Exeter has thoroughly investigated the complaint and made the following determination.

      Exeter is an indirect automobile lender that purchases retail installment contracts from automobile dealers. Any inquiries regarding obtaining the original contract for the vehicle should be addressed to the dealership.  ************ may contact ******************** directly at **************.

      Additionally, not having possession of the original contract does not release Weatherspoons contractual obligation for the vehicle that was purchased.  All required information regarding the terms of the loan were disclosed on the Contract as required by law and the signed Contract shows ************ agreed with the terms and conditions stated. At this time, we are unable to honor Weatherspoons request to remove the tradeline from their consumer credit report.

      This business is calling me at 6:30am to collect a debt, they are also calling me more then the allowed in one week. Exeter finance is calling 3 times sometimes 4 times a day from Monday through Saturday. ********** law is they can not call until 8am an no more then 7 times in a week.

      On January 23, 2023, ******* signed a ********** Retail Installment Contract (Contract) for the purchase of the 2017 Jeep Cheroke (VIN# *****************) (Vehicle) with Carmax, which was later assigned to Exeter. The Contract payment schedule provided for 72 monthly payments of $571.40 beginning March 9, 2023. 

      Exeter sincerely apologizes for any inconvenience the phone calls may have caused. As a result, Exeter has waived $171.42 in late fees from Budmarks account.

      Unethical and misleading business practices. My experience with Exeter has been frustrating and caused significant harm to my financial stability and life. When I asked to negotiate payments and go ahead and refinance, due to falling behind a month as a result of being hospitalized on life support for almost a month, which would have allowed 60 days before a payment would be due, they took a $900 payment then informed me that they do not refinance. I was misled when I initially entered in an agreement to purchase a 2018 vehicle. Before signing, I specifically asked about refinancing after a year due to the outrageous 30% interest and monthly payments of $859. I was assured that they could refinance after a year lower both of those. I would have walked away had I been told that to begin with. My mother offered to buy the vehicle, but we encountered further obstacles. Exeter and my mothers bank need notarized bill of sale, which is impossible as the co-signer is not around and Exeter said sorry we have no way to help you. This experience has been characterized by misleading information, intrusive and disruptive communication practices, and a failure to honor their commitment regarding refinancing. These actions have not only had a negative impact to my credit but also resulted in my loss of employment and no them wanting possession of the vehicle. Please take appropriate action to address the unethical conduct. Resolution to be refunded everything paid so far due to misleading information when I was going to walk away from the sale, as well as the loss of my job. Despite attempts to negotiate payment terms that are manageable, they have been uncooperative and unyielding. Their constant and relentless phone calls have been not only intrusive but also counterproductive to my livelihood. I told them I work during the day and asked them to refrain from calling multiple times in a row as it could jeopardize my job. They continued their calling, resulting in my termination

      I have added a receipt of all payments made since purchasing truck. Right off Exeter website my account. Its a total of  $22,536. I was way off on how much Ive already paid. I dont even have a copy of the paperwork I signed. It was supposed to be sent to me. I finally found them on my account online and they have me paying more for interest than than what I financed for the truck. I was either blatantly lied to when I got the truck and told yes they could refinance me after a year of making payments. Well that was a big lie. I wasnt going to buy it because of the rate and payment but they assured me I could refinance with them after a year. All my payments always processed with no problems. All of a sudden out of the blue they are being returned. My bank never returned anything Ive done a thorough investigation. Then I am hospitalized for over a month 2 weeks spent on life support. When I was released from the hospital on April 25th I contacted Exeter asked if they could help me and go ahead and refinance as it had been more than a year and I had paid $22,500 of the interest. I was told my payment was late and that I needed to make my payment first. Well I paid $900. Asked what all I needed to do in order for them to refinance it and it wasnt until I made that $900 payment they informed they dont refinance. And its been one issue after another. They made it so I have to have the co-signers signature or I can not do anything. Well nobody can reach him. Thats another lie they told I made sure to ask if the title would be myself or the co-signer so there wouldnt be this issue and I was absolutely thats how they do it. Well no its not they made it read myself and the co-signer making so cant refinance cant sell it cant do anything. Well Im 2 payments behind as of the 8/25 so not quite yet. However my truck is in repo status. They call constantly back to back after me asking them not to as I worked during the day. They completely ignored me and continued until I was let go from my job. Now I have no job and they are about to take my transportation. They really should have to either refund me everything Ive paid so far or provide me with the title to the truck. Almost $23,000 I paid in a year. I only financed ****** so ***** of the total amount financed and still have 60 more months of payments. They are taking advantage of people with low credit scores and the. Making things worse for them. Not to mention Im homeless now after being let go due to their constant calling and blatant disregard to being asked not to call until after 6pm. Please help me they are violating everyones rights they finance and are just out right crooks. Now they are going to take my truck because they have made it impossible for me to be able to do anything so I cant make a payment and now I wont have transportation to be able to get another job. Also if Im almost 60 days late and they are saying my amount due now is $2,784.68. What kind of fees are they really charging. Also they have made my total amount owed go from a little over ****** after last payment being made to now its over $20,000. Someone had to see the problem here they are robbing people and getting away with it. Well if we have to keep our part up with payments they should have to keep their commitments also and instead to cause you as much problems as possible and then steal your vehicle. Exeter has thoroughly investigated the complaint and made the following determination.

      Exeter is an indirect auto finance company that purchases Contracts from dealerships. Exeter does not communicate with or negotiate Contract terms with borrowers prior to the consummation of the Contract between the borrower and the Dealer. All required information regarding the Contract terms were disclosed on the Contract as required by law. The signed Contract shows that all parties agreed with the terms and conditions.

      Regarding Englishs request to refinance, Exeter does not refinance our own accounts, however, English may explore refinance options through other financial institutions of their choice.

      Regarding Englishs claims of excessive calling, Exeters telephone records were reviewed,and it was determined that Exeter is adhering to all applicable laws under the Telephone Consumer Protection Act (TCPA) and the Fair Debt Collections Practices Act (FDCPA). There is no record of Exeter exceeding the maximum number of calls allowed on any given day. Additionally, there is no record of English ever asking for their phone number to be placed in a Do Not Call status.

      I acquired this car loan in 2018. We have paid the payments, we did have an extension for 7 months, but have paid for the extra 7 months. This company now says I still owe them over $4000 after the account has matured. They misappropriated the money on this account and added most all of it to interest and not much at all to the principal. I have paid $23,000 to this company. I want this company to close this account because it has been paid in full. They have now reported to my credit and I lost 56 points. I have seen other people claiming the same, that they misappropriated the money given like this.

      On December 16, 2017, ********* signed a Retail Installment Sale Contract Simple Finance Charge (Contract) for the purchase of the 2008 Infiniti G37 Coupe (VIN# *****************) (Vehicle) with City Auto Sales, LLC, which was later assigned to Exeter. The Contract payment schedule provided for 60 monthly payments of $395.14 beginning January 15, 2018.

      This is a simple interest loan which means interest accrues daily and must be collected first out of each payment received. Exeter applies all payments as follows: first to earned and unpaid interest;second to principal; and third to other amounts owed under the Contract (late fees). Late payments, partial payments, and extensions will impact the amount of interest charged.

      Once the loan reaches maturity, ********* is required to pay the entire loan balance, including all earned but unpaid interest and any fees owed under the contract as the final payment. Normal collections guidelines will continue to apply until the loan is paid in full.This may include, but is not limited to, collections notices and repossession.

      Exeters records were reviewed and determined that all payments received were posted in accordance with the terms of the contract and Exeter policy.       I am rejecting this response because:   No one can explain why the balance was so much, there is absolutely no reason that the balance should be $4000, and no one can explain anything, all you can say is it is interest and late fees. From when, I need you to break this down for me, you have to show me proof that this is true and accurate and all your people can say on the phone is the same thing over and over. I have read countless complaints that you have done this to other people, and I am ready and willing to get an attorney to fight this, I think I can get enough people with proof to have a class action against you in the ********************! You are trying to scam me out of a lot of money, and I am not going to stand for it, I have worked hard for my money, and I have paid you over $23000 dollars for a 2008 car. I have paid for it plus some.  I want written documentation that shows down to the ***** how you think we owe this money.

      I am rejecting this response because:   Exeter has stated that there are tools that show me where the balance is  coming from, yet no one has shown me where the balance is actually coming from. I would like a breakdown that shows me exactly where the balance is coming from, this company is claiming I owe them $4700 more on top of the $24000 already paid. They keep claiming I owe this money, and that they can account for it, but no one has accounted for this extra amount as of yet. I am not satisfied with this, and I will not be satisfied until they can show me the break down of what they say I owe.

      Exeter Finance would not refund me the overpayment I made on June 28, 2023. I contacted the customer service line about a month after I noticed that I had overpaid. On the first call, when I asked to speak to a manager the employee pretended to be a manager. I hung up on that employee and called back only for the next employee to pretended to be a manager. I hung up on him and called back to an employee who then transferred me to a real manager and I was able to inform her of my request to dispute my final payment of $540. I explained that I paid $540 instead of paying $536.94 (my final payment via their website) my last payment was supposed to be on July 15, 2023. I thought I was being productive by making my payment early on june 28, 2023 but they would not refund me the $3.06 and I wanted my money back. They refused to refund it so I contacted my bank who did refund me a temporary credit until they respond to my bank. They've sent me the title to my vehicle and updated all credit bureaus as paid in full and a ZERO balance prior to me even contacting them. Today they Updated my account to the credit agency as past due with an amount of $155. I do not owe them anything and they need to remove it from my credit reports or I will be filing a lawsuit with the courts! This company is predatory and unprofessional and I will make an example out of them if this is not rectified.

Exeter has thoroughly investigated the complaint and made the following determination.

      Exeters records indicate that ****** made a payment on June 29, 2023, in the amount of $540.00 that paid the account in full. On July 29, 2023, ****** contacted Exeter and advised the **************** Representative (***) that their records indicated that the account was overpaid by $8.00, and they were inquiring about the overage refund. The *** advised ****** that the account was paid in full, however, there was no overage refund due. ****** disagreed, and advised if Exeter did not refund them the $8.00,they would dispute the full $540.00 payment made on June 29, 2023. Exeters telephone records were reviewed, and we could not substantiate ******* claims of any *** acting as a manager during any phone conversations.

      On August 31, 2023, the final payment for $540.00, was returned by ******* bank unpaid. Additionally, on August 31,2023, ******* bank submitted another payment in the amount of $399.00. This left an unpaid principal balance on the account of $141.72. On September 6, 2023,Exeter waived the unpaid principal balance and accrued interest in the amount of $147.07 and the account is now closed.

      Regarding ******* credit reporting, on September 11, 2023, Exeter submitted an update to the ************************* to reflect the account closed as of June 29, 2023. ****** should allow ***** days for this updated information to reflect on their credit report.

      Regarding Degrates credit reporting, Exeter is bound by the Fair Credit Reporting Act which requires all accounts to be reported accurately to the ************************* (CRAs). Account information is furnished to the CRAs every month and will reflect the status of the account at the time of reporting.


      Exeters records were reviewed, and the information reported to the CRAs was confirmed to be accurate. As such, Exeter will not honor Degrates request to remove the valid tradeline from their credit file or cease reporting based on the claims presented in this complaint.

      I made a car payment of $502.17 on my car on july 14th the date my payment was due, the amount got taken from my bank account, i also have the screen shot conformation and the email confirmation that my payment was made, i even got my next payment date which was august 14th. Two weeks later after making my payment around july 24th i got an email saying my payment was sent back. Exeter told me it was because of insufficient funds from the bank but the payment was taken from my bank account. Then finally i was told the payment was sent back to the bank and the bank sent it back and $300 something dollars went to interest and only $100 something went towards my car payment because it was late. But it was paid on time and i was never late before making a payment. Now due to this my car payments are behind and its a struggle catching them up when i was never late or behind before and im getting told different stories of what happened even with the proof i have.

Late payments, partial payments, and extensions will impact the amount of interest accruing on the outstanding principal balance.
      If ********* believes there are any inaccuracies with a payment and how it was allocated, please provide the specific information that ********* is disputing and an explanation of the basis for this to be investigated.

      This is ******* ***************************, I filed for Bankruptcy on September 14, 2023. Im receiving harassment letters from Exeter Finance LLC. Im requesting this company to cease & stop contacting me about a debt I dont owe. Im in pre litigation with Autonation. In the court case or arbitration meeting all matters will be resolved and addressed by my attorney. An automatic stay has been ordered by the petition filing of my bankruptcy. If Exeter Finance LLC continues to contact me I will file harassment charges and a lawsuit against this company. Im not 100% sure of the contract I signed with Exeter Finance LLC because my signature has been forged on the retail purchase agreement.       I bought a car from ******************** on 27 November 2020 with financing through Exeter Finance. The interest rate for this purchase was at *****%. We have been paying faithfully for the past three years. In May of 2023, I attended a military finance class offered through the military that the Servicemember Civil Relief Act (SCRA) has certain benefits for active duty military personnel. Seeing that I'm currently Active Duty for over 25 years, she looked into if any of those apply to us. It turns out, my home of record ************* provides extra relief for debts incurred during your enlistment as well, to include adjusting your APR to no more than 6%. Once we found that out, we filed the necessary paperwork per the law to all of our companies that we have debt with. To date, we have received favorable responses from all of the companies except Exeter. They have stated that they have sent me correspondence through the mail (which I have never received) that requires me to submit my W2. This is not a requirement for the key provision of the *************. I have been active duty for 25 years and there are no Navy bases in **** so that would be virtually impossible. I am simply requesting that Exeter honor the law in accordance with the key provision of the *************. I'm trying to avoid getting a lawyer involved, but I am willing to, to ensure that this company honors the law by adjusting the interest rate to the required 6% and applying any overpayments/interest accrued back into the loan.

      I am rejecting this response because:   First, I was never informed that was denied, I was informed that it was being upheld until Exeter received a W-2 from me.  Second, per the Ohio State Guide for SCRA (attached), it does not require the servicemember to submit their W-2 or be a current resident, only that their residency at the time of active duty is from the *************.  I have submitted my home of record of entry into military service from the key provision *************.  This is a federal document and should suffice to establish my entry into service from ****.  If no resolution is possible, then I will be forced to reach out to the military lawyers here in ************ for further action.  I thank Exeter for their timely response and hope we can come to a solution before any legal action.  Additionally, I provided my original letter and supporting documentation for reference.  Thank you for your time in this matter.

      On March 24, 2021, ***** signed a Retail Installment Contract (Contract) for the purchase of a vehicle with CarMax, which assigned the Contract to Exeter. The vehicle was repossessed on May 10, 2023, due to non-payment.

      On May 25, 2023, ***** paid the amount required to reinstate the account, and the vehicle was released to ***** thereafter. Prior to the reinstatement of the account, ****** name was removed from the title in preparation for the auction sale. On July 7, 2023, Exeter sent ***** a ***** of ******** (***) to complete and return along with a copy of their drivers license. ***** was advised that the original *** had to be signed to transfer the title back to their name. On July 21, 2023, the *** was resent to ****** address on file.

      Exeter received the executed *** and copy of Ortizs drivers license on July 31, ******** title transfer back into Ortizs name was completed on August 18, 2023. We are unable to substantiate ****** claims of being provided different responses or unfair business practices as stated in this complaint. Exeter is committed to providing excellent customer service and apologizes if the services received did not meet Ortizs expectations.

      I am rejecting this response because:   This took an unreasonable amount of time. I had to pay extra money and utilize resources I do not have! I want reimbursements for all the car services I had to use during this time, the stress this company caused me and also all of my personal belongs were destroyed! I want at least 2min the removed from the balance owed or current balance satisfied or late fees cleared. Just because the vehicle is back in my name what about the 3min the I was without a car!? Exeter is still asking me to pay for their mistakes.
