Upon receiving her complaint, Republic Finance immediately investigated the statements made therein. As a part of its investigation, Republic Finance’s Regional Vice President (“RVP”) attempted to contact the Consumer to discuss this matter, and to reach a mutually agreeable resolution, with the Consumer on numerous occasions. Specifically, Republic Finance’s RVP attempted to reach the Consumer by telephone to discuss this matter on March 18, 2024, March 25, 2024, and March 26, 2024 but was unsuccessful in his attempts. Republic Finance mailed a letter on March 26, 2024 to the Consumer requesting that she return our calls to discuss this matter in detail. As of the date of this response, the Consumer has not contacted Republic Finance.

I took out a loan with this company in 2021. I was working and faithfully paying. I encountered health issues and fell behind on my payments. I lost my job and couldn't afford to pay anymore. I had not heard anything from the company, but I just started working and have received notation from my employer that my wages are being garnished. I reached out to the company with no answer. I received an email stating that I could make arrangements to settle the debt if I reached out by 3/15/2024. I called 3/6/2024 and I was told no offer exist and that the garnishment has already been filled. The issue I have is the amount as well as the form, in which they ask you for collateral but now they don't want the collateral you listed but money instead. Second, I don't like that I received a letter to reach out by 3/15/2024, but the garnishment had already been filed and scheduled to take my first check on 3/15/2025. Crazy part is that I just got this job. They couldn't locate where I live or call my phone, but they were able to locate a new employer to serve me with garnishment papers. This company needs to be looked into. Why file a garnishment order before the date on the offer letter came. I had no chance to reach out and get it taken care of and now she stated they want the whole amount. Now I have to file for a bankruptcy or risk not being able to feed my kids or provide shelter. I have an active loan with Republic Finance of Columbus, Ga and renewed the loan last year. The loan was renewed by using my 2010 Hyundai Elantra. They paid off an existing loan with a different company that the car was with which only had approximately 1,300 left on it. RP were eager to pay off that loan & renew my loan with them. Fast forward I inquired about the loan and what it would take to pay off to get the car title back. They informed me that I must pay the loan off in its entirety for the over 10k. I’m trying to understand why when only 2k was taken out for the vehicle. I pay my monthly bill & due to how much it is I can’t afford to pay any extra due to my insurance also went up almost double to have it used as collateral on the loan. I am not trying to get out of paying, I just want to get the correct amount to pay off for my car title. It is highway robbery and unethical to think someone can ever pay this company off.Business Response

Please allow this to serve as Republic Finance’s response to the Consumer’s rebuttal to our response submitted to the BBB on March 1, 2024 regarding this matter.
Republic Finance immediately investigated the Consumer’s rebuttal and her statements made therein. Republic Finance’s records show that on or about March 1, 2024, it mailed a letter under separate cover via Regular U.S. mail to the Consumer at the address she provided in her original complaint. The March 1, 2024 letter details the three separate attempts to contact the Consumer by Republic Finance’s Regional Vice President (“RVP”) and provides her contact phone number. The RVP is willing to discuss this complaint in detail and is awaiting a call back from the Consumer. They advertise you can pay online. However they do not allow payments online always. They will make it to where you are unable to make your payment online. The only way you can make your payment is over the phone with a live person. Which I do not feel comfortable doing. I receive the loan with the understanding I can make my payments online. Which is not true if you are late at all. They lock your account so you have to basically miss work to make a payment. I am deeply troubled by the unauthorized sharing of my nonpublic information with credit bureaus, resulting in inaccuracies on my credit report. This violates my privacy rights under 15 USC 1681 Section 602 and contradicts 15 USC 1681 Section 604 A Section 2 regarding the need for my written consent. The inaccurate reporting, especially in regard to payment history, breaches 15 USC 1666 B, causing significant financial and emotional distress. I request immediate rectification of these errors and a prompt resolution plan. Please address this matter urgently and rectify the inaccuracies associated with 181400005 Despite multiple attempts to resolve this issue with both the data furnisher and the credit bureau, proper protocol and procedure have been ignored in the requests for removal of inaccurate and fraudulent information. The burden of proof to deny my request has not been met, despite submitting multiple FTC reports, signed witness statements, and affidavits. I have provided sufficient information to prove my identity, and any request for more sensitive identifying information, considering my identity theft victim status, could contribute to further misuse. Continuation of denial infringes upon my federally protected rights under the FCRA, Fair Credit Billing Act, Truth in Lending Act, and Equal Credit Opportunity Act. Due to repeated denials without tangible proof or a sworn affidavit from the credit bureau, asserting legal proof that the items were not from identity theft, these items should be removed immediately, complying with the 5-day mandate of Federal Law.Business Response

Republic Finance immediately reviewed the Consumer’s statements made therein. Under the Fair Credit Reporting Act (“FCRA”), Republic Finance is obligated to investigate credit disputes that are complete and meet certain requirements. According to the FCRA, a dispute notice is complete when it is submitted in writing directly to the creditor (i.e., not through a private, non-profit organization such as the BBB) and includes the following: (1) sufficient information to identify the account in dispute (e.g., consumer's full name, address, telephone number, and account number); (2) the specific information that is being disputed and an explanation of the basis for the dispute; and (3) all supporting documentation or information to substantiate the dispute, to the extent available (e.g., a copy of the relevant portion of the consumer report that contains the allegedly inaccurate information, a police report, a fraud or identity theft affidavit, a court order, or account statements). Therefore, Republic Finance has determined the Consumer’s credit dispute is incomplete because it does not meet all of the three afore-mentioned requirements. If the Consumer has any additional information to satisfy the requirements set forth above, she is welcomed to submit a complete dispute notice directly to: Republic Finance, LLC, Attn: Credit Dispute Team, 7031 Commerce Circle, Suite 100, Baton Rouge, LA 70809-1394. I cashed a loan check by mail in April 2023. My payments were due on the 20th of each month. *********, called me about a week later to see if I wanted to change my payment date to the 1st since that is when I get paid, she said all I had to do was come in and sign a paper stating I wanted to do so. I told her no keep the date the same. I went on line a couple of days ago to make a payment and saw my payment was due on the 28th. I did not go in to sign anything asking for a date change. It also showed I had a 82.00 credit that should be more if I'm paying about 16,17 days early. This is not right. I have been doing business with Republic Finance for some time now. I obtained this loan 11/14/2022, the loan ammount was for 8025.00 at an interest rate of 35.99% for a 4 year term. The issue is there was some non transparency and I believe this is just general predatory banking and usury. The total loan on the $8025 comes out to $23,520. That is the equivalent of almost 300% interest. At the time of obtaining this loan it was explained to me that there were insurances included and was interpreted by me to mean included as in no fee. But they added another $4,132 in charges to the original $8025 plus a finance charge of a whopping $11,137, 150% of the amount borrowed. This is criminal and I can only imagine how many other people are in this debt trap. On top of all this there is no principal balance for the original loan ammount, I checked in for my loan payoff over the course of 2023 and the payoff remained at $9700 the entire year and remains as such. I cannot justify continuing to pay these people, I have already paid them $6000 and I would like for them to wave their absurd finance charge and insurance charges of almost $16,000 and just charge me the 35% interest on $8025 and let me pay them the last $2000 of the principle that should be remaining plus their $2800 in interest and go our separate ways.Business Response
