********* is a 5th class city that has a no solicitation ordinance which is clearly posted on all entrances of the city. My wife was harassed by an employee of the listed business. He approached the house, knocked and rang the doorbell in an attempt to speak with my someone in the home to try and gain business through a sales door to door sales. My wife politely informed the person that we were not interested during a conversation with the door closed for her safety. The employee again knocked and rang the doorbell to try and continue with his sales pitch. This made my wife very uncomfortable and feel unsafe. We have notified local authorities of this incident. We would like for our address to be removed from the company list of houses to solicit business from. This is not the first time we have been solicited by this company.Business Response

I am writing to formally complain about the repeated and unsolicited visits from Moxie Pest Control sales representatives to my home, despite the presence of a clearly visible "No Soliciting" sign. These visits are a clear violation of my expressed wishes for privacy and non-interruption. As per San Clemente Municipal Code Section 5.12.090, it is unlawful for any person to solicit at a residence where a "No Soliciting" sign is posted. Specifically, the ordinance states: "No person shall solicit, peddle or canvass at any residence where the owner or occupant has posted a sign bearing the words 'No Soliciting' or words of similar import." Violation of this ordinance can result in fines up to $500 for each offense. I'd like this business to be fined.Despite my clear display of this sign, your representatives have rung my doorbell on 6/5, 6/24, and 6/25 of 2024 just this month. They have come before too I just don't have all the dates. These unwelcome visits have caused significant disruption and distress. As a consumer, I have the right to refuse unwanted solicitation, and I expect that right to be respected.Business Response

Moxie signed me up for pest control (door to door salesman) May 2024 because I had ants in my kitchen. They assured me that the only used all natural products and no poisons. At my second treatment I reached out just to verify again that all the products were all natural because I have a two-month old baby and a family history of cancer at a very young age. The rep said that I had not signed up for the all natural option and that they were planning to come and spray poisons and had already done so at the first treatment. I told her I absolutely did not agree to this and to have the person coming that day contact me because I never consented to any poisons on my property. She said the rep would call me before coming to the house. I never received a call but then got a email stating that a number of poisons had been sprayed on my property against my wishes. This is so unacceptable. I told the rep that I will call the police for trespassing if they ever return to my property, but they haven't responded.I can upload the transcript of my text messages with the rep along with email from employee that illegally treated my lawn if you need proof of this. In April 2024 a young man came to the door on his segue soliciting for pest control. He explained that I could get a rate of $99 per visit for treatment of my yard for ticks and the foundation of the house would be sprayed to control other pests like ants. He said the company requirement for this price was to sign up for 4 treatments. He had a tablet where he asked me to sign and took my credit card information. No paperwork was handed to me. 2 trucks arrived the next day spraying the foundation and a guy walked thru the yard with a hand held spreader putting something into the yard. I was billed $99 plus tax on my credit card. The 2nd time they arrived in 2 trucks on May 18th. They were here less than 5 minutes spraying something at the front door and dusting for cobwebs. I thought that it was ridiculous to pay $99 for this service. Well I was billed $148.73 for the 2nd visit and I called to complain about the over charge. I was told there were actually 5 visits and only the 1st visit was $99The remaining 4 visits are $148.73 each. I complained that I was not advised this by the sales person nor was I given anything. They claimed that the contract was emailed to my email address. I have no record of this emailed contract !I requested to cancel the rest of the service calls and was told that the cancellation fee was 80% of the remaining 3 quarterly treatments. When I continued to complain and speak with management I was given Kala x547. She basically told me I should keep the service because it would cost me the 80% ($356.95) if I cancel and she would adjust $40 of the May 18th visit but couldnt do anything more. This is truely ridiculousa true ripoff of the consumer. The guy who came to my door never mentioned anything about a cancellation fee and misrepresented the quarterly fees as $99 each so instead of my estimated $400 plus tax for this service Im looking at $662. The kid said they had a local Pgh Pa ofc but NO you have to deal with *****.Business Response

I am rejecting this response because:
This response only verified that I have paid for 2 visits to my home by this company. They are going to bill a higher rate for 3 future visits and even thou the sales person that came to my home quoted a rate of 4 visits at $99 per visit they will not honor that quote. This is deceptive practices. They will bill $139 for 3 future visits and if I cancel will bill me 80% of those remaining fees. A cancellation fee was never discussed by the sales person at my home. I feel Ive been duped and Im not alone.Business Response

I was leaving my home and approached my a staff of Moxie. He said he needed 10 minutes. He said they were doing a special to treat outside and inside for $99. I wasn't going to be home for the inside and he said it could be done at another time, to just call to schedule. He took my credit card and had me sign. I did not have my glasses and was leaving for an appointment. I asked if that was the charge of $99 dollars and he said yes. He did not cover and contract, I was not given one nor was one emailed to me. The date of service was 5/20/2024. I received a text or email they were coming back out about 3 was later, I thought it was about the inside of my house and responded that I wasn't available for additional 2 weeks. I got no response. They came to my home on 6/18/2, I wasn't home. They then charged me $129, I called the company to dispute the entire sales tactic request a refund of $129. They told me about the contract that I signed. I tried to explain the salesman and they continued to go back to the contract. I told them I wanted nothing to do with Moxie. That same day they charged me an additional $309.60 causing an overdraft with my checking account. The salesman did not answer truthfully about additional charges when asked.Business Response

First treatment 5/20, I thought that was all I agreed to. Text 6/17 they were coming the 18th for quarterly maintenance. I thought they referred to interior as it was not done. Texted back to come 6/27. They came anyway and treated outside, I was not home. Now quarterly means every 90 days. Why would they treat property 30 days apart? I expect an answer to this from company.. This sale is unethical business practice. I thought I signed a sale of $99 period. The sales did not explain a contract or treatments, as I would not have gone through with sale. I will take this to small claims in massachsetts if not resolved.Business Response

Good afternoon. I have been dealing with Moxie Pest Services for the past year. On multiple occasions I have tried to cancel my service. I was in contact with their customer service on November *********, and was told it would be over ****** to cancel. I agreed to continue services at the time. Om March 27 2024, I called to get my services canceled with the cost being lowered due to 2 additional services. I was told an account specialist would contact met. I never got that call, and continued to be placed on hold despite multiple attempts to speak to someone. I received a text message today on June 17,2024 saying that I would be having service completed on Wednesday. I called their number and spoke to a service associate named ****** after being on hold for 30 minutes. I asked about canceling my services. I explained I had tried to do so in the past, and never got a call back. I asked to speak to a supervisor and was told they were busy and not available to speak to me. I was told someone would contact me back in ***** hours as before, and never spoke to anyone. I would like assistance in making sure someone from the company does call me back to cancel services, and support if possible. I wish I had never encountered them, and want them away from my property.Business Response

CountrySide Proprietary is a non-soliciting HOA community in ******** **. For the past 3 years (including today, 06.17.24) Moxie Pest Control representatives have blatantly ignored the posted non-soliciting signs in the community and have harassed the residents at all hours of the day, including as late as 10PM at night. The ****************** has sent cease and desist letters to the local branch in ********* VA every year along with a clear map, showing the community's boundaries. Moxie Pest Control continues to ignore the posted signs and when turned away by residents will return 2 or 3 times on the same day to try and brow beat the residents into new business.The community residents have been directed to contact the Loudoun *********************** to trespass Moxie representatives from the community, which we made Moxie aware of in the letters we sent, and even that has not deterred them.Business Response

I am rejecting this response because the sales personnel are NOT permitted with the ********************************** This company has continued to show utter disregard in their responses. The ****************** has now contacted the Loudoun *********************** and ANY Moxie Pest Control representative will now be arrested for trespassing if they are within the community boundaries, unless they are performing contracted work at an individual residence and are able to provide proof of an active contract.
