I am not liable for this debt with Sun Loan Partnership and do not have a contract with Sun Loan. They did not provide me with the original application like i asked.Business response

On January 4, 2022, ************** took out a loan for $269 at the Sun Loan *****, ** office, which called for a total payback of $45 a month for 6 months. Three payments were received, and the loan was charged off on September 30, 2022.
Two indirect disputes were received and responded to within ********************************************************************************************** the complaint. We cannot delete the tradeline as ************** has requested as that would be incorrect credit reporting. We have included a copy of the original signed contract and application. On December 21, 2015, ******************** took out a loan for $259 at the Sun Loan ******, ** office, which called for a total payback of $43 a month for 6 months. No payments were received, and the account was written off on May 31, 2016.
On January 19, 2016, ******************** telephoned the Sun Loan office, and made a promise to make a payment on January 20, 2015, but no payment was received.
Regarding the request for a copy of the application letter ******************** references in his complaint, we have not received any correspondence from him. On September 19,2020, we received an indirect dispute from *********** disputing the date of first delinquency, account status, compliance condition code, special comment code, and date closed. We reviewed the account information and responded to the dispute on October 6, 2020.
As far as ******************* not being liable for the debt, we have included a copy of the signed application, loan contract, identification card, personal references, and check stubs he provided when he took out the loan.
We have reviewed all three credit reports and found that Experian is not reporting any data and Equifax and *********** are both reporting correctly as charged off status. It would be incorrect for us to delete the tradeline as ******************** has requested.

On November 2, 2022, we received a complaint from *****************************, the daughter of our customer, Mr. ************************* located at the Sun Loan Company, ***********, ** office. On August 17, 2021, ******************** listed **************** as a personal reference on his application along with her ***** number. Ms. ******* complaint states that she has requested the Sun Loan office remove her ***** number from the account and discontinue calling her. She says that the Sun Loan office has continued to contact her after she requested to be removed from the account. The District Manager has investigated and confirmed with the Branch Manager, that Ms.******* ***** number has been removed from the personal references on Mr.********* ************** We apologize for any inconvenience and **************** can contact Sun Loan Company at ************** if she has any questions.Initial Complaint

On August 4, 2022 I paid sun loan my payment of 178 they charged me **** for payment over the phone but without my consent they took 20 dollars for supposedly late payment without letting me know, I then gave a payment on August 25, 2022 for another 178 with the **** fee and they took 10 for supposedly another late fee without letting me know. Now they are saying I still owe $30 on late fees. They take money out of the payment without letting the customers know and leave them with a balance so they can charge a late fee. I spoke to ****** the store manager and she would not let me speak and did not give me an explanation. Can you please help.Business response

We have reviewed ************** BBB complaint # ******** on July 25, 2022 and responded on July 28, 2022, requesting account #**** be deleted from her credit report. We investigated the account further and made the decision to delete the account from her credit report. We have submitted a manual request to the credit bureaus to update the reporting. We ask that she please allow a minimum of thirty days for this information to update on the credit file. On 2/16/22, I filed a consumer dispute with ********************* regarding inaccurate and unauthorized data. This complaint is specifically against the furnisher of that information, Sun Loan Company.My privacy was violated. I have been treated with impartiality and unfairness for over 60 MONTHS. Pursuant to 15 U.S. Code **** - Congressional findings and statement of purpose (a)Accuracy and fairness of credit reporting The Congress makes the following findings: (4)There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy.After Transunion's and Experian's "alleged" investigation was complete; On 3/25/22 submited a notice to Sun Loan notifying them of the consumer violations against me. The certified letter returned to me as "undeliverable".On 4/10/22,due to the responses that I received from Transunion and Experian, after their "alleged" investigation, I followed up with CFPB complaints: ******************************************* On 4/14/22 I submitted a CFPB complaint directly against Sun Loan CFPB#******-8517119. I gave none of these consumer reporting agencies written permission to furnish any information on my consumer report. Pursuant to 15 U.S. Code ****b - Permissible purposes of consumer reports (a)In general Subject to subsection (c), any consumer reporting agency may furnish a consumer report under the following circumstances and no other:(2)In accordance with the written instructions of the consumer to whom it relates. Furthermore, Sun Loan is intentionally reporting a cancelled debt (charge-off) greater than $600. I am still waiting on my ****. According to IRS publication 2021 cancelled debt is income. Income can not be reported on the consumer report. Sun Loan is continuing to report this income as an "alleged" debt on my consumer reportBusiness response

On June 28, 2016 ****************** took out a loan for $263 at the Sun Loan at the ************* office, made four payments and then refinanced it on November 15, 2016 for $567. It called for a total payback of $71 a month for 8 months. No payments were received on the refinanced loan and the account was charged off on April 29, 2017. As to the account being cancelled as stated by ******************, Sun Loan did not cancel the account when it is charged off nor was it reported to the *** as gross income and we did not issue Form 1099-C. The account will continue to accrue maturity interest as stated in the signed contract until it is paid off and Sun Loan will continue to report the account status for 7 years from the date the loan was taken out. We have included a copy of the signed contract. We will not delete the account from ****************** credit reports as requested as that would be incorrectly reporting the account.We have reviewed all three major credit reports and have found that Equifax and *********** are not reporting any data and Experian is reporting the account as charged off with a balance of $567. If ****************** has any further questions or would like to discuss a settlement, she can call Sun Loan corporate office at ************.Customer response
