      Stenger and Stenger filed a civil case on behalf of **************** in March 2022 for the total amount of 1585.00.That amount was garnished and paid in full.It appears that a 2nd case(DUPLICATE) was filed for the same exact issue for the same company, **************** Oct. 2023 and the garnishment has begun today, Feb, 2 2024.The cases were filed with 2 different clerks for the same company for an amount that has already been paid.Thus far as of this writing, ****** has been garnished from my wages.I have attached both cases What I am looking for is for this garnishment to cease and any monies collected be refunded as this balance has already been paid.

      Stenger & Stenger, P.C. is in receipt of your BBB complaint #******** wherein you indicate that the balance for your file was satisfied via garnishment in March of 2022, and you are now being garnished again for the same case. Please note that Stenger & Stenger has previously communicated with your place of employment regarding the past garnishments in 2022. All the garnishment funds that were previously sent to the court in 2021 and 2022 were returned to your place of employment via a mailed check following a hearing on January 26, 2022. The check was mailed by the court on or about February 1, 2022, for the total monies garnished. As such, Stenger &Stenger refiled the garnishment that you reference in your complaint. In Stenger & Stengers communications with your employer, the firm provided them with the date the court sent the check, the check number, and the address it was sent to. To date, Stenger & Stenger has not received any funds from the garnishments.  The firm has filed a request with the court to release any garnishment funds in their possession to Stenger & Stenger. If the amount released by the court exceeds the amount listed on the garnishment, a refund will be sent.       On November 17, I paid the original creditor my entire balance of $1656. On November 20, I called *********************************************** to update them that I had paid and was told that was incorrect and was urged to pay them the full amount and stop payment on the original creditor. Not wanting my wages to be garnished, I did that and paid them in full as well, $1659. Only the original creditor refused to stop my payment. Neither of the companies could do anything until the payments completely cleared my account. Both payments cleared my account, then the companies need to communicate to see who will be issuing the refund (a debacle in itself). I call the office numerous times and talk to numerous representatives. I email with my own documentation to help the process. I get confirmation on December 1st that *********************************************** will be issuing my refund FROM a representative at Stenger and Stenger, as well as a representative from the original creditor. They tell me 40 days. Takes 30 seconds for them to type in my account information but 40 days to process a refund due to being understaffed. I continue to follow up with emails because its Christmas time, I have an 2 year old and my bills still need paid. I call again, then Im told 60 days. I call again, ** told that should have happened immediately. Every time I call, ** told something different to oh the refund is currently being processed to I dont see any documentation here stating youre to be receiving a refund. *** sent numerous emails with ZERO response to any of them. Today ** told initially that they can see a refund being processed and to call back at the end of the day. I call at the end of the day and am told there is no where indicating Im to be receiving a refund. I spoke with the original creditor today who has documented they spoke with and have in writing they communicated with *********************************************** on 11/30 for them to process the refund. Its now been 53 days since I sent payment with no refund.

You further state that when you called Stenger & Stenger, an agent advised you to pay the law firm and to cancel your payment to our client.  You also indicate that you are told different information every time you called in, that your emails have not been responded to, and that you a dissatisfied with the turnaround time to process a refund. Please note that our records indicate that your refund was processed and mailed out on or about January 11, ****. Lastly, the firm requires explicit consent to communicate via email. As such, the primary method of communication for Stenger & Stenger is done by phone.       They filed a claim at my local courthouse but yet they have the wrong address for me claiming I ignored all notices that have been sent to me. I want information sent to me at my address if they expect me to pay anything towards the debt.

      I got a letter from my state court house stating that lvng fund llc are sueing me for a 3 year old debt they bought from credit one bank and they are having *********************************************** represent them in court. The debt they are trying to collect from me is $811 total will be $888 after court fees funny thing is the credit limit that I had with credit one bank was for only $400 so how is this lvng llc coming up with $811 ? On top of this I have never received any thing in the mail that my debt was sold to you and only found out when I got this summons a few weeks ago I never knew you were trying to collect the debt you never sent me any mail to know so I never got a chance to try and settle with you. Now three years later and at the worst timing possible I have you sueing me lol look I owe credit one yes you bought the debt for pennies Ill pay the interest that built up on it which would be $600 I would like to avoid going to court if possible but if it comes down to it Ill make sure to show the judge all the complaints about *********************************************** and also file a class action lawsuit if they pull anything shady on me like they have done to others. Im willing to settle this if you are right now you wont let me talk to you over some solosuiit thing I have no idea how that happened but you have my permission to talk to me so please contact me and lets resolve this so I and you can move on with our lives please.

Please note that prior to filing suit and you receiving the summons, a letter regarding the debt was sent to the same address that the summons was sent to on or about October 24, 2023. Please also note that on or about December 20, 2023, we received an authorization letter from Solosuit that contained your signature; however, pursuant to your request, we have removed Solosuit from your file so that we can communicate with you directly.       I am rejecting this response because: They waited 3 years to *** me I got a letter in the mail out of the blue a month ago that they are taking me to court for a 3 year old debt I had with *********** LLC thet I never knew I had a debt with I never received anything about me owning a debt to them even though they claim they sent me a letter back in October 2023 at my address about trying to collect this debt the only reason found was from the mailed summons I guess they bought the debt I had with a credit one bank for $600 that got jacked up to another $811 by living fund LLC. So I called a couple weeks ago to set up a payment arrangement on the 3 year old credit card debit to try to avoid going to court and they agreed on me paying $68 a month till my debt was paid with living fund LLC I called today to make a payment but before I made the payment I asked why I couldn't see the balance I owed after I make the payment they didn't say anything then I asked why I never received any paperwork they were supposed to mail to me on our agreement so we could let the court know we made a payment arrangement and didn't need to go to court. Come to find out they are still going to court even though I set up payment arrangement and was going to pay them the agreed payments and I was also told that I was going to have to pay another $500 on top of the $811 for court fees ECT how crappy we came to an agreement I called to make a payment and you still are trying to take this to court and now extortion me of another $500 bringing the debt to $1500 wtf you seriously need to be investigated idk why the BBB hasn't stepped in yet and shut you down seeing all the horror stories on the BBB about you and on your website reviews from people you screwed over.oh I did talk to my aunts lawyer and you lied to me about the $500 added fees he called the county court house and they told us the real amount of cost sad you had to lie to me I really wanted to work with you but I guess I'm better off leaving this in the courts hands.

      This company was sent my refund check after being completely paid off, I was told I would be sent the overpayment of $990.00 in 60 days. I have not received my check and everytime I call they are extremely rude. They have my money and have not made any attempts to get it to me

      I have been paying on an agreement since 10/13/2021 without incident until my November 2023 payment was due. I received a letter stating I had not paid my monthly payment despite their being proof in their files. As I used an attorney, they stated they could not speak to me at all, not even for basic questions (like if their system may have had an issue and sent it in error). Instead, I was met with rude and condescending responses from the first person I spoke with. I gathered the information about what was needed to get it 'released' despite having had my original attorney do so as I knew it may cause issues in the future. They stated they never received it. I got the letter sent a second time and they informed me 24 - 48 hours it would be through their system and I could speak with someone. I called more then 48 hours later yet the release still 'wasn't in their system'. I then contacted my attorney who showed me when she sent the release over (which was exactly when she said she did and more then 48 hours before then). They won't speak to me until the release is there yet it is but they won't process it (again) so they can't speak with me. They wrongfully said I have defaulted on a payment but I can't fix anything. Because it has happened more then once, it makes me feel as if they are trying to take advantage of people and send them into default on purpose to be able to collect more money.

The firms records indicate that the attorney on your file has been removed, and that you were able to call in on December 6, 2023, and set up your payment plan for $50.00 per month due by the 15th of every month. If the payment is received later than the fifteenth of the month or for an amount less than $50.00, you may receive a late payment letter. Lastly, please note that original signed consent judgment for your accounts was for a $100.00 per month payment plan, with $50.00 going to each of the two accounts included in the underlying lawsuit.       I paid off a balance with a garnishment and a lien on my property. The garnishment was released on October 16th. Two extra payments was sent to ******************* and they have not returned them to me or employer. They have yet to send the lien release in which with ** statue they have 30 days from when its paid off to send the release when calling ******************* they have no resolution and tell me contradicting storys and tell me I must wait. This is unacceptable as it needs to be addressed.

      I have been trying to get a letter of my payoff either faxed or emailed to me and/or a title company that my brother and I closed with that needed this info to pay off the debt. I have been calling them several times a day for over a week and a half. I still have nothing. No letter or any type of document stating an amount I owe. How do they expect to be a debt collector if they aren't helping to get info for the debt to be paid? This has put a hardship on my family, we need this resolved so I can get my money from the company I'm closing with that was paying this debt off .

      Stenger & Stenger, P.C. is in receipt of your BBB complaint # ******** wherein you indicate that you have been attempting to obtain a payoff letter for the remaining balance of your account for a week and a half, but have not received it, and that it has been a hardship on your family. Please note that our records indicate that the first request made for a payoff letter to be sent to a title company from our office was on November 6, 2023. In order for Stenger & Stenger to send a document containing personal information to a title company, the firm requires several identifiers to ensure the documents are being sent to a proper party which may include the address, your signature, last four of social security, case number, etc. Without a payoff request, or authorization to email you, the document was sent via regular mail to your address on November 7, 2023.  On November 10, 2023, you provided authorization for Stenger & Stenger to email you, and the payoff letter was sent to you via email on November 14, 2023.       Stenger & Stenger, P.C. is in receipt of your BBB complaint # ******** wherein you indicate that you have been paying a debt for a few months, but Stenger & Stenger wont assist in setting up an arrangement with your financial hardship.

      Stenger & Stenger records indicate that a settlement arrangement was set up on July 10, 2023, wherein the outstanding debt would be settled for a discounted amount spread across three monthly payments, with a final payment due on September 30, 2023. While the Stenger & Stenger received your first two payments timely, the firm has pushed the due date of your third and final payment twice to its current due date of October 31, 2023, at your request. Stenger & Stenger is willing to assist by delaying a due date 30 days; however, it is firm policy to refrain from extending due dates over a month beyond their original due date. That being considered, the firm will agree to accept your final payment of the settlement arrangement by November 28, 2023. Failure to pay the final payment amount by this date will result in the settlement agreement being broken, and the remaining balance being due.
