Hi ***, I'm happy we have been discussing this transaction the last couple days. It was over a year ago and I had to remember what happened and you reminded me.
1. Yes, after you closed. I sent the deposit to the wrong party in error. I sent you an apologize email. Human errors are made sometimes. I'm not perfect.
2. The day of your closing. An urgent repair was needed however it ran into a grey area. You were about to close. Once you close my management agreement expires and funds are no more in my authority. The listing agent and buyers agent should have had your best interest in mind and should have postponed your closing. Your prestigeous and im sure a cash buyer so it should have been very easy. Instead they all called me to demand I authorize repairs on your home which I do not have an agreement for. In my point of view it got ugly because they did not move the closing and demand the past seller and property manager to make proper repairs and then have you close. Instead we had heated conversation that I am to fund and repair your home that I have no permission or agreement on later in the day. I tried explaining to your buyers agent that I could cause damage to your home or not get reimbursed from the past seller because after closing it is now your home... So in the end I am the villian because the real estate agents just wanted there commission today versus having your best interest in mind and not having you close until repairs were made. I hope you can now understand my position, the only person not receiving compensation but in trouble for not taking on all the risk...
4. Leases/Rents - These were all in place with my owner and I'm sure you reviewed them during your escrow period. Our owner approved them and set pricing based on there needs. You have expressed your dislike of them. If you were not comfortable with them at time of purchase I would think you would have purchased another home? I cannot control there approved forms or reasoning behind the current rents. Maybe they were long term tenants and my owner kept rents the same to keep good paying tenants.
5. What I have learned - If an owner of mine is ever selling another home and a last minute repair arrives I will demand to speak to the buyer to make sure they are protect and not forced to close.
I hope you do great with these units. There in a great area of town and I'm sure you gotten great appreciation since you have closed.
