I am writing a complaint from the business here in Huntsville Alabama. I called in January to report i was and needed to know my options for making payments forward on my account to not get behind I was told i can get a deferment or payment plan of 100.00 but know they say i owe 174 with an upcoming payment in march pending. I branch manager was disrespectful to me and degrading me over the phone when i needed help. I need to file a police report for aggressive language from said branch owner. I spoke with a supervisor who is trying to help but the branch manager is not responding to her and she is from the main office. to help get me a deferment option.the company is not trying to take responsibility of the actions and choice of words used towards me and not looking to help for me to get payments on my account. Republic Finance will not let me make a payment back in January because they said I missed one month which was December one issue that happenedwith them when they wrote down the incorrect numbers of my checking account number so they did not deduct my payment for November so that was their side that was their fault After finding out on my own that they have filed to garnish my wages because I didn’t make a payment I had to make all phone calls. I talked to the court and I talked to the Board Of Education to see what was going on and nobody called me. Nobodysent me some email. Nobody sent me a letter from their company saying that they were going to go to my wages Republic Finance did not contact me. They said they called but I never answered. I do not answer spam calls that is not. I don’t do that. I don’t answer anybody that does not That I do not recognize. They did not leave a message for me to call them so finally, we work things out. I paid $460 is three payments December January and February so I called today to make a payment and they said no they were gonna take a payment becauseI have to pay for the court Fee Which was due to them having to file papers to garnish my wages for the recent problem. I’m very unhappy with this business and the way they things they do not contact you and their way of fixing things is just not even does not make sense. At no time did I provide such consent, and reporting this information without my authorization is a clear act of fraud. Beginning in August of 2024 for several weeks I called in order to get a settlement amount, the branch manager tried herself and eventually got on in October. At this point my consolidation had expired and I asked if they would be willing to break it down into payments. She advised that isn’t normally how it’s done and told me to contact the 1-833 number. As always, never able to speak with someone on the phone and was directed to email the lady over my account in collections. The branch told me I had until the end of November. December 2, I contacted the branch ti make a payment and was advised they could not take any payments from me and I had contact the number above. Tried several times via email and phone. December 20 I received a letter from an atty. I contacted their office and was told to call the branch. I did and again was referred to the main line. Again no response. January I advised Ms. Bush that I had mailed 2 payments and they haven’t been cashed. She responded with the main number and told me not to mail anything to her being she is remote employee. I asked her to advise the branch due to receiving the letter and they were unable to speak to me, again no response. I called the attorneys office and was told that the suit had been filed due to not hearing from me. The branch states that there’s no record of me speaking to the or no copies of emails to the main branch and that i huge contradicting information when in fact it’s their office doing all of this. I asked that they pause the suit even after providing emails of contact to try to resolve and they have refused and basically don’t care if I get fired oor not. This is embarrassing and I’m not sure what else to do.Business Response

I am rejecting this response because suit was filed against me. The matter has been taken care of with their attorney. However, due to the fact that I was unable to get a response within a timely manner and the Alexandria location did not provide sufficient information to their attorney as requested. Due to this, a suit was filed and is now public knowledge and I do not like the fact that my personal business can now be obtained. It was embarrassing and could have put me at financial risk. The damage has been done not only mentally but also to my credit and/or credit worthiness. None of the communication was recorded on my end with the company and they have my case viewed as non - compliant; which has been reported to other businesses.

Re:Acct: 138-5752-20485 Republic Finance Settlement Agreement and Terms(1/03/2025) Dear BBB: In reference to this account, original balance of $9922.00 as of 4/2022. This account had been paid on time prior to this date. I lost my spouse and I fell into hard times. This account was given to a debt relief company but they failed to settle in a timely manner, so II released them from handling on 12/20/2024, plus I was told I should try and reach out to Republic Finance for settlement. I did numerous times, Many calls back and forth. I even contacted the collection agency who they gave it to but no longer had it because it was too old plus they were not able to reach me personally because I had relocated and gotten a new job and they tried reaching out many times to the relief program that was handling my case, did nothing to work with them. I only been told this recently 12/2024 by ****** ****, ******* ***********. So I wanted to resolve this matter and that is why I made many efforts to resolve because I don’t want to end up in court down the road dealing with this matter. So on 1/2/2025, I sent Republic Finance explaining my situation and me settling this debt. On 1/3/2025, around 2:30pm, I saw that ****, Republic Finance Settlement Supervisor had saw my 1/2/2025, email and wanted me to call her and I did around 2:57pm in 1/3/2025. She was very empathetic to my needs and request to settle. She never mentioned the balance but as I held on to phone call, she was saying let me take off these fees. Equifax was saying balance owed $16,041, online website is saying $9047.00 and past due amount $9,385.00, (original balance $9922.00). When she finished she said they will settle with $4,985.00, which is half of the original balance and not $16,041(interest) was added because of non payment!. I was so relieved and grateful that she did this, Agreement is pay for 18 months at $276.95 starting 2/15/2025. She would send out today 1/3/2025. As of today has not received!Business Response

REPUBLIC FINANCE ************** Balance: $5,894.00 REPUBLIC F ********** Balance: $5,417.00 As per IRS regulations, a canceled debt of $600 or more necessitates the filing of a 1099-C form by federal or government agencies, or applicable financial entities. Failure to comply with this requirement constitutes tax fraud, a serious offense that I will not hesitate to report to the IRS. It is essential to understand that a canceled debt is considered ordinary income by the IRS. Consequently, any failure to file a 1099-C form, or any attempt to conceal such actions, constitutes inaccurate reporting. Income is not to be included on a credit report, and any such inclusion violates consumer laws and regulations. Your company's actions are in clear violation of the Fair Credit Reporting Act (FCRA), specifically 15 USC 1681s-2, which outlines the responsibilities of furnishers of information to consumer reporting agencies. Under this statute, it is prohibited to furnish inaccurate information knowingly or with reasonable cause to believe it is inaccurate. It is evident from my previous communication and this notice that there is reasonable cause to believe the information provided is inaccurate. Therefore, it is imperative that you take immediate steps to rectify this situation by deleting the inaccurate information from all consumer reporting agencies. Failure to comply will result in legal action being pursued, including holding the ******** **** ** ******* accountable for willful noncompliance under 15 USC 1681n(a)(1)(A). According to the FCRA, a dispute notice is complete when it is submitted in writing directly to the creditor (i.e., not through a private, non-profit organization such as the BBB) and includes the following: (1) sufficient information to identify the account in dispute (e.g., consumer's full name, address, telephone number, and account number); (2) the specific information that is being disputed and an explanation of the basis for the dispute; and (3) all supporting documentation or information to substantiate the dispute, to the extent available (e.g., a copy of the relevant portion of the consumer report that contains the allegedly inaccurate information, a police report, a fraud or identity theft affidavit, a court order, or account statements). Therefore, Republic Finance has determined the Consumer’s credit dispute is incomplete because it does not meet all of the three afore-mentioned requirements. Republic Finance received my check for a payment on a Loan in their after hours drop box and never deposited it. I received an email indicating my payment was going to be late I went to the local office, they HAD MY CHECK. I informed them I received a late notice, they apologized and said they got my check in the drop box but it was misplaced because of the 'Holidays'. I completely lost trust with them so I paid off the entire balance of this loan and they gave me the check from November that I had placed in the drop box back. They then reported me being late and my credit score took a 60 point hit.Business Response

Below are the details of the account in question: Creditor Name: Republic Finance Account Number: ************* Original Balance: $2,073 Current Status: Charged Off and Past Due Issue: The account is being reported as "charged off" while simultaneously reflecting a "past due" balance of $1,898. This dual reporting is inconsistent with the Fair Credit Reporting Act (FCRA), which mandates that information furnished to credit reporting agencies be accurate, complete, and not misleading. Additionally, since the account was charged off in June 2019, I should have received a 1099-C (Cancellation of Debt) form for tax purposes. Republic Finance stole around $600 from me through overcharged interest rates. Each month they added an additional $20 to my account for the 3 years which comes to the previous stated total. When you log in to your account each month, the only thing it shows is the amount you owe minus an interest rates, etc. Each time I called to inquire about this, all management would say is they did not know why this is all that was showing each month. They denied this was happening, but I kept my own records and then asked them about the additional $20 each month and one manager said it was interest. I explained to him again that I could not really see what was happening with my account. Each time I inquired, I received a different answer.Business Response

The Consumer filed a complaint with a federal regulator, the Consumer Financial Protection Bureau (“CFPB”), regarding the same matter on December 16, 2024, which is substantially the same as this complaint that he filed with the BBB. As of the date of this response, the CFPB complaint is still open. Republic Finance is actively investigating that complaint and will respond to that complaint with the CFPB.

The loan in question was charged off, and as per standard reporting practices, it should appear on my credit report as a charge-off only for the month in which it was charged off. However, the company has been reporting that this account has been reported as a charge-off every single month for the past three years. This repeated reporting is incorrect and does not comply with established credit reporting guidelines. In addition they will not give me the 1099-C showing that the account as been charged off and I have been contacted by a collection agency. (Please see the attached)Business Response

Republic Finance responded to the CFPB complaint on December 16, 2024. Republic Finance has completed an investigation and mailed a letter under separate cover detailing the results. Republic Finance considers this matter closed.
