January 19,2023 for the Januarys due date.  A review of Exeters records indicates that ****** processed a payment on March 31, 2023 for the remainder of January 19th payment due date.  As a result, a late fee was assessed to the account on March 1, 2023 for the February 19th payment due date, and a late fee was assessed on March 29, 2023 for the March 19th, payment due date.

      Per the terms of the Contract, if payment is not received in full within ten days after it is due, ****** will pay the greater of late fee of $10.00 or 5% of the scheduled payment.  Late fees do not accrue interest.

      Subsequently,a payment in the amount of $1,200.00 was processed on April 5, 2023.  That payment was applied to the February 2023, March 2023, and part of the April 2023 payment due date.  Due to the status of the account that payment was not applied to the late charge balance as any payment received is first applied to the past due balance as previously stated above.

      Regarding the **************** Representatives (CSU) advising you that your request will be completed, our records do indicate that several requests were made advising to have the $1,200.00 payment reallocated to satisfy the late charge balance.  Due to the past due status of the account the reallocation could not be completed using that payment.

      Additionally,on September 27, 2023 a payment in the amount of $342.10 was processed on the account.  The payment was requested to be reallocated in order to satisfy the late charge balance.  On September 29, 2023 the request was fulfilled and the late charge balance is now $0.00.

Exeters records were reviewed, and it was determined that the information reported to the CRAs is accurate.       This is concerning an known predatoryal subprime lender Exeter Finance llc with known unfair usury practices. ****** has multiple settled and unsettled lawsuits for this very reason upon researching several complaints. ****** and dealer never provided written copy of loan agreement to party. Was provided with flash drive that required payment to view and expired two weeks after purchase. After previous bbb complaints lender emailed purchaser to call to resolve complaint but only gave options of when and where late payment arrangement would be paid. Payment arrangement extension was voided due to lenders employees giving purchaser wrong information assuring agreement would not be voided. This was documented and lender still would not honor mistake. Purchaser has been through financial difficulties and stress Cosiner is considering litigation Due to loan agreement being incorrect from possible fraudulent activity. Dealer and/or lender switched purchaser and cosigner on loan agreement documents. Dealership or lender never provided purchaser or co signer written loan agreement. Was provided flashdrive that charged a fee to view and expired two weeks after purchase. Would have been IMPOSSIBLE for cosigner to be switched to buyer with a closing auto loan being paid off towards new auto loan plus a home mortgage with an income slightly above minimum wage. My opinion is that this was done without consent due to cosigner having auto insurance *** purchaser not. Foul play is involved with this loan agreement with outstanding unfair apr rate of 20% making overall final loan price at a whopping 58,000$ for an at the time 20,000$ vehicle. Purchaser would have declined loan knowing it's not fair and knowing they could not afford payments. A 2,500$ tire service warranty was added to loan without agreement or acknowledgement from party. After previous bbb complaint of lender pdf file of loan agreement has been added to account profile which raises awareness of inaccurate paperwork.

      On February 12, 2022, ***** signed a Retail Installment Sale Contract (Contract) for the purchase of a vehicle with ********************************************** Buick of ************* which assigned the Contract to Exeter. Exeter is an indirect auto finance company that purchases Contracts from dealerships. Exeter does not communicate with or negotiate price, Contract terms with borrowers prior to the consummation of the Contract between the borrower and the Dealer.

      All required information regarding the terms and conditions of the Contract, including without limitation the APR, was disclosed on the Contract as required by law. The signed Contract shows that all parties agreed with those terms and conditions. The APR charged does not exceed the maximum rate allowed by the State of *********. Hineks claim of predatory lending and usury stated in the complaint are unsubstantiated.

      The Contract included a Tire and Wheel Protection plan that was itemized separately. This is an optional purchase and can be cancelled by *****, they will need to contact the administrator at *************. If cancelled, the refund amount will be prorated and applied to the principal account balance.

      On April 6, 2023, ***** spoke to an Exeter representative regarding the account delinquency. ***** was advised of the total amount due and that the amount included the past due March 2023 payment and the upcoming April 2023 payment.***** was offered and they accepted a one-month payment extension for the past due March 2023 payment, stating that they would complete the April 2023 payment prior to its due date. The extension was processed and was not voided as stated in this complaint.

      All other allegations presented in this complaint are consumer issues between ***** and the Dealer and should be addressed with the Dealer directly.

      i financed a car through this company and due to covid lost my job and they were no help! my car got repoed a week before i had to go into the hospital to give birth. so as soon as they got the car back in november 2022, they said i made a payment in december 2022 which is false information, if it was repoed in the beginning of November 2022. then they kept updating my closed date of the account, which i have all the proof and screen shots of it keep being updated, because it now says it was closed and charged off as of august 2023 which is highly not possible. they are deliberately changing the closed date on purpose because it has changed 3 times now! this company ***** most of the people i have talked to that they have done this to is people of color!       On March 12, 2021, Page signed a ********** Retail Installment Contract (Contract) for the purchase of a vehicle with CarMax Auto Superstores (Dealer),which assigned the Contract to Exeter.

      Pages account charged off on July 31, 2022, and the vehicle was repossessed on October 28, 2022, both due to non-payment. As a result of the repossession, the vehicle was sold at auction, and Page was sent an Explanation of Calculation of Surplus or Deficiency Notice that outlined the gross proceeds and the balance due after the auction sale of the vehicle.

      As of the date of this response, Pages account remains open and has not been reported as closed by Exeter to the credit reporting agencies (CRAs) as stated in the complaint. In addition, the last installment payment received on Pages account was on April 19, 2022. Exeter is unable to substantiate Pages claim of being told that they made a payment in December 2022, after the repossession as stated in this complaint.

      Exeter reports account information to the CRAs at the end of each month and will reflect the status and balance of the account at that time. Any discrepancies between the information reported by Exeter and what is reflected on Pages credit file will need to be addressed by the CRAs directly as each reporting agency is governed by their own guidelines and procedures.

      Exeters records were reviewed, and it has been determined that the information reported to the CRAs is accurate, and no adjustments are necessary. Exeter will not honor Pages request to remove the valid tradeline from their credit file based on the claims presented in this complaint.

      I purchased a vehicle in January 2018 and it was financed through Exeter Finance. Due to health issues and being unable to work, I was forced to surrender the vehicle to them March 2021. Since that time, Exeter notified me that they sold the vehicle at auction and received over $6,000 for the vehicle. This left a balance of $3844. This debt was sold to NCB Management and they are reporting that $3844 is due. I disputed this information with CFPB and also with the credit bureaus and Exeter has since updated my credit report stating $9,000 was written off on my report. I am requesting that they delete this account from my credit reports due to this error.

      They are reporting different amounts on all 3 credit bureaus. The vehicle was sold at auction and the remaining balance was $3844. The debt was sold to ncb management. On my credit report Exeter is saying the balance is 9k and it was written off. Due to this discrepancy I am requesting it be deleted from my credit reports. This was verified with fcra that states information has to be accurate.

      The Vehicle was repossessed on March 19, 2021, due to voluntary surrender. On March 19, 2021, a Notice of our Plan to Sell Property was sent to ******, which explained the right to redeem the Vehicle by paying all amounts owed before the expiration date. The notice explained that the Vehicle would be sold at auction sometime after March 31, 2021, if the Vehicle is not redeemed.

      The Vehicle was sold at auction on April 14, 2021, as the result of the voluntary repossession. The auction proceeds were applied to the account after the sale.On April 20, 2021, ****** was sent an Explanation of Calculation and Surplus or Deficiency advising of the deficiency balance in the amount of $5,745.72, for which ****** is responsible for after the sale of the Vehicle.

      Exeter has an obligation to the Fair Credit Reporting Act which requires all accounts to be reported accurately and factually. Exeters records were reviewed, and the information reported to the ************************* (CRAs) was confirmed to be accurate.

      Additionally,Exeters records indicate that the Account was charged off on April 16, 2021,in accordance with Exeter policy and applicable law. An account charge-off status does not relieve customers from contractual obligations owed; indeed,Exeter will still seek remedies to collect money owed on charged-off accounts.

      As of August 24, 2022, the account was sold to NCB ************************* (NCB). The account was reported to the credit reporting agencies as sold and was closed by Exeter with a zero balance. Exeter does not delete tradelines on accounts that are sold, paid, or settled in full. ****** can contact NCB to discuss any updates regarding their tradeline at **************.
