I am not liable for any debt with Exeter Financial, I don't have the Jeep Patriot I had a contract with Exeter for it was reposed. I called them on more than one occasion giving them all that I had towards the Jeep Patriot. At the time I only had one source of income, I traded my **** Flex as collateral which I only got $2000 off of the trade and ended up in a ****** car note having to pay 475 a month. I was placed on a extremely high contract that was completely out of my finances support by Napoleton Auto. They indeed accepted partial payments but failed to be satisfied with partial payments and sent a tow truck to repose my Jeep on January 1, 2023. Before this occurred I reached out to them and also to the dealership Napoleton Auto and everyone at Exeter Finance refused to help with adjusting the payments. Giving me nothing but run around and we cant refinance and I should speak to one of the two parties in question Napoleton/Exeter as to why the payment couldn't be adjusted. After they retrieved my vehicle they went fourth and sold my vehicle at auction and left me with a sum of $9,000 usd on my credit to be repaid. Due to them taking the vehicle I was left to quite my job because I had no real form of transportation after the repossession. Lawfully I feel this was not acceptable for a company that has been around for years. They have tampered with my children and I living situation by taking my Jeep and leaving such a high sum on my credit to be paid after they did get some type of payment from me.Business Response

Exeters success is based on customer satisfaction with our products and services, so the issues presented in this complaint are taken seriously and every effort is made to provide a prompt and equitable response. Exeter has thoroughly investigated the complaint and made the following determination.
Regarding the repossession, on November 08, 2022, Exeter mailed ***** a Notice of Right to Cure Default (Notice) to the address on file, advising they had until November 21, 2022, to pay the total amount due of $496.19 or we may repossess the collateral secured by the Contract and exercise all of our rights under the law.
On October 10, 2022, ***** called and spoke to a ******** Service Agent (***)regarding how to reduce the monthly payments on the account. The *** advised ***** that she could try refinancing the auto loan and offered a Due Date Change after the first payment is processed. As of December 22, 2022, a full payment had not been received, as such, the Vehicle was assigned for repossession.
The Vehicle was repossessed on January 3, 2023, due to non-payment. On January 4,2023, a Notice of our Plan to Sell Property was sent to *****, which explained the right to redeem the Vehicle by paying all amounts owed before the expiration date. The notice explained that the Vehicle would be sold at auction sometime after January 27, 2023, if the Vehicle is not redeemed.
The Vehicle was sold at auction on February 08, 2023, as the result of the repossession. The auction proceeds were applied to the account after the sale.On February 13, 2023, ***** was sent an Explanation of Calculation and Surplus or Deficiency advising of the deficiency balance for which ***** is responsible for after the sale of the Vehicle.

Hi , I financed the car from Exeter finance. I had a few late payments on the car that I tried to work out with Exeter. Unfortunately all of those late payments were sent to the end of my loan and when it was time to complete the loan they notified me that I would have to pay all the late fees. Those late fees accumulated to more than the original purchase price was. I had no choice but to repo because I couldnt not afford to pay that all at once. I asked exeter to work with me on that and they gave me no remedy. I feel that this was unlawful and exeter should have to answer for this.Business Response

To Whom It May ****************** July 14, 2023, Exeter Finance LLC (Exeter) received notice regarding a complaint filed through the Better Business Bureau (BBB). Exeter would like to thank ***************************** (******) for the opportunity to address their concerns.Exeters success is based on customer satisfaction with our products and services, so the issues presented in this complaint are taken seriously and every effort is made to provide a prompt and equitable response. Exeter has thoroughly investigated the complaint and made the following determination.
The Contract is a daily simple interest agreement, late payments will increase the interest charged, total number of payments, and total amount paid. In addition to the eight payment extensions processed on the account per ****** s request,a balance remained after the loan reached maturity, due to the late payments received and interest accruing during the extension periods. By signing the Payment Extension Agreement forms, ****** acknowledged that daily interest will continue to accrue during the extension periods and may result in a larger final payment.
Exeter encouraged ****** during the extension process, to process extra payments throughout the life of the loan in order to avoid a larger final payment at the maturity date. Exeter also suggested to ****** the option refinance with a different financial institution.
Under separate cover, a copy of the executed Contract, and a Statement of Account showing all activity through July 21, 2023, will be sent for Majieds review.
We trust this answers any questions associated with the complaint. If ****** has any questions about these or any other concerns, Exeter encourages them to contact the Office of the President at ************.

I currently have a financed vehicle with Exeter Finance. I recently lost my job, and have fallen behind on payments. They have been calling my relatives giving information on my account. Such as amount owed, and that I am behind on my payments. I am the ONLY authorized individual on this account. I never gave them any of my relativea information for contact, or agreed to have *************** information shared. This has been a HIGHLY embarrassing experience to have my relatives call me stating very detailed specifics about the conversations had with this company. I believe this is against the law for this company to act in this manner. Please help me with resolving this issue. Thank you!Business Response

To Whom It May ****************** July 13, 2023, Exeter Finance LLC (Exeter)received notice regarding a complaint filed through the Better Business Bureau.Exeter would like to thank ************************* (******) for the opportunity to address the concerns outlined in the complaint. Exeters success is based on customer satisfaction with our products and services, so the issues presented in this complaint are taken seriously and every effort is made to provide a prompt and equitable response.
On June 11, 2016, ****** signed a Retail Installment Contract (Contract) for the purchase of a vehicle. The Contract payment schedule stated 72 monthly payments of $351.61 beginning July 11, 2016.On February 1, 2021, ****** requested and was granted, a payment due date change (***) from the 11th to the 25th of each month, effective February 17, 2021.
This is a simple interest account, which means interest accrues daily. Late payments, extensions, and the number of days between payments impacted the amount of interest charged and the account balance. As indicated in the Contract, payments are applied as follows; first to earned and unpaid part of the Finance Charge, second to the unpaid part of the Amount Financed, and then to other amounts owed under the Contract, if applicable.
The Finance Charge, Total of Payments, and Total Sale Price shown on the Contract assumes that every payment will be paid on the day it is due. The Finance Charge, Total of Payments, and Total Sale Price will be more if paid late and less if paid early.
A total of 71 payments have been completed on the account, of which multiple payments were received after the due date. In addition to late payments, ****** requested and was granted 14 payment extensions on the account. During the months extended, interest continued to accrue.
****** was sent the first of three Notices of Upcoming Account Maturity (Notice) on May 27, 2023, explaining the account would mature on August 25, 2023, not July 25,2023, as stated in the complaint and they would be required to pay the remaining account balance in full. A second Notice was sent on June 26, 2023,with the same maturity date. The original maturity date of June 11, 2022, was extended due to the *** and 14 payment extensions ****** received.
Exeter does not offer refinancing; therefore, will not refinance or otherwise change the existing terms of the Contract. ****** has the option to sell or trade the vehicle in. In addition, ****** can surrender the vehicle voluntarily. If this option is chosen, the account will be reported to the credit reporting agencies (CRAs) as a voluntary repossession and such report is derogatory in nature.****** would be responsible for any deficiency balance remaining on the account after the auction sale of the vehicle.
Exeter will continue to accept payments on the outstanding balance after the maturity date, however, the account will remain delinquent until paid in full and will be reported as such to the CRAs. In addition, there is a possibility that the account will be reviewed and assigned for repossession if the balance is not satisfied in a timely manner.
Exeter has determined that the account balance is accurate due to late and extended payments. We dispute ******* claim that the balance is due to Exeter enrolling them in a program as we are unaware of such program.
Under a separate cover, Exeter is sending ****** a copy of the executed Contract and a Statement of Account showing all account activity through July 18, 2023. Also included will be a Simple Interest Tool that *** help to better understand how interest is calculated and how payments are allocated.
We trust this response answers any questions associated with the complaint. If ****** has any questions about these or any other concerns, Exeter encourages them to contact the Office of the President at ************.

In addition to late payments, ****** requested and was granted a Due Date Change (***) and 14 payment extensions on the account. During the months extended, interest continued to accrue. As of the date of this response, the account is current, with outstanding late charges for payments completed more than 10 days after the due date.
****** was sent the first of three Notices of Upcoming Account Maturity (Notice) on May 27, 2023, explaining the account would mature on August 25, 2023, and they would be required to pay the remaining account balance in full. The original maturity date of June 11, 2022, was extended due to the *** and 14 payment extensions ****** received.
Exeter does not offer refinancing for pre-existing accounts; therefore, will not refinance or otherwise change the existing terms of the Contract. ****** has the option to sell or trade the vehicle in. In addition, ****** can surrender the vehicle voluntarily. If this option is chosen, the account will be reported to the credit reporting agencies (CRAs) as a voluntary repossession and such report is derogatory in nature. ****** would be responsible for any deficiency balance remaining on the account after the auction sale of the vehicle.
Exeter will continue to accept payments on the outstanding balance after the maturity date, however, the account will become delinquent if the balance is not paid in full by the maturity date and will be reported as such to the CRAs. In addition, there is a possibility that the account will be reviewed and assigned for repossession if the balance is not satisfied in a timely manner.
Exeter has determined that the account balance is accurate due to late and extended payments. Exeter disputes ****** claims regarding the sale of their account as the account has not been sold since it originated.
We trust this response answers any questions associated with the complaint. If ****** has any questions about these or any other concerns, Exeter encourages them to contact the Office of the President at ************.
Sincerely,
Office of the President

I am rejecting this response because:
The account you are reporting is identified as a ''repossession, yet you continued to report late payments. Since the vehicle is no longer in my possession, it would be impossible for me to default on payments after the fact. I have the right to an accurate credit file and discrepancies like this are unacceptable. Please immediately remove this account in its entirety from my credit file. This is against the FCRA

For the past 7 months, I have had issues with this company accurately maintaining my payment history. For the past 3 months, I've been charged fees for payments that were already made, payments that were withdrawn using *** while I asked that the *** be closed in December 2022 because they consistently used the wrong account number, costing me bank fees. No response to emails, no call backs and every customer service rep I spoke to did not take accountability nor did they try to fix this. Each person I spoke to simply said I owed money, how can they assist me in making a payment.Business Response

I am rejecting this response because: I was told by an Exeter **************** representative named Maddy several weeks ago that my request to cancel my auto withdrawal took effect in December 2022, but according to this reply, it is just now being cancelled! Further, this reply does not address why all my submitted payments weren't added to my history, correcting it and reimbursing me for fees I should not have had to pay. This response does not correct my credit bureau information submitted by them either. I would like written notification that corrections have been made and I would like to be reimbursed for false fees I've paid because of their errors.Customer Answer

I called into Exeter Finance in May 2023 and was told by their representative named *****, that my request to discontinue automatic withdrawals was received by Exeter in December 2022 so it doesn't make sense that Exeter's response is that my request was made in May, 2023. Clearly, there is confusion about what occurred in May. Also in May, during the same conversation with *****, I submitted a screenshot of my bank statement showing a withdrawal by Exeter after she confirmed that 2 payments had been received by Exeter. That withdrawal, and the other withdrawal in May that wasn't cancelled are listed on the original attachment I submitted detailing payments from December 2022 to June. All proceeding months have been paid. My credit history is still incorrect and as of this writing, Exeter has a balance on my account showing more than $1,500. If all my payments have been applied, my balance would be zero. I provided six months of payment information to Exeter plus the payments for ***** July have been received. Lastly, the fees they charged me of $140 should be returned to me. This is not resolved, at all.Business Response
